City Council review of the Commission's decision in regard to the following
requirements:
• UDC 11-4-3-2A.1, which requires all outdoor recreation area and
structures that are not fully enclosed to maintain a minimum setback
of 100 feet from any abutting residential district;
• UDC 11-3A-13, which requires outdoor speaker systems associated
with the use to be located a minimum of 100 feet from all residential
districts;
• UDC 11-4-3-2A.2, which prohibits outdoor event or activity centers
from being located within 50 feet of any property line and limits the
hours of operation to those between 6:00 am and 10:00 pm;
• Condition #2.2, which limits the hours of operation of the athletic
club and spa to hours between 4:00 am and midnight (12:00 am) for
indoor activities and 6:00 am to 11:00 pm for outdoor activities, with
outdoor music limited to the hours between 9:00 am and 10:00 pm;
• Condition #2.10, which requires the applicant to work with planning
staff and ACHD to create a crosswalk for pedestrian access to the

The Idaho Transportation Department (ITD) reviewed the referenced city council review application and has the
following comments:
1. This project abuts the State highway system.
2. No direct access to the State Highway system is requested with this application and none is approved.

3. The southbound right turn lane of SH -55 (North Eagle Road) onto East Seville Lane does not meet current ITD
standards. Applicant will be required to reconstruct right turn lane to current ITD standards in order to preserve
the safety and mobility of the State highway corridor. Refer to ITD Traffic Manual Figure 313-4.
4. ITD plans to widen SH -55 in the future. ITD requests a 12 foot dedication of right of way along the applicant's
parcel. This allows ITD to reconstruct the right turn lane in the future with no cost to the applicant.
5. Any work done in ITD Right of Way shall allow for drainage of the State Highway to be contained within the
Right of Way unless otherwise provided for by the local agency.
6. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.
7. IDAPA 39.03.60 governs advertising along the State highway system. The applicant may contact Justin Pond,
Program Manager for ITD's Headquarters Right -of -Way Section at (208) 334-8832 for more information.
8. ITD again objects to the proposed development due to traffic concerns as noted in items 3 and 4.
9. Once the southbound right turn lane has been reconstructed to ITD standards and the required right of way has
been dedicated, ITD will withdraw any objections to the application.
