Request For a Conditional Use Permit to Allow a Group Childcare Home for 6-12
Children at 567 East Brown Bear Street, Located in an R-8 Zone by Christina
Floyd (File No. CUP-02-O03).
We have reviewed this submittal and offer the following comments, as conditions of the applicant.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY
The applicant, Christina Floyd, has requested approval of a group childcare home at 567 E. Brown
Bear Street. Group childcare homes require a conditional use permit in the R-8 zone. Approved
group childcare homes may care for up to 12 children each day.
The applicant has an approved family childcare home permit to care for up to five children in her
home. The applicant has stated in her application that she does not intend to care for 12 childrer£ The
reason for the application is to care for 1-2 additional children, and to stay within the City of Meridian
childcare guidelines.
LOCATION & SURROUNDING USES
The subject property is located at 567 E Brown Bear, approximately 2,000 feet west of Meridian
Road and ~ mile north of Cherry Lane.
The following uses surround the subject property:
North - Single-family dwellings, zoned R-8.
South - l~ural Residential, zoned RUT (County)
East - Single-family dwellings, zoned R-8.
West - Single-family dwellings, zoned R-8.
STANDARDS FOR CONDITIONAL USES
The Commission and Council shall review the particular facts and circumstances of each

proposed conditional use in terms of the following and may approve a conditional use permit
if they shall find evidence presented at the hearing(s) is adequate to establish (11-17-3):
That the site is large enough to accommodate the proposed use and all yards, open
spaces, parking landscaping and other features as may be required by this ordinance;
Staff finds that the subject property is large enough to accommodate the requested
childcare uses.
That the proposed use and development plan wBl be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The current Comprehensive Plan Land Use Map designates the property as "Single-family
residential". Staff finds that the requested childcare use is in harmony with the Meridian
Zoning Ordinance and the Comprehensive Plan.
That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character
of the general vicinity and that such use will not adversely change the essential
character of the same area;
Stafffinds that the proposed development will not change the essential character of the
general vicinity. The applicant already has a permit to care for up to five children, and the
addition of 1-2 more children will not adversely change the character of the area.
That the proposed use, if it complies with all conditions of the approval imposed,
will not adversely affect other property in the vicinity;
Commission and Council should rely upon public testimony to determine if the
development will adversely affect the other property in the vicinity.

That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures,
refuse disposal, water, sewer or that the person responsible for the establishment of
proposed conditional use shall be able to provide adequately any such services;
Staff finds that the proposed development will be adequately served by the essential public
facilities and services listed above.
F. That the proposed use will not create excessive additional requirements at public
cost for public facilities and services and will not be detrimental to the economic
welfare of the community;

SITE
1.
Stafffinds that the proposed use would not be detrimental to the economic welfare of the
community, nor would it create the need for any new facilities or services to be paid for by
the public.
That the proposed use will not involve activities or processes, materials, equipment,
and conditions of operation that will be detrimental to any persons, property, or
general welfare by reason of excessive production of traffic, noise, smoke, fumes,
glare or odors;
Staff finds that no excessive traffic, noise (if children are properly supervised), smoke,
fumes, glare or odors will result fi.om the proposed use.
That the proposed use will have vehicular approaches to the property which shall be
so designed as not to create an interference with traffic on surrounding public
streets;
Stafffinds that the proposed use will not create significant interference with any traffic on
the surrounding public streets as long as ACHD requirements are met and all approaches
and traffic control measures are installed.
That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Stafffinds that no natural or scenic feature will be los/, damaged or destroyed by issuance
of this conditional use.
All landscaping shall be continuously maintained and any dead or dying vegetation shall be
replaced upon request from the City.
All parking and areas of circulation shall be improved with a hard surface in accordance with
Meridian City Code 11-13-4.D. Parking for the pick up and delivery of children shall be
located in the driveway and not on the street.
No signage is permitted as part of this application and is expressly prohibited. Temporary or
portable signs or banners are prohibited, and will be removed upon 3 days notice to the
applicant.
4. All construction and site improvements shall conform to the requirements of the Americans
with Disabilities Act and the UBC (1997 Uniform Building Code). The UBC defines all

buildings used in the daycare of 6 or more children as an E-III occupancy and must then meet
all standards as set forth in the UBC for such an occupancy.
As part of a conditional use permit, the City of Meridian may impose additional
restdctionedconditions.
The applicant shall meet all of the licensing requirements of the State of Idaho prior to
beginning operation. A copy of the State license shall be submitted to the Clerks office for
inclusion in the City's records.
Pursuant to the applicant's letter submitted with the application, no more than 7 children,
including the children under the age of 14 who live in the home, shall be cared for at anytime.
RECOMM~NI)ATION
Staffrecommends approval of this application.
Staff'Ms not received any complaints concerning the existing claycare. The Commission and City
Council should rely on public testimony to deterraine if the addition of 1-2 children will adversely
effect any neighboring residents.

The Ada County Highway District (ACriD) staff has received and reviewed the application and site plan for
the item referenced above. This no review letter is in response to the lead agencies request for comment.
The ACriD Commission will not hear this item unless the site plan is changed in such a manner as to require
Commission review.
ACHD policy requires that before any improvements of any kind are constructed or installed within the public
right-of-way, a permit or license agreement permitting the improvements must be obtained.
All future design plans and construction shall be in accordance with the Ada County Highway District Policy
Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable
ACriD Ordinances unless specifically waived in writing by the District. Meet D strict drainage requirements
per section 8000 of the ACriD Development Policy Manual. Contact District staff at 387-6170 for details.
Contact the office for payment of possible road impact fees prior to building construction in accordance with
Ordinance #195, also known as the Ada County Highway District Road Impact Fee Ordinance.
