Project
Description
Modification to the terms of the previously required Development Agreement for
Langly/Power Mall to update the development plan for the site and associated provisions.
Applicant BVA Development
The Idaho Transportation Department (ITD) reviewed the referenced development agreement modification
application and has the following comments:
1. This project does not abuts the State highway system.
2. No direct access to the State highway system is requested with this application and none is approved.
3. ITD has previously received a Traffic Impact Study for Rackham Subdivision (Idaho Central Credit
Union). Modifications have been made to the size of the development that will likely change trip
generation significantly. ITD requests a revised TIS that accurately reflects the increased scope of the
project and analyzes the entire project at full buildout. Any necessary mitigation for traffic impacts
identified by the Traffic Impact Study shall be the responsibility of the applicant to install.
4. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.
5. The Idaho Administrative Procedures Act (IDAPA) 39.03.60 governs advertising along the State highway
system. The applicant may contact Justin Pond, Right-of-Way Section Program Manager, at (208) 334-
8832 for more information.
6. At this time, ITD objects to the proposed application due to incomplete documentation as noted in item 3.
ITD reserves the right to make further comments upon review of the revised TIS.
7. Once all concerns have been addressed with ITD staff, ITD will withdraw any objection to the proposed
application.
