APPLICATION SUMMARY The applicant, Wendy Shrief, requests approval of a one (1) year time extension on the preliminary plat (PP) in order to obtain the City Engineer’s signature on the final plat for phase 1 of development for Little Creek Subdivision. The subject preliminary plat consists of 24 building lots, 4 common area lots and 1 other lot on 8.19 acres of land in the R-40 zoning district. II. STAFF RECOMMENDATION Staff recommends approval of a one (1) year time extension as requested to expire on October 4, 2019 with the conditions included in Exhibit B. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is located at 1470 N. Locust Grove Rd., in the northwest ¼ of Section 8, Township 3 North, Range 1 East. (Parcel #: R7104253800). B. Owner: Little Creek Partners, LLC. 2452 Bay View Ave. Carmel, CA 93923 C. Applicant/Representative: Wendy Shrief, J-U-B Engineers 250 S. Beechwood Ave. Boise, ID 83709 D. Applicant's Statement/Justification: Please see applicant’s narrative for this information. IV. HISTORY OF PREVIOUS ACTIONS In 2016, the subject property received annexation (DA #2016-109494), preliminary plat and conditional use permit (H-2016-0076) approval to construct a 204 unit multi-family development. In 2017, the subject property received final plat approval (H-2017-0067) consisting of 24 building lots, 4 common lots and 1 other lot on 8.19 acres of land for Little Creek Subdivision No. 1. In 2018, the applicant received approval of a conditional use permit modification to relocate open space to the west part of the site (A-2018-0013) and certificate of zoning compliance and design review (A-2017- 0157). UNIFIED DEVELOPMENT CODE (UDC) Per UDC 11-6B-7, approval of a preliminary plat shall become null and void if the applicant fails to obtain the City Engineer’s signature on a final plat within two years of the approval of the preliminary plat. Upon written request and filing by the applicant prior to the termination of the allowed time period, the Director may authorize a single extension of time to obtain the City Engineer’s signature on the final plat not to exceed 2 years. Additional time extensions up to 2 years as determined and approved by the City Council may be granted. With all extensions, the Director or City Council may require the plat to comply with current provisions of the UDC. VI. STAFF ANALYSIS This is the first time extension requested on the subject preliminary plat. Approval of the subject time extension will allow the applicant to proceed with obtaining the City Engineer’s signature on the final plat and recording the plat for phase 1 of development. The applicant has already commenced the multi-family use as permitted with the conditional use permit. If the subject time extension is not granted, the preliminary plat will expire. A new preliminary plat application would be required if the applicant desires to sell off the individual buildings. Since the time the preliminary plat was approved, there have not been any changes to the UDC that would impact development of this site. The applicant should comply with all previous conditions of approval for this site. Staff recommends approval of the requested one year time extension of the preliminary plat in order to obtain City Engineer’s signature on the first phase of the final plat. IV. EXHIBITS A. The applicant shall meet all applicable terms of the approved annexation, development agreement (Inst. No. 2016-109494), preliminary plat and conditional use permit (H-2016-0076), and final plat (H-2017-0067). 2. Per previous conditional use modification (A-2018-0013) applications approved for this site, applicant shall apply for and obtain approval of a final plat modification prior to occupancy of the first structure. 3. The applicant shall have until October 4, 2019 to obtain City Engineer’s signature on a final plat or submit another time extension in accord with UDC 11-6B-7.
