and Boise Meridian RV Rc¥Iort LLC, hereafter referred to as APPLICANT, their heirs, successors,
assigns and personal repre~tative.

WHEREAS, The foPowing assessments are calculated by the City based upon information
supplied to the City by the ~licant and/or historical information on record for a simllar fucility
and/or established in the CiWs Ordinances for the proposed type offacility.

NOW, THEREFO~, IT IS HEREBY AGREED AS FOLLOWS:

The above recitals ate contractual and binding on the parties

Both parties to this ¡agreement acknowledge that the above assessments were determined
trom the informatiOD referenced in the first recital, and not actual metered flows, and that the
assessments for the ¡proposed facility will be re-evaluated after a period of thirty-six (36)
months offuD servi,*" final occupancy, to detemúne if adjustments are warranted. The City
shaD refund any o'ferpayment of assessments resulting trom the re-evaluation, or the
Applicant shaD be njsponsible for, and shaD pay within forty-five (45) days the shortage of
payment resulting tram the re-evaluation.
