In the Public Hearing on July 17, 2018, you heard significant testimony in opposition to the proposal as it was written at that time. At least two of the Council seemed very adamant that the Applicant (Mike) and City staff work with the neighbors to resolve issues prior to returning to the Council. Also, in that meeting, Mr. Murgoitio stated that he had offered to work with the neighbors if they’d give him an idea (or list) of what they wanted, but that had not been forthcoming. I wish to set the record straight on that … 1. He made that offer at a public meeting on July 11, 2018. 2. A group of neighbors met the following day to come up with a list and a designee to present it. 3. The designee, Josh Leonard, called to set a meeting with Mr. Murgoitio the following day…he declined to meet. Now, as we draw close to the follow-up hearing on September 18, I learn that once again the representative for the neighborhood group has been denied access to the planning discussions for the revised Proposal. An e-mail on August 17 from Bill Nary said that the attorney for the applicant had said we couldn’t participate in the planning meetings….I beg your pardon, but shouldn’t the city staff decide who participates?!! Regardless of who issues the invitation, the failure to include the neighbors is in direct violation of the instructions given by the City Council to their staff on July 17. The Murgoitio attorney did indicate they’d have another public meeting, but once again we are be forced to be reactive instead of being a part of a solution. Sorry for the long e-mail, but I felt you should be aware of the situation while there may be time to rectify this prior to the September 18 hearing. At the meeting 2 weeks ago, Council members and the Mayor specifically asked questions about where the materials for the project, under the DA, would be stored, etc. Council members were very clear that they expected the UNPROCESSED materials to be contained to the 39 acre section being discussed. Mr. Murgoitio hedged around it trying to clarify that he needed to be able to put materials (supposedly the processed stuff to fertilize) on his farm ground. But ultimately it appeared he agreed to the Council members comments that he would limit the materials to the section under discussion. In previous meetings he has responded to public critisim or Council question by indicating he didn't want to mess up his pivot sprinkler as indicated on the map by expanding into that area. As of early last week, he has not only violated his CURRENT DA, but gone directly against the obvious Council intent that he contain his recycling activities to the 39 acres described in the amended DA. I have attached a picture that clearly shows the wheel marks of the pivot sprinkler and the raw materials stacked in a dump line on the property. In Provision #5.2.5, Storing of Recycling Materials, it states " ...may be stored on the Recycling Property and on the balance of the Property.... " I urge the staff, Council, City attorney and Mayor to rewrite the amendments in Exhibit B, section 4 so that it ensures the material is contained to the 39 acres in the DA and not the adjacent land owned by the Murgoitio's. Mr. Murgoitio assured you this would be done. Please see the attached picture to show he has already violated that condition by dumping unprocessed leaves and such on the section where the pivot line exists.
