These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY The applicant, John Nesmith, has applied for a modification to his existing Conditional Use Permit (CUP). The CUP was for an expansion of a non-conforming use. The original CUP prohibited any use within the railroad right of way. The applicant is currently using the property for vehicle storage/impound yard. The fence around the railroad right-of-way has been installed without a permit. Also prohibited in the existing CUP are vehicle sales. It appears that the sate of vehicles is continuing on the lot, albeit signs ate not as prominent as they were previously. A sign permit was not approved for a new sign on the property due to the fact that the conditions of approval were not met. The applicant had a new sign installed without a permit. The application proposes allowing vehicle storage along the railroad right-of-way. It also proposes a new fagade on the building, facing East First, and significant landscape improvements. The proposed landscape improvements would have to be approved under the 'alternative compliance' provisions of the landscape ordinance, as the existing site layout prevents conformance with the "letter" of the ordinance. The City of Meridian has initiated legal action against Mr. Nesmith for failing to conform to the conditions of approval of the original CUP. Non-conformance issues include, but are not limited to, storage of vehicles within the railroad right-of-way, insufficient landscaping, no sidewalks, non-paved parking areas, insufficiont screening of storage areas, possible continued use of welding equipment in the newest building, and an illegal sign. Due to the fact conditions of approval were never met, the applicant is also operating the facility without a Certificate of Occupancy. Planning & Zoning Commission/Mayor & City Council Marchl 8, 2002 Page 2 Several original conditions of approval are still not met, but the applicant is requesting to make the remaining improvements in conjunction with the work proposed in this application. For example, the sidewalk improvements along Bower are apparently designed, but not yet constructed. The applicant desires to do such improvements at the same time as the additional landscaping and parking improvements proposed in this application. While staff generally favors the proposed plan included in this application, past history with the applicant suggests that follow-through with the proposed improvements is questionable, and staff's perception is that the improvements may only be proposed as a means to get the City to approve the applicant's existing vehicle storage/impound use along the raikoad. The application states that "the work is not proposed to be phased [e.g., they intend to do the full improvements as one phase], except for the logical and practical sequence of construction, and we would anticipate a requirement that the building renovation and landscaping be completed along with the construction of the railroad parking" [emphasis added]. Therefore, staff feels strongly that all required improvements should be bonded for with cash or an Irrevocable Bank Letter of Credit in the amount of 110% (documented by bids)to be submitted to the City &Meridian prior to approving the Findings of Fact/Conclusions of Law for this CUP, or, at a minimum, prior to building permits being issued. Use &the railroad property for storage of vehicles should not be allowed until after the landscape and building improvements are constmeted. LOCATION The property is located on the west side of E. First Street (aka Main Street), just south of the railroad tracks, in O1d Town. The proposed vehicle storage along the railroad right-of-way extends from E. Ia to Meridian Road. SURROUNDING PROPERTIES North: Union Pacific Railroad tracks South: A pawn shop & Valley Video, zoned O-T, and single-family homes. East: Double D Supply, zoned O-T. West: Viking Fence and other storage buildings, zoned O-T. Planning & Zoning Commission/Mayor & City Council Marchl 8, 2002 Page 3 STANDARDS FOR CONDITIONAL USES The Commission and Council shall review the particular facts and circumstances of each proposed conditional use in terms oftbe following and may approve a conditional use permit if they shall find evidence presented at the bearing(s) is adequate to establish (11-17-3): That the site is large enough to accommodate the proposed use and all yards, open spaces, parking landscaping and other features as may be required by this ordinance; Stafffinds that the subject property is large enough to accommodate the requested use and all other required features, except landscaping. However, staffhas reviewed and agrees to the proposed alternative compliance for landscaping, The existing structure was built in 1948 and encroaches into the fight-of-way for Bower StreeL The applicant should be required, per ACHD's report, to obtain an encroachment agreement for the existing structure. The new faoade improvements do not extend into the right-of-way, but end at the property line. aa That the proposed use and development plan will be harmonious with the Meridian Comprehensive Plan and in accordance with the requirements of this Ordinance; The current Comprehensive Plan Land Use Map designates the property as 'Existing Urban', which is not defined for specific uses. Old Town Policy 5.4, page 27 states the following: "Special analysis should be undertaken concerning existing uses within Old Town so that specific recommendations can be made for the development of transitional uses which will enhance the area and prevent future deterioration." The original CUP proposed no use of the railroad property. Use of this property has detracted fi~om the area and cansed further deterioration. Staff finds that tbe proposed improvements, paved parking, landscape buffers, planters, and fac~ade improvements~if completed, could enhance the area and help prevent future deterioration. The Commission and Council should rely on testimony at the hearing before making this finding. That the design, construction, operation, and maintenance wiil be compatible with other uses in the general neighborhood and with the existing or intended character of the general vicinity and that such use will not adversely change the essential character of the same area; Staff finds the design concept to be compatible with other uses in the general neighborhood and the existing/intended character of the area. Staffaiso finds that the Planning & Zoning Commission/Mayor & City Council Marchl 8, 2002 Page 4 proposed improvements would