Box 770 Meridian, Idaho 83680 Re: Building Permit Issuance at 2340 W. Franklin Road Dear Walt: In regard to our conversation this moming, I am formally transmitting the items of contention from City Planning & Zoning Administrator's office that led to City issuance of a 'stop work' order on the permit that was issued to you by our Building Official, Daunt Whitman. It is my understanding this permit was originally issued because our Building Official viewed this proposal as an accessory use. I understand from our conversation that you did receive a copy of an inter-office e-mail from City Planning & Zoning Director Shari Stiles to Daunt Whitman, dated October 4, 2000, in which she listed problems in the permit request for an accessory building to an existing land use. She determined that this building permit request did not meet the criteria for an accessory building and therefore Ihe request would need to be processed as a request for a Conditional Use Permit. The concerns she listed in her e-mail are as follows: · Annexation requirements for the property have not been met, including making provisions for how the property will be sen/ed with sewer and water and design review of all buildings. · The submitted building plans show expansion of a non-conforming use regarding landscaping, paving, land use, etc. · Needed right of way dedication (sale) to ACriD for future widening of Franklin Road will place this building location within the setback area as set forth by City Ordinance. · Water supply is not available to meet Uniform Fire Code requirements. · ACHD impact fees need to be paid. The foundation you constructed for this building has been setting since the October 'stop work' issuance and, as you related to me, your other construction projects have occupied your time to an extent that this matter has taken a back seat to your other endeavors. I have talked with Shari about yo0r situation and she advises me that you can appeal the 'stop work' order to City Council or make application for a Conditional Use Permit. The 'appeal" application is available at her office and there is a $100 fee associated with its filing.
