HomeMy WebLinkAboutLoyal GibbonsMeridian City Clerk 33 E Broadway Suite 104 Meridian, Idaho 83642 RECEIVED JUL 1 z 2018 CITY OF C> tJ �pnry CITY CLERKS OFFICE Dear Sir or Madame, Please record this letter as my opposition to Application H-2018-0042 by Michael Murgoitio to amend his existing development agreement to allow expansion of his waste management business at the NW Corner of Locust Grove and Columbia for the following reasons: 1) Mr. Murgoitio is currently in violation of sections 4.4, 4.6 of the existing development agreement. Specifically section 4.4 Et 4.6 state; "4.4 Any currently allowed use regarding the raising and maintaining of livestock shall remain on the Property until such time that the Property is developed in the future. The Property maintains a livestock business and operation. All existing uses and operation on the Property relating to the livestock business and operation at the time of annexation may remain until the Property is developed in the future. 4.6 Any use constituting an "agricultural operation", as defined in Idaho Code 22-4502 until such time the Property is developed in the future." Mr Murgoitio's operation has already expanded significantly in both size and scope well beyond the agricultural usage allowed at the time of the annexation. 2) If Mr Murgoitio's application to modify the development agreement were to be approved by the city it would be in clear violation of sections 5.1, 5.1.1, Et 5.1.2 of the agreement. Specifically sections 5.1, 5.1.1, Et 5.1.2 state; 5. 1 Owner/Developer shall develop the Property in accordance with the following special conditions: 5. 1. 1 Future development of the property shall comply with the ordinances in the Meridian City Code in effect at the time of development. 5. 1. 2 Future development of the Property shall comply with all bulk, use, and development standards of the R-4 zoning district listed in UDC 11-2A-5, unless rezoned by the City in accordance with the UDC following application by the Owner/Developer or future developer, and then in accordance with the new zoning designation." Due to the nature of Mr. Murgoitio's proposed changes to the development agreement it is clear the that these changes move it well outside the currently allowed agricultural usage. Clearly making it an industrial/commercial use. The requested changes include unlimited traffic increases, non-agricultural material handling, and retail traffic. If these usages are permitted it can only legally be done via the full planning and zoning legal process. Not through a simple amendment to the original development agreement, whose sole purpose is to ensure the continuation of existing usage until further development is requested, NOT expansion into industrial -commercial usage in an R4 zoned area. In closing, here are a few of the many issues and some quotes that illustrate the how the proposed changes move this project from a simple agricultural livestock bedding usage to an industrial -commercial composting operation.