bring the property closer to the intended character of the area. The main issue that the Commission and Counc'fl need to consider in this regard is whether or not a vehicle storage lot in the heart of Old Town sets the desired precedent, in spite of the proposed improvements to the properly. Note: 'Automobile wrecking yard and storage' is a prohibited use in the Old Town zone per the Schedule of Use Control. That the proposed use, if it complies with all conditions of the approval imposed, will not adversely affect other property in the vicinity; Staff does not anticipate that the proposed project will have an adverse impact on the surrounding property; however, the Commission and Council should consider any testimony given at the public hearings before making this finding. That the proposed use will be served adequately by essential public facilities and services such as highways, street, police, and fire protection, drainage structures, refuse disposal, water, sewer or that the person responsible for the establishment of proposed conditional use shall be able to provide adequately any such services; Stafffinds that the proposed development will be adequately served by the essential public facilities and services listed above, if improvements are made by the applicant in accordance with policies, ord'mances and Uniform Codes. That the proposed use will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community; Staff finds that the proposed improvements would not be detrimental to the economic welfare of the community, nor would it create the need for any new facilities or services to be paid for by the public. That the proposed use will not involve activities or processes, materials, equipment, and eonditious of operation that will be detrimental to any persons, property, or general welfare by reason of excessive production of traffic, noise, smoke, fumes, glare or odors; Stafffinds that no excessive traffic, noise, smoke, fumes, glare or odors will result fi.om the proposed use. That the proposed use will have vehicular approaches to the property which shall be so designed as not to create an interference with traffic on surrounding public streets; Planning & Zoning Commission/Mayor & City Council Marehl 8, 2002 Page 5 Staff finds that the proposed use will not create significant interference with any traffic on the surrounding public streets, if curb cuts are designed in conformance with ACHD requirements. That the proposed use will not result in the destruction, loss or damage of a natural, scenic or historic feature considered to be of major importance. Staffdoes not find that any natural or scenic feature will be lost, damaged or destroyed by issuance of this conditional use. S~TE SPECIFIC COMMENTS The Schedule of Use Control states that 'Automobile wrecking yard and storage' uses are prohibited in Old Town. Automobile wrecking yard is defined as "Premises on which two (2) or more currently non-licensed motor vehicles or two (2) or more motor vehicles not in operating condition are standing more than thirty (30) days and are dismantled or stored." 'Automotive Repair Shop' and 'Motor Vehicle Repair' are also prohibited uses in Old Town. However, the existing use is considered to be eligible for the non-conforming use provisions of Ordinance I 1-5. Ordinance 11-5-5.B states that a "nonconforming use shall be extended to occupy any additional land only as an application shall be submitted to the Commission and in accordance with the conditional use procedures of Chapter 17." The same requirement for a conditional use application applies to fagade improvements of the structure per 11- 5-5.A. Except as modified by this application, the conditions of approval for the original Conditional Use Permit shall apply. The existing sign was installed without a sign permit. Signage for the property should be evaluated as part of this application. The existing sign shall be modified as necessary to conform to the recommendations of the Planning & Zoning Commission. If the proposed improvements are not substantially complete within six (6) months of the date of approval of this CUP, Council should begin revocation proceedings. The landscape plan meets the intent of the Landscape Ordinance. Staff recommends approval of the proposed landscape plan under the 'Alternative Compliance' section of the ordinance. Landscaping shall be installed per the approved plan. No field changes are permitted without prior written approval from the Planning & Zoning Department. The proposed trash enclosure size and location must be coordinated with the Sanitary Services Corp. (SSC) before the next public hearing. Provide an approval letter from SSC with the application for a Certificate of Zoning Compliance. Planning & Zoning Commission/Mayor & City Council Marchl 8, 2002 Page 6 Gating and fencing of the parking area within the railroad right-of-way is proposed. The applicant should address the need for the fence and gate, especialIy the internal gate located halfway through the parking area. No gating of the main access is proposed or approved. Proposed parking includes 20 parking spaces on the Meridian Automotive property, and an additional 65 spaces on the railroad right-of-way. Parking shall be installed per the approved plan and meet all dimensional requirements of the city ordinances. All parking, including the fight-of-way, shall be paved per City Ordinance. If the railroad does not allow the proposed paving and/or landscaping improvements, the proposed vehicle parking shall not be allowed. A drainage plan designed by a State of Idaho licensed architect or engineer is required and shall be submitted to the City Engineer (Ord. 557, 10-1-91) for all off-street parking areas. Storm water treatment and disposal must be designed in accordance with Department of Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal into a surface water is prohibited unless the jurisdiction which has authority over the receiving stream provides written authorization prior to development plan approval. The applicant is responsible for filing alt necessary applications with the Idaho Department of Water Resources regarding Shallow Injection Wells. 10. All improvements shall meet all federal requirements of the Americans with Disabilities Act. 11. All parking, landscaping, and fagade improvements shall be installed prior to the issuance of an occupancy permit. No occupancy permit has ever been issued for the newest (westernmost) building on the subject property. 