July 13, 2018 Re: Opposition to Murguritio/Timber Creek Land Use — H-2018-0042 Dear City Council: My wife and I are opposed to the modification of the land development agreement that is under consideration on this property. We also believe that the original land development agreement is and was simply wrong and should not have been allowed —we believe it should be rescinded. While my wife and I are not neighbors within 300 feet of property (we are 7/10th's of a mile to the South of the Murgoitio Subject property) we believe this whole commercial/industrial use in this location is simply wrong and inappropriate, both legally and from a common sense perspective and here is why: 1. 1 believe that original development agreement was not properly noticed..... but for sure the intended limited grinding of product to be used on site (on the farm right there) is not what is happening now — the business is a full fledged commercial/industrial re- cycling operation. I am happy for Mike that he is being successful but this is simply in the wrong location. 2. My wife and I can hear the noise quite substantially and we are 7/10t"s of a mile away and I have smelled the operation already a handful of times. I cannot imagine being next door or close by. 3. This is R-4 property and it is between two towns growing together with a lot of residential use and with more happening everyday —simply this is an industrial recycling business and it makes no sense whatsoever from any perspective — practically, legally, or from any basic land use perspective. While we are folks that very much support recycling — big time — and I believe in allowing someone to grow their business big time — I own my own and I am a developer myself (we did Fairview Lakes right here in Meridian) this Is simply the wrong place to be doing this. Mike is growing (even from the original development agreement/ annexation time), I am sure this extra business that is happening he did not really contemplate — BUT it is happening - he is back expanding what he wants to expand his uses because he is growing and expanding. 208-HOP-KINS 467-5467 • 800-597-7154 • fax: 208-323-0667 P.O. Once again —this aspect of the annexation (being able to do a commercial/industrial recycling business) should have never been allowed, and surely it should not be allowed to expand in this inappropriate location. I simply think he should find an appropriate industrial site and do everything he is doing and more. When I called in I suggested the Clerk talk to a group that had concerns about the noticing issues - while his offices does all the noticing the Planning Division provides the addresses.
