Box 8028 • Boise, ID 83707-2028 (208) 334-8300 • itd.idaho.gov November 15, 2018 C.Jay Coles Meridian City Clerk’s Office 33 East Idaho Avenue Meridian, Idaho 83642 VIA EMAIL Development Application H-2017-0088 REVISED AZ, CPAM, PP, VAR Project Name LINDER VILLAGE REVISED Project Location Southeast corner of US-20/26 (West Chinden Boulevard) and North Linder Road at 1225 West Chinden Boulevard, south of US-20/26 milepost 37.56 Project Description • Annexation and zoning of 81.51 acres of land from the RUT zoning district in Ada County to the C-C zoning district (63.796) and the R-8 zoning district (17.713 acres) in the City • Preliminary plat consisting of 16 commercial building lots, 1 residential lot, 2 common lots and 2 other lots for future right-of-way dedication on 78.13 acres of land in the proposed C-C and R-8 zoning districts • Variance to UDC 11-3H-4B.2 for two accesses via West Chinden Boulevard (US-20/26) Applicant Lynx/ DMG Real Estate Partners, LLC The Idaho Transportation Department (ITD) reviewed the preliminary plat, variance, annexation, zoning, and comprehensive map amendment application and has the following comments: 1. This project abuts the State highway system. 2. Linder Village has two accepted access points on US-20/26 (West Chinden Boulevard). See attached Exhibit A for visual. Site Access A is accepted as a right-in, right-out approach. • Edge of pavement is not accurately depicted in the concept plan provided. • Approach must be designed to meet the future US-20/26 corridor plan as described in the STAR Agreement. If the necessary right-of- way cannot be obtained for the collector road connection to Fox Run Way, ITD will allow a signal at Bergman Way (Site Access B). • The concept, landscape, and circulation plan provided do not show Site Access B as restricted and instead depicts a full access. Through movement will not be possible assuming a right-in, right-out, left-in configuration. • A full signalized access at Bergman Way will only be allowed if the necessary right-of- way cannot be obtained for the collector road connection to Fox Run Way. • Edge of pavement is not accurately depicted in the concept plan provided. • Approach must be designed to meet the future US-20/26 corridor plan as described in the STAR Agreement. 3. ITD has reviewed the revised Linder Village traffic impact study (TIS) dated May 11, 2018. The TIS states that improvements are needed for US-20/26 (West Chinden Boulevard), Fox Run Way, Linder Road, and Meridian Road. Applicant will be required to build all identified improvements as stated in ITD’s Linder Village Commercial Development Revised Traffic Study Acceptance letter dated October 19, 2018. 4. The US-20/26 corridor study shows this area of US-20/26 requires 100 feet of right-of-way as measured from the centerline of US-20/26 for the roadway, drainage, clear zone, utilities and pathway. Based on conversations with the City, ITD is willing to allow a variance to the corridor study requirements outside the area of impact for the future Continuous Flow Intersection and accept a 70ft right-of-way dedication from the applicant for the paved roadway with an additional 30ft easement for drainage, clear zone, utilities, and pathway. The pathway must be located along the back edge of the easement to accommodate drainage. If the City requires berms or other improvements, they should be constructed outside of the additional 30ft easement. No structures impeding maintenance of the irrigation or drainage shall be built within the future easement. ITD reminds the City that keeping costs down within this corridor will help with future construction. ITD is unable to allow the future paved roadway for the Continuous Flow Intersection within the 30ft easement. Specifics regarding right-of-way dedication versus easement shall be determined with the applicant during Project design. However, estimated limits of the easement is identified in Exhibit A. 6. IDAPA 39.03.42.08.a states “a minimum setback of fourteen (14) feet from State highway right- of-way line is recommended, unless a greater minimum is established by an engineering study.” Depending on the determination of right-of-way versus easement near the future Continuous IDAHO TRANSPORTATION DEPARTMENT P.O. Box 8028 • Boise, ID 83707-2028 (208) 334-8300 • itd.idaho.gov Flow Intersection, the restaurant building depicted between Pad A and Pad B potentially does not meet these setback requirements. ITD requests that restaurant’s building permit be withheld and construction not allowed until the applicant’s dedication of right-of-way in this vicinity is defined. 7. Landscaping as depicted in the application will be reduced once the site plan accurately depicts the edge of pavement as called out in the STAR Agreement and as shown in the US-20/26 corridor plan. 8. Per the STAR Agreement, the applicant shall dedicate such necessary right-of-way to ITD to the extent they own identified future right-of-way for the Continuous Flow Intersection located at the intersection of US-20/26 and Linder Road. ITD does not allow parking within the right-of-way. The Concept Site Plan will need to be revised to exclude parking within the dedicated right-of- way as identified by the white dashed line in Exhibit A. 9. IDAPA 39.03.42.600.04 rules govern landscaping within ITD right-of-way. No trees will be allowed within 4 feet of the face of curb at full growth. Irrigation systems shall be no closer than 5 feet from the pavement edge and shall be adjusted so as not to cause water to cover any portion of the highway pavement. Installation of any landscaping within ITD right-of-way will need to be addressed by ITD permit and meet the requirements of IDAPA 39.03.42. Provisions shall be established for the responsibility of future maintenance of any landscaping within ITD Right-of- Way. 10. No trees are allowed within the clear zone of the ITD right-of-way. Only planting of forage, plants, grasses, flowers, and shrubs with a mature height not to exceed 3 feet will be allowed. 11. No rocks larger than four inches are allowed within the clear zone of the ITD right-of-way. 12. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway. 13. IDAPA 39.03.60 rules govern advertising along the State highway system. With the modifications described above and included in the STAR agreement, ITD does not object to the proposed preliminary plat application.