12. The applicant shall provide surety for all required improvements, including paving, landscaping, irrigation, faqade improvements, sidewalks, fencing, etc., prior to formal approval of Findings of Fact/Conclusions of Law, or, at minimum, prior to obtaining building permits, in the amount of 120°,4 for an insurance bond or 110% for a Letter of Credit or Cash bond. COMPREHENSIVE PLAN POLICIES The subject property is located in an area designated as Old Town in the Meridian Comprehensive Plan. The 1993 Comprehensive Plan contains a variety of goals and policies that are relevant to this application. Staff has selected the following sections that most directly apply to the proposed project. Planning & Zoning Commission/Mayor & City Council Marchl 8, 2002 Page 7 Goal 5: To preserve and improve that character and quality of Meridian's man-made environmem. Goal 8: To establish compatible and efficient use of land through the use of innovative and functional site design. Economic Developmem Chapter 4.5U - Continue to acquire land and develop parking facilities available to the public and downtown employers. 5,1 - The City of Meridian shall encourage existing businesses and commercial enterprises to remain in Old Town. 5.3 - The development of a variety of compatible land uses should be provided in plans and proposals for the future development of Old Town. 5.4 - Special analysis should be undertaken concerning existing uses within Old Town so that specific recommendations can be made for the development of transitional uses which will enhance the area and prevent future deterioration. Furore Conditions #1 - The City has identified a 200-foot right-of-way to be protected along the Union Pacific railroad line... This area would be a potential site for future mass transit... It would also provide for pedestrian paths, bikeways, and utility lines. 1.14 - Design and performance standards should be applied to infilling development in order to reduce adverse impacts upon existing adjacem development. Community Desi~m~ Charter 1.4 - Major entrances to the City should be enhanced and emphasized. Unattractive land Uses along these entrances should be screened from view. 1.56 - Consistent landscaping, street lighting, and street furnishings should be planned and implemented for Old Town. 1.6 - The addition of landscaping within existing commercial parking lots should be encouraged. 3.1 - Maintain a district identity for the downtown through expansion of E. l~t Street streetscape. Entryway Corridors - E. 1~ Street is identified as an important entryway corridor that introduces both visitors and residents to the Meridian. More extensive landscaping and more concern for site character may be required. RECOMMENDATION Staffrecommends approval of the application with the comments listed above. Beaver Street Improvements: The 1996 staffreport indicates that the applicant should be required to construct Bower Street to one-hal,'of a 41-foot street section. Due to the existing building location, it is not possible to construct a 40-foot street saction within the existing 55-feet of right-of-way. Staffrecommends a modification of policy to allow a reduced local/commercial s~a~t width of 36-feet to be built to the same standards as the 40-foot local/commercial section within the existing right-of-way. To accommodate the reduced width, the applicant should sign the street for '3qO PARKING" adjacent to thin site. Bower Street Driveways: The 1996 staffreport addressed two driveways on Bower Street: 1. The applicant is proposing to utilize an existing SO-foot wide curb cut driveway on Bower Street located approximately 50-feet west orE. 1st Street. The request is to allow modification and renovation of the existing facility, and vehicular parking in the existing Union Pacific Railroad right-of-way to the North of and adjacent to the existing Meridian Automotive business located at 505 East 1 st., Meridian, Idaho. The existing automotive repair and towing business has existed at this location for many years. The original existing building was built in 1948, and is in need of renovation to present a more attractive appearance and to accommodate an expanded volume of business. The existing railroad property at this location is undeveloped, and can become an attractive and beneficial business asset for Meridian if the proposed use is allowed. The proposal is to enlarge and rebuild the front (East) side of the existing building, facing East First Street. This will present a modern, neat appearance, and will amount to a significant improvement. A large amount of new landscaping will be added, based on the current landscape ordinance; this will greatly enhance the appearance of the property. This landscaping will be added around much of the property perimeter, where it will be most visible. The towing business requires an impound/parking area, in addition to the area needed for parking of vehicles awaiting repair and pickup. It would be very beneficial to the business, mad to the community, to provide this parking area as proposed in the railroad area, where it can be adequately screened by fencing and landscaping. Therefore, the proposed parking use of this portion of the property should be justified as an improvement to the neighborhood. Page- 1 We area aware that the railroad has been designated as a transportation corridor, with a proposed terminal near this location. Therefore, the proposed landscaping along the railroad will be of significant benefit in improving the appearance of this area. Some conditions of the previous/existing use permit were not fully met, but can best be done in conjunction with the work proposed in this application. The work along Bower Street has been designed, but not yet completed; it would be beneficial to do this all together with the site development proposed herein. This application also requests modification of the previous CU condition disallowing use of the railroad property. A significant part of the justification for the building renovation is the increased business viability which will be created by the use of the railroad parking area. Without this parking, the renovation of the building will not be feasible. The work is not proposed to be phased, except for the logical and practical sequence of construction, and we would anticipate a requirement that the building renovation and landscaping be completed along with the construction of the railroad parking. We believe the work proposed in this Condition use Application will be a significant improvement to the existing property, and will be of benefit to the community.
