RE: Vacation of a portion of an easement on Lot 3, Block 4 of Howry Lane Subdivision #1,
Meridian, Idaho.
To Whom It May Concern:
J -U -B Engineers, Inc., on behalf of our client, M3 Companies, LLC, would like to request a
vacation of the northwesterly five (5) feet of the existing ten (10) foot easement on the
southeasterly boundary of the property located at Howry Lane Subdivision #1, Lot 3, Block 4,
12855 W Auckland, Street, Meridian, ID 83642, R3745790320. The vacation of a portion of this
easement is being requested due to the fact that during design of the project a pressurized
irrigation (PI) line was located in this easement. The PI line has since been relocated and the
10' width of the easement is no longer necessary. To provide for more floorplan options, it
would be beneficial to have a five (5) foot easement instead.
This application is submitted in conformance with the Vacation application submittal

This Partial Release of Platted Utility Easement ("Release") is made by Qwest
Corporation d/b/a CenturyLink QC ("CenturyLink").
BACKGROUND:
A. Vacation of the northwesterly five (5) feet of an existing ten (10) foot easement
on the southeasterly boundary of the property located at Howry Lane Subdivision #1, Lot 3,
Block 4,12855 W Auckland, Street, Meridian, ID 83642, Parcel Id R3745790320. A 10.00 -
foot -wide utilities easement as shown on Lot 3, Block 4 of that certain Plat showing Howry
Lane Subdivision No. 1, recorded in the Office of the Recorder of Ada County, Idaho, as
Instrument No. 2017-084898. Said parcel is located in Section 33, Township 3 North, Range 1
East, Boise Meridian, City of Boise, Ada County (Exhibit A).
B. Clark & Co. Real Estate, LLC, now owns a parcel of land which legal description
is: Lot 3, Block 4, of Howry Lane Subdivision No. 1, according to the plat thereof, filed in book
112 of Plats at pages 16284 through 16291, records of Ada County, Idaho. Located within the
SW % NE % of Section 33, Township 3 North, Range 1 East, Boise Meridian, City of Boise, Ada
County Idaho. This request was received from JUD Engineers on behalf of SRS AZ Investors,
LLC, for the land owner, Clark & Co. Real Estate, LLC, requesting that CenturyLink release its
right, title and interest in the northwesterly five (5) feet of an existing ten (10) foot easement on
the southeasterly boundary of Lot 3, Block 4 of the Howry Lane Subdivision #1
RELEASE:
As of the date CenturyLink signs this Release, CenturyLink vacates and releases all of its
right, title and interest in and to any and all easements and easement rights acquired by
CenturyLink pursuant to the northwesterly five (5) feet of an existing ten (10) foot easement on

designated on Exhibit A attached to and incorporated by reference into this Release as "to be

Block 4 Howry Lane Sub #1. Originally the site was designed to accommodate a PI line, but the PI line was relocated so the
easement is no longer necessary. This fact was not noticed until the plat was recorded. The builder would like to be able to
offer a wider product to built on this property so would need a minimum easement to be in place.
A neighborhood meeting is not required & the site is not required to be posted with a public hearing notice sign although a
public hearing is required to be held before City Council.
Record drawings confirm there is no existing PI line within said easement (per BF)
Note: A Trak Impact Study (TIS) will be required by ACHD for large commercial projects and any residential development with over 100 units. To
avoid unnecessary delays & expedite the hearing process, applicants are encouraged to submit the TIS to ACHD prior to submitting their application
