Ice Bear Court Meridian, lD 83642 Dear Ms. McBride: Thank you for your August 11 ,2011 letter regarding the drive through pharmacy that is being proposed for the planned Wal-Mart at Stoddard and Overland. Your letter and this response will be included as part of the hearing record when this item has its public hearing in front of City Council on August 23,2011 and the Planning and Zoning Commission on September 1,201l. Since these are active applications, I am responding in order to maintain neutrality for the Mayor, City Council and Commission. Please understand that at no time has a vote been taken specifically for a Wal-Mart as your letter states. [n 2007,the subject property was annexed and zoned C-G for commercial uses. Allowed uses in the C-G district consist of commercial uses on the largest scale and can include a broader mix of retail, office, service and light industrial uses. When this properly received its zoning designation in2007, that designation identified the permitted uses and standards to accommodate future development; it did not identify any specific user as part ofthat process. A development agreement was required as a provision of the 2007 annexation. The City Council will hear a request to amend the existing development agreement to address specific conditions of approval and the approved conceptual site plan. This is the only issue that is under consideration by City Council as part of their hearing. The actual consideration of the drive through pharmacy is by the Planning and Zoning Commission. That hearing is September 7, 2011 and is limited to consideration of the drive through as the retail store is a permitted use. The properfy has already received its entitlements and construction could occur without this hearing taking place if the application was not seeking to makes changes to the underlying Development Agreement. While I understand you are not happy with the proposed business in this location, I wanted to make sure you were aware of the history and process and what is being considered at the hearings. I would like to however see the hydrant placement that was not on the site plan. Also, just a commenUrequest. I would like to see a dedicated area out in front of the store that would be 12 foot deep and totally removed from the traffic lane for emergency vehicle parking. This would apply for fire, police, EMS. The vehicles would be out of the traffic lane improving both responder safety and the safety of pedestrian traffic as well. Any questions please let me know. The group came up with a suggestion of requiring speed bumps on the south side to prevent that area from being a speedway cut through causing noise and helping to prevent someone from getting hurt. The black lines on the south side are suggestions for speed bump areas. lf the walmart was required to keep the same hours as Lowes and not 24 hours it would help keep noise pollution down and better serve a neighborhood environment.
