Box 8028 • Boise, ID 83707-2028 (208) 334-8300 • itd.idaho.gov Development Application H-2018-0137 FP Project Name PARAMOUNT DIRECTOR SUBDIVISION NO 2 Project Location Southwest corner of US -20/26 (East Chinden Boulevard) and North Meridian Road, south of US -20/26 milepost 38.21 Project Description Construct a subdivision consisting of 64 building lots and 8 common lots Applicant Brighton Development, Inc The Idaho Transportation Department (ITD) reviewed the final plat application and has the following comments: 1. This project abuts the State highway system. 2. The US -20/26 corridor study shows this area of US -20/26 requires 100 feet of right-of-way as measured from the centerline of US -20/26 for the roadway, drainage, clear zone, utilities and pathway. Based on conversations with the City, ITD is willing to allow a variance to the corridor study requirements outside the area of impact for the future Continuous Flow Intersection and accept a 70ft right-of-way dedication from the applicant for the paved roadway with an additional 30ft easement for drainage, clear zone, utilities, and pathway. The pathway must be located along the back edge of the easement to accommodate drainage. If the City requires berms or other improvements, they shall be constructed outside of the additional 30ft easement. No structures impeding maintenance of the irrigation or drainage shall be built within the future easement. ITD reminds the City that keeping costs down within this corridor will help with future construction. This final plat depicts the sidewalk easement within the 70 feet of future right of way needed for the paved roadway. The sidewalk as depicted may be relocated at the taxpayer's expense in 2021 when the STARS project widens US -20/26. ITD requests the City's assistance in keeping structures out of the future right- of-way to help reduce the taxpayer expense of improving the highway. 4. Landscaping as depicted in the application will be reduced once the site plan accurately depicts the edge of pavement as called out in the STAR Agreement and as shown in the US -20/26 corridor plan. IDAPA 39.03.42.600.04 rules govern landscaping within ITD right-of-way. No trees will be allowed within 4 feet of the face of curb at full growth. Irrigation systems shall be no closer than 5 feet from the pavement edge and shall be adjusted so as not to cause water to cover any portion of the highway pavement. Installation of any landscaping within ITD right-of-way will need to be addressed by ITD permit and meet the requirements of IDAPA 39.03.42. Provisions shall be established for the responsibility of future maintenance of any landscaping within ITD Right -of -Way. 6. No trees are allowed within the clear zone of the ITD right-of-way. Only planting of forage, plants, grasses, flowers, and shrubs with a mature height not to exceed 3 feet will be allowed. 7. No rocks larger than four inches are allowed within the clear zone of the ITD right-of-way. 8. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway. 9. IDAPA 39.03.60 rules govern advertising along the State highway system. ITD objects to the proposed application due to the encroachment of the sidewalk upon future ITD right of way for planned paved roadway. ITD will withdraw any objection to the proposed application once all concerns have been addressed with ITD Staff.
