And if I could just add, since I have the floor, the reason that we are proposing a blanket easement, as staff has already stated, is we can't specify the exact location at this time, we just want everyone to be on notice that when the road comes through that we have got that in our favor. Item 5: Public Hearing: CUP 04-055 Request for a Conditional Use Permit I Planned Development for office, retail and daycare uses in an I-L zone as required by CUP 04-009 and a request for a building height modification from the previously approved 40-feet to 52-feet for DBSI Realty Corp. by DBSI Realty Corp. - north of West Overland Road and east of South Linder Road: Zaremba: I will open the Public Hearing for CUP 04-055. This is a request for a Conditional Use Permit planned development for office, retail, and daycare uses, in an 1- L zone as required by the CUP 04-009, and their request for a building height modification from the previously approved 40 feet to 52 feet for DBSI Realty Corp by DBSI Realty Corp, north of West Overland Road and east of South Linder Road. And we will begin with the staff presentation. Guenther: The applicant did not post as required, so we will not hear this one tonight. We don't have the appropriate posting, so -- Baird: Mr. Chair, if I could make a suggestion and I will ask for staff to chime in here as well, since I may not be familiar with your procedures, but since you have the Public Meridian Planning & Zoning February 3, 2005 Page 7 of 58 Hearing open and individuals may be in the audience who received the mailed notice or the published notice, if you choose to perhaps set a continued hearing for a date certain that would be after the required time for the posting, then, those who received the mailed notice and the publication notice would show up at that continued hearing. Now, if staff has another procedure that they'd like to follow -- I'm getting a nod that they prefer to do it that way. Guenther: Yeah. That is the general procedure that they are required to post the site for ten days prior to the Public Hearing and it was not posted and, therefore, we are just postponed two weeks and allow the application to adequately post the site. Zaremba: Right. Because they would have to get it posted by Monday for it to be eligible for the meeting of the 17th. Guenther: That's correct. Zaremba: Or at least the 7th. Have they indicated they can do that? Guenther: I believe they are here and I believe they have actually got the site posted today. They just missed the actual date that they needed to have it posted by. So, it's posted today. Baird: But they will need to change the date. Guenther: And theywill meet their ten days for the next meeting. Zaremba: Okay. What is the date on the posted notice? ThePublic Hearing is open, so, please, begin with your name. Yancey: Wayne Yancey with DBSI Realty. And the date that posted is today's date. Zaremba: Okay. Yancey: That's on the sign. So, we can change that to the next date that you will have your hearing. Zaremba: So, our procedure would be to continue it to the 17th and they will change the date on the sign to the 17th. Baird: Mr. Chair, Members of the Commission, that's correct, and if we could get their commitment on the record that they would make that change, so that it -- the 17th would be on -- displayed on the sign for the required ten days, then, we would know that we are covered on that. It looks like 13 items on the 17th, including a short presentation -- or 14, I guess, including a short presentation from Valley Regional Transit. The 3rd of March is about the same. We are ready for the next Item 6 and I will open the Public Hearing for CUP 04-053, request for a Conditional Use Permit for a planned development for a clinic slash office in an L-O zone for OB/GYN Associates by ZGA Architects and Planners, Chartered, south of East Franklin Road and east of North Eagle Road. And we will begin with the staff presentation. Guenther: Thank you, Mr. Chairman, Members of the Commission. The site is in the Touchmark Living Center's planned development. It's for -- Moe: Excuse me. Could we speak up just a little bit. Guenther: I'm sorry. Moe: Thank you. Guenther: The Touchmark Planned Development is generally an office/medical clinic area and this is consistent with what their development plan was. This is for an OB/GYN center for -- essentially it was Lot 1, Block 2, of the development. The issue at hand is that there will be a one-time lot line adjustment that will relocate -- or that won't relocate the lot, but it will redo the legal description for the parcel and that, actually, has been submitted to Public Works and is in progress, which is one of the conditions of approval for this site. Generally, staff does not have any issues with this site that are outstanding, with the exception of the one time division must be filed prior to the site -- okay. This is -- I'm sorry here. The site here is what Lot 1, Block 2, would look like. The portion that is in question is going to be this approximately one acre right in the southwest corner of that lot and this is what the site would look like, This is the fire department's rendition where they can show that they provide services without using this access on this location, because this is longer than 150 feet and does not meet their minimum requirements, but they are within 150 feet of every site -- every portion of the building on the site. There will be compact stalls located just north of the building. We have reviewed this submittal and offer the following comments, as conditions of the applicant. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION BACKGROUND & SUMMARY On April 3, 2001 the Meridian City Council granted the request for a planned development in order to locate approximately 7 buildings, containing 261,630 square feet, on 4 parcels ofland totaling 32.79 acres. DBSI was granted the following 46 different uses to be considered within the Planned Development under CUP-OI-009: A. Commercial Uses- Accounting services, administrative services, automobile service stations, bakery stores, banks and other financial institutions, broadcasting, radio and TV, childcare center, clinics (medical, dental, and optical), department stores, dry cleaning, entertainment centers (indoor and outdoor), greenhouses, nurseries, hospitals, hotels, laboratories, motels, nursing home5, sanitariums, daycare centers, professional and sales offices, public parking lots, restaurants, retail stores, retirement homes, research facilities, shopping centers (community and neighborhood), tech schools, veterinary clinics and hospitals, and wholesale facilities. B. Industrial Uses- Apparel manufacturing, bakery products,' bottling and packaging, electronic supplies and appliances, electronic equipment and products, industrial