Title 6 Chapter 9 (the Idaho Tort Claims Act), and to any other limitations set forth in the
agreement.
9. City shall not sell, assign or otherwise transfer this MOU, the license herein extended,
or any of its rights hereunder.
10. This MOU, the license herein extended, and the covenants and agreements herein
contained shall inure to the benefit of and be binding upon the parties hereto and their successors
and assigns.
11. This MOU shall not be recorded in the Official Real Property Records of Ada
County or Canyon County, Idaho.
12. In the event suit is instituted for the purpose of enforcing any or all of the provisions
of this MOU, the prevailing party shall be entitled to such attorney's fees as are adjudged
reasonable by the Court.
IN WITNESS WHEREOF, the undersigned have caused this MOU to be executed the
day, month, and year first set forth above.
