District Director EES:ds Enclosure DISCUSSION DRAFT MEMORANDUM OF AGREEMENT Ada County Highway District and All Other Municipalities in Ada County In accordance with previous discussions between the Ada County legislative Delegation, and elected officials of Ada County, Boise City and the Ada County Highway District, it is hereby understood and agreed that the follow- ing statements are to clarify the intent of the laws which cre med Llio Ada County Highway District and subsequent amendments to the legislation ner- taining to the Ada County Highway District. I. The responsibility of Highway Districts organized under the provisions of this chapter, within the limits of any city shall be the design, con- struction, reconstruction and maintenance of city rights-of-wav and accompanying curbs, gutters, culverts, sidewalks, paved di bulk- heads and retaining walls. Within city rights-of-way, such design, con- struction, reconstruction and maintenance shall include: a. Traffic and safety engineering for both motori,- aad pedestrian traffic. It is understood that the Highway District will provide traffic control signing and striping, street n --m., signs and traffic control devices as determined by the Dis:-ric— Recommen- dations may be made to the proper legislative bodies in regard to the determination of speed zones and such other ,ecessary traffic control laws which will be enforced b,. Pro4urement, installation, operation and maintenance of traffic control devices where such is primarily of benefit to the motorists. The District shall provide all traffic control devices determined r to be necessary by the District. The District shall follow the guidelines for all devices as outlined in "The Uniform *anual For Traffic Control Devices". d. Drainage where such is,necessary for the benefit of the motorist's safety or necessary for right-of-way maintenance. Drainage of the right-of-way for maintenance and safety of the motorist shall be the responsibility of the District. The District shall not be responsible for the maintenance of private irrigation ditches on private property or the disposal of waste irrigation water or storm water from private property. No unauthorized individual shall work within the public right-of-way without securing a right- of-way permit. The District shall be responsible for the main- tenance of irrigation and drainage structures crossing the right-of-way. -2- f 1'I. quiSi.tion and acceptance of rights-of-way shalL be tho respon [bL]:i.t\ of the Highway District. The District shall be responsible fox 'he acquisition and acceptance of new or additional right-of-way. New con- struction shall be in accordance with the Design Standards os'tablished by the District. It is anticipated that the previous coo.eration and assistance previously received from the.Planning and Zoning Gonim.issions by the Street and Road Departments will continue to be enjoyed by the District until such time as the District shall change oa- revise existing road and street specifications. The Planning and Zoning Commissions have been extremely helpful in the securing of right -of -watt- to provide proper service to the public. Through staff coordination, the District and the Planning and 'Zoning Commis- sions will continue to cooperate in matters of traffic volumes, street width, access and othcc matters of mutual interest. Although not specifically outlined in the proposed legislation, it is further agreed that the Ci�y of Boise shall continue to maintain the system of parking meters and shall also continue to receive the revenue from said meters. All expense in connection with the installation, operation, main- tenance, collection and enforcement of the parking meter system',,- borne by the City o,f Boise. Sidewalks will be maintained by the District under a p,:,.,' y .m ar to that previously followed by the City until modified by the Distr`ct, wherebv the property owner abutting a faulty sidewalk agrees to furnish the material necessary to replace the sidewalk and the District will furnish the labor necessary to accomplish the repair. The District will provide the Local Government share of approved landscaping projects for Federal Aid Secondary and Federal Aid Urban Highway projects. The City Park Department shall thereafter maintain such gre,n medians in a satisfactory condition. Existing green medians shall be maintained by the Park Department. Roads and driveways through parks and not on dedicated pub is right-of-way will remain under the jurisdiction of the owner. Upon request by the Park Superintendent, the District will perform maintenance work h dr.ivewav -4- IL the expense of the owner. Such work must be programmed in advance. with the District Director and will be done as the District work load allows. Signs requested by the Park Superintendent for installation wit'_iin a Park will be manufactured by the District at Park expense. Such s sns installed by the Park for traffic control purposes should conform as ne,:I,,• as possible to,Uniform Manual For Traffic Control Devices in order to avoid ccnfus?.1 of the motorist. Fences and other construction encroachments within -the pirblic rLghc-cifwav will be authorized by the District subject to applicable Local Building Eales. The local building jurisdiction shall provide the inspection pertaining t,, the Building�Code and issue the necessary Building Permit for f,nce construction. The District shall issue all right-of-way permits for any work .i.thin the Public Right -of -Way. The District does not wish to become involved in the is'suancu of permits for the banner at Eighth and Bannock Street. The Building Department has admin- istered this in the past due to the fact that the anchorages are a structural problem on private buildings. So long as legal clearance hei r ver the street are maintained, there is no reason for the District t .nt rfere with the operation. The District will retain the performance bonds for roadway construction in new subdivisions administered by either the County Planning and Zoning Com- mission or the City Planning and Zoning Commission having 4uris-.:ction. Curb Cut Permits will be issued by District in conjunction wit' Right -Of - Way Permit subject to the approval of the Traffic Engineer in regard to traffic control matters. -5- flags and banners which are displayed on the City street light poles will become the property and responsibility of the City. The District grants permissi n �ugtil further notice for the use of the airspace above the rLght-of-way for the purpose of displaying such flags or banners. In accordance with the meeting of January 24, 1972, the District will .assist in flood control or other emergency matters. Boise City and Ada Countp are recognized as the governmental agencies having jurisdiction. Upon request by the agency having jurisdiction, the District will assist. No charg,-, will. be made for supervisory personnel. The agency may call upon the District. Staff for advice and consultation during an impending emergency. A joint decision will be made in determining the necessary action. The District will furnish available employees at their prescribed hourly rates and will be reimbursed by the agency requesting assistance. The District will furnish available equipment at no charge and no charge will be made for payroll associated ,xpenses such as insurance and F.I.C.A. The District will not hire additional equipment and will not purchase material. The City of Boise and the District have by agreements and resolution provided for the District to receive specific services from the Citv in regard to the City Shop for vehicles, the Armory for the Traffic Division quarters, the City Print Shop for reproduction and office supplies, the Communications Division for two-way radio service. The City shall &fliver Warranty Deeds for all property owned by the respective Street Division.
