The Contract, together with the performance bond and payment bond, if any, represent the entire and integrated agreement between the parties hereto and supersedes prior negotiations, representations or agreements, either written or oral. ARTICLE 2 THE WORK OF THIS CONTRACT The Contractor shall fully execute the Work described in the Contract Documents, except as specifically indicated in the Contract Documents to be the responsibility of others. Contract Requirements: Provide all labor, material, and equipment required to complete the building and site concrete as noted on the drawings and per the following: This contract specifically includes but is not limited to: r Provide all labor, formwork, concrete material, and misc. concrete accessories to form, place, strip and hnish concrete footings, foundation walls, slabs on grade, and exterior concrete slabs as shown on the construction documents. r Furnish and install all concrete reinforcing steel. . Provide all add mixtures and additives for concrete as required and as weather conditions dictate for your work. o Include covering exposed subgrade and concrete with insulated blankets, ifrequired. r Complete bituminous dampproohng. (if applicable) o Provide and install foundation insulation and vapor barrier below slab-on-grade.o Fumish and install miscellaneous concrete accessories where indicated. o Include caulking ofall concretejoints as indicated. o Sawcutting joints as shown in the construction documents. o Include curing of all concrete slabs at the time of concrete placement. e Drilling and epoxy as required to complete all work as noted above. All construction shall follow OSHA standards and requirements. o Contractors Warranty (standard warranty) on the project is 2 years (minimum) from the date of final acceptance in lieu of the I year as indicated in the project manual. Refer to the Supplementary General Conditions included in the bid book. Extended warranties will be as noted in the contract documents. o Per Addendum No 2 - Include installation of(2) coats concrete sealer / hardener as specified. This contract specilically excludes: r Gravel base and structural fill r Excavation, backhll and compaction for concrete. r Masonry reinforcing. o Painting pipe bollards ARTICLE 3 DATE OF COM]UIENCEMENT AND SUBSTANTIAL COMPLETION $ 3.1 The date of commencement of the Work shall be the date of this Agreement unless a different date is stated below or provision is made for the date to be fixed in a notice to proceed issued by the Owner. (Insert the date of commencement, if it differs from the date of this Agreement or, d applicable, state that the date will befixed in a notice to proceed.) If, prior to the commencernent of the Work, the Owner requires time to file mortgages, mechanics' liens and other security interests, the Owner's time requirement shall be as follows: $ 3.2 The Contract Time shall be measured from the date of commencement. $ 3.3 The Contractor shall achieve Substantial Completion of the entire Work not later than ( ) days from the date of commencement, or as follows: (Insert number of calendar days. If an Application for Payment is received by the Construction Manager after the application date fixed above, payment shall be made by the Ov-.ner not later than Thirty ( 30 ) days after the Construction Manager receives the Application for Payment. (Federal, state or local laws may require payment within a certain period of time.) $ 5.1.4 Progress Payments Where the Contnc-t Sum is Based on a Stipulated Sum $ 5.1.4.1 Each Application for Payment shall be based on the most recent schedule of values submitted by the Contractor and approved in writing by the Construction Manager and Architect in accordance with the Contract Documents. The schedule of values shall allocate the entire Contract Sum among the various portions of the Work and be prepared in such form and supported by such data to substantiate its accuracy as the Construction Manager and Architect may require. This schedule, when, and only when, approved in writing by the Constmction Manager or Architect, shall be used as a basis for reviewing the Contractor's Applications for Payment. S 5.1.4.2 Applications for Payment shall show the percentage of completion of each portion of the Work as of the end of the period covered by the Application for Payment. S 5.1.4.3 Subject to the provisions of the Contract Documents, the amount of each progress payment shall be computed as follows: .'l Take that portion of the Contract Sum properly allocable to completed Work as determined by multiplying the percentage completion of each portion of the Work by the share of the total Contract Sum allocated to that portion of the Work in the approved schedule of values, less retainage of Five percent ( 5.00 %).