research, instruments, machine shop, mobile home manufacturing, molded plastic products, office machines, photographic equipment, printing and publishing, processing plants, warehousing and wholesaling. CUP-Q4-055 DBSI.CUPIPD Planning & Zoning Commission/Mayor & City Council P&Z Hearing Date: February 3, 2005 Page 2 DBSI was also required to submit a conditional use request under CUP/PD 01-009 with the following applicable conditions of approval: "The developer shall be required to return to the Commission and City Council for approval through the conditional use pennit process of all office, retail or daycare uses in the I-L zone" "Additional development within this project shall only proceed to the extent that the particular building, or phase, has an adequate supply of both domestic and fire protection water, as may be detennined by the City of Meridian Public Works Department, and the meridian Fire Department." The application was processed under the 1993 comprehensive plan and was approved under the "existing urban" land use designation. DBSI reauested the following 46 different uses be considered within the Planned Development: C. All proposed uses reauire conditional use approval as outlined above. ~ The outstanding issues for the Commission's consideration are noted in the Special Considerations section of this report. Upon resolution of those issues, staffrecommends approval of the project with the conditions noted in this report. LOCATION The subject property is adjacent to 1-84, located northwest of the intersection of Stoddard and Overland Road, extending approximately 1,325 feet along Overland and 1,065 feet north to 1-84. The lot is currently zoned I-L. SURROUNDING PROPERTIES North: Interstate 84, zoned I-L South: Ada County zone RI and RUT - Residential. OWNER OF RECORD The property owner of record is Meridian Freeway Association, LP, and they have given their consent through Douglas Swenson (General Partner) for the applicant to submit the conditional use pennit application. STANDARDS FOR CONDITIONAL USES The Commission and Council shall review the particular facts and circumstances of each proposed conditional use in terms of the following, and may approve a conditional use permit if they shall fmd evidence presented at the hearing(s) is adequate to establish (11-17-3): A, That the site is large enough to accommodate the proposed use and all yards, open spaces, parking, landscaping and other features as may be required by this ordinance; Staff finds that the subject property is large enough to accommodate the requested use and all other required features as noted above. The parking and landscape plan as submitted under sheet L-l on December 7, 2004 is not approved and an approved landscape plan must be submitted prior to issuance of a certificate of zoning compliance. Standard ordinance parking requirements for "Office, Retail, Daycare" and/or Mixed uses apply to the site. The standard for Retail stores is one space per 200 gross square reet-,~ I the standard for professional offices is one space per 400 gross square feet. The proposed two buildings are 60,000 gross square feet each, requiring 200-300 parking spaces based on use. The applicant has proposed 323 parking spaces in compliance with the Chapter 11 Section 13 MCC, however the landscape plan requires detailed review and modifications to parking standard5 prior to issuance of a certificate of zoning compliance. Staff feels the site has adequate area in order to comply with the landscape and parking requirements based on the conceptual review. B. That the proposed use and development plan will be harmonious with the Meridian Comprehensive Plan and in accordance with the requirements ofthis Ordinance; The current Comprehensive Plan Land Use Map designates the property as "industriaL" Staff finds that the proposed retail/office uses are not in compliance with the 2002 Comprehensive plan and are prohibited uses under the existing zoning ordinance. The overall project was approved as a conditional use for a planned development in order to allow use exceptions under CUPIPD 01-009, the applicant has applied the exemption to this CUP-Q4-055 DBSLCUPIPD Planning & Zoning Commission/Mayor & City Council P&Z Hearing Date: February 3, 2005 Page 4 project. The current proposal is also a planned development to modify the maximum height requirement and allow a 52' maximum building height. If the project is approved as a Planned Development, it will meet the minimum requirements of the use exception applied in CUP/PD 01-009. c, That the design, construction, operation, and maintenance will be compatible with other uses in the general neighborhood and with the existing or intended character of the general vicinity and that such use will not adversely change the essential character of the same area; Staff finds that the proposed office may not adversely change the existing (Industrial) or intended (industrial) character of the general vicinity. The proposed project boundary is surrounded on two sides by other property owned by the Meridian Freeway Associates project and is in compliance with the approved Planned Development for the project. Any impacts of the office will likely be restricted to existing and future phases of the project itself. D. That the proposed use, if it complies with all conditions of the approval imposed, will not adversely affect other property in the vicinity; Staff does not anticipate that the proposed office/retail uses will adversely affect adjacent properties due to the fact that the proposed U5es are in compliance with the conceptual plan for DBSI/Meridian Freeway Associates Planned Development CUP/PDOl-009. The Commission and Council should consider any testimony (written and oral) presented at the public hearings before making this finding. E, That the proposed use will be served adequately by essential public facilities and services such as highways, street, police, and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; Staff finds that the proposed development can be adequately served by the essential public facilities and services listed above. City water & sewerlIlains have been constructed within the Meridian Freeway Associates project and will be extended as part of this proposed development. Sewer and Water flows must be determined by Public Works and operate in compliance with the Public Works standards. The existing Western Electronics facilitveast of the site is served bv a privatelv owned and maintained sewage lift station that discharges to a City of Meridian sewer main in Overland Road. Bear Creek Estates Subdivision discharges to the same manhole. Because Bear Creek Estates and the Western Electronics facilities use the lift station. onlv the proiected excess capacitv in the receiving sewer is available for future development.
