Project
Description
• Annexation and zoning of 81.51 acres of land from the RUT zoning district in
Ada County to the C-C zoning district (63.796) and the R-8 zoning district
(17.713 acres) in the City
• Preliminary plat consisting of 16 commercial building lots, 1 residential lot, 2
common lots and 2 other lots for future right-of-way dedication on 78.13 acres
of land in the proposed C-C and R-8 zoning districts
• Variance to UDC 11-3H-4B.2 for two accesses via West Chinden Boulevard
(US-20/26)
Applicant Lynx/ DMG Real Estate Partners, LLC
The Idaho Transportation Department (ITD) reviewed the preliminary plat, variance, annexation, zoning,
and comprehensive map amendment application and has the following comments:
1. This project abuts the State highway system.
2. Linder Village has two accepted access points on US-20/26 (West Chinden Boulevard). See
attached Exhibit A for visual.
Site Access A is accepted as a right-in, right-out approach.
• Edge of pavement is not accurately depicted in the concept plan provided. Approach
must be designed to meet the future US-20/26 corridor plan as described in the STAR
Agreement.

Site Access B is accepted as a right-in, right-out, and left-in approach.
• The concept, landscape, and circulation plan provided do not show Site Access B as
restricted and instead depict a full access, which is not approved. Through movement
will not be possible.
• Edge of pavement is not accurately depicted in the concept plan provided. Approach
must be designed to meet the future US-20/26 corridor plan as described in the STAR
Agreement.
3. IDAPA 39.03.42.08.a states “a minimum setback of fourteen (14) feet from State highway right-
of-way line is recommended, unless a greater minimum is established by an engineering study.”.
Building depicted as Pad D and restaurant building depicted between Pad A and Pad B do not
meet these setback requirements.
4. ITD has reviewed the revised Linder Village traffic impact study (TIS) dated May 11, 2018. The
TIS states that improvements are needed for US-20/26 (West Chinden Boulevard), Fox Run
Way, Linder Road, and Meridian Road. Applicant will be required to build all identified
improvements as stated in ITD’s Linder Village Commercial Development Revised Traffic Study
Acceptance letter dated October 19, 2018.
5. The US-20/26 corridor study shows this area of US-20/26 requires 100 feet of right-of-way as
measured from the section line in US-20/26. If the City requires berms or other improvements,
they should be constructed outside of the 100 feet of right-of-way. ITD will use 70 feet for
construction of the future widening of the paved roadway and an additional 30 feet shall be an
easement with the City for drainage, clear zone, utilities, and pathway. No structures impeding
maintenance of the irrigation or drainage shall be built within the future easement. ITD reminds
the City that keeping costs down within this corridor will help with future construction. A view

6. Landscaping as depicted in the application will be reduced once the site plan accurately depicts
the edge of pavement as called out in the STAR Agreement. ITD’s TIS Acceptance letter and the
STAR Agreement require that the applicant build the full US-20/26 corridor on the south side of
Chinden Boulevard.
7. Applicant is aware that the future right-of-way needs for the Continuous Flow Intersection will
eliminate multiple parking spots and the drive aisle around the front of Building #2 as identified
by the white dashed lines on the concept site plan.

8. Applicant indicated the rest of the parcel is proposed as future residential, office, and retail
development. This portion of the development was not included in the TIS reviewed by ITD.
Future development of the parcel will require a separate TIS.
9. IDAPA 39.03.42.600.04 rules govern landscaping within ITD right-of-way. No trees will be
allowed within 4 feet of the face of curb at full growth. Irrigation systems shall be no closer than
5 feet from the pavement edge and shall be adjusted so as not to cause water to cover any portion
of the highway pavement. Installation of any landscaping within ITD right-of-way will need to be
addressed by ITD permit and meet the requirements of IDAPA 39.03.42. Provisions shall be
established for the responsibility of future maintenance of any landscaping within ITD Right-of-
Way.
10. No trees are allowed within the clear zone of the ITD right-of-way. Only planting of forage,
plants, grasses, flowers, and shrubs with a mature height not to exceed 3 feet will be allowed.
11. No rocks larger than four inches are allowed within the clear zone of the ITD right-of-way.
12. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.
13. IDAPA 39.03.60 rules govern advertising along the State highway system. The applicant may
contact Justin Pond, Program Manager for ITD’s Headquarters Right-of-Way Section at (208)
334-8832 for more information.
14. ITD objects to the proposed preliminary plat application due to inconsistencies with the
preliminary plat that are in conflict with the ITD US-20/26 corridor plan and STARS Agreement.
ITD will withdraw any objection to the proposed application once revisions are submitted,
reviewed, and accepted by ITD Staff.

Hi Sonya-
John pointed out an error in ITD’s response letter. I’ve updated it by striking out item #8 referring to the need for a
revised TIS for Phase 2. Kittelson did include Phase 2 analysis for the additional office buildings and homes in the Linder
Village TIS submitted in May. The analysis shows that a CFI is not needed nor any additional improvements outside of
the ones being agreed to for Phase 1 and the STAR agreement.
Sorry for the confusion. Too many impact studies going on at once.
