Zaremba: Mr. Chairman, I move we forward to the City Council recommending
approval of PP 04-026, to include all staff comments of their memo for the hearing date
of December 2, 2004, with the one change. Under site-specific conditions of approval
preliminary plat, on page 15, I would add a paragraph 14 that says applicant will work
with staff and the fire chief to temporarily provide an emergency access on the southern
most lot facing Meridian Road and the applicant has the ability to challenge that at City
Council. End of motion.

Borup: Thank you. Next item is Public Hearing PP 04-040. This is the one we
discussed earlier. It's a request for a preliminary plat for Tuscany Lakes amended. Like
to open this hearing at this time and open for a motion for --
Nary: Mr. Chairman, we did receive a fax today from Monte Morgner, who was not able
to be here tonight, with an objection and I just wanted to submit that to the clerk for part
of the record on this Tuscany Lakes.

Canning: Mr. Chairman, just so you all know, I spoke to his sister Mary DeChambeau
earlier today and she said she would inform him that -- of the hearing date on the 6th
and he might try and make that hearing date.

Public Hearing: PFP 04-008 Request for Preliminary/Final Plat
approval for 4 building lots on 8.02 acres in an I-L zone for Nola
Subdivision by Bergey Land Surveying - SWC or East Pine Avenue and
North Nola Road:
Borup: Okay. Next item is Public Hearing PFP 04-008, a request for preliminary/final
plat approval for four building lots and 8.02 acres in an I-L zone for Nola Subdivision,
Like to open this hearing at this time and start with the staff report.
Wilson: Chairman Borup, Members of the Commission, Nola Subdivision is located at
the corner of East Pine Avenue and North Nola Road and is zoned Light Industrial. The
proposal is for a four-lot subdivision. It has come in as a preliminary/final plat request.
The southern most Lot 4 has an existing structure, which is used for Oak Harbor
Freight. The northern portion of the subdivision contains three lots with frontage on
East Pine Avenue and Nola Road on the east. Locust Grove is scheduled for
improvements. It's on ACHD's five-year work program for extension to the west of this
subdivision, requiring a 96-foot right of way for the associated improvements to Locust
Grove Road. Along with that, the intersection of Locust Grove and Pine will be
improved and widened onto a portion. Pine will be improved on a portion of this -- of
this property to the east of the intersection and it's staff's understanding that there has
been some recent developments with the applicant and ACHD regarding the design and
the right of way requirements along East Pine Avenue across north of this property and
we anticipate that a revised preliminary plat will be submitted. I have to apologize for
the large draft across the front page of this. There was, actually, supposed to be a
water mark and read it -- so, it was supposed to be there, but that page was supposed
to be readable, so apologize for that. I can get to the specifics in them, but we are
recommending a continuation of this upon resolution of some of the outstanding issues

APPLICATION SUMMARY
The applicant, Tuscany Development, Inc., has applied for Preliminary Plat (PP) approval of six
(6) buildable lots in locations that were previously platted as storm drainage ponds for Tuscany
Lakes Subdivision, On August 13, 2002, the Meridian City Council approved the Preliminary
Plat of Tuscany Lakes Subdivision with 455 buildable lots (net density of 3.1 units per acre, or, a
gross density of 2.4 units per acre), 38 common lots, and one school lot. The subject property
was also granted a Conditional Use Permit for a Planned Development, which included reduced
fi'ontage requirements, block length modifications, and modifications to sidewalk requirements.
The property is designated "Medium Density Residential" on the 2002 Comprehensive Plan
Future Land Use Map. The proposed preliminary plat depicts four (6) new buildable lots, which
range in size between 10,332 square feet and 29,185 square feet.
Staff recommends approval of the subject PreliminarylFinaI Plat (pP-04-040) with the conditions
outlined in this report.
LOCATION
The subject property is located southwest of the intersection of South Eagle Road and East
Victory Road. It is located in the N Yo of Section 29, Township 3 North, Range I East.
SURROUNDING PROPERTJES
North: Thousand Springs and Sherbrook Hollows Subdivision, zoned R-4, and rural/agricultural
residential, zoned RUT (Ada County).
South: Rural/agricultural residential properties, zoned RUT (Ada County).
East: Messina Village No.2 Subdivision, zoned R-4.

OWNER OF RECORD
The property owner of record is Tuscany Development, Inc. and Tuscany Development, Inc. has
submitted an affidavit oflegal interest for the subject property.
PRELIMINARY PLAT FINDINGS
Meridian City Code (MCC) 12-3-3 J.2 and 12-3-5 D read as follows: "In determining the
acceptance of a proposed subdivision, the Commission/Council shall consider the objectives of
this title and at least the following:
A.
Tbe conformance of the subdivision with the Comprehensive Plan;
Staff finds the 2002 Comprehensive Plan Future Land Use Map designates all of the
subject property as "Medium Density Residential", which allows for densities of three to
eight units per acre. (See Chapter VII, pg. 99.) Staff finds that the proposed subdivision
is in compliance with the Comprehensive Plan.
B.
Tbe availability of public services to accommodate the proposed development;
The subject site can be serviced by the City of Meridian's sanitary sewer and water
systems. Sewer and water will be extended to the proposed development by the
developer. The Commission and Council should reference any written or verbal
testimony submitted by the Meridian Fire, Police, and Parks Departments, and any other
agency, regarding their ability to adequately service this project.
Staff finds that the property proposed for development can be serviced by essential public
facilities and services.
C.
Tbe continuity oftbe proposed development with the capital improvement program;
Staff finds that the subdivision will not conflict with the capital improvement program
because the developer is required to install sewer, water, utilities and irrigation, for the
development at their cost.
D.
The public financial capability of supporting services for the proposed development;
The developer will be fmancing the extension of sewer, water, utilities and irrigation
services to serve the project, The primary public costs to serve the future site will be fire
and police services. Staff finds that this development will not cause excessive additional
requirements at public cost, if the applicant complies with the conditions of approval for
the and preliminary plat application. The Commission and Council should consider the

Meridian Police, Parks and Fire Departments' comments with regard to their capability to
serve the proposed development.
E.
The other health, safety or environmental problems that may be brought to the
Commission's attention.
There are no health, safety, or environmental problems to bring to the Commission's
attention.
PRELIMJNARY PLAT SPECIAL CONSIDERATIONS
1. Open Space: The approved preliminary plat for Tuscany Lakes Subdivision contained a total
of 18 acres of common/open space, which represented approximately 9.4 percent of the gross
acreage of the project. The changes proposed with Tuscany Lakes Amended preliminary plat
reduce this acreage by approximately .9 acres, reducing the total common/open space to
approximately 8.9 percent of the gross acreage of the project. The total common/open space
provided remains above the 5 percent minimum required for the development per MCC 12-
13-16.
2. Amenities: The applicant is proposing, as a part of this amendment, a tot lot with active open
space on the reduced open space lot on Lot 53, Block I. It should be noted that Lot 53,
Block 1 will be an unbuilable lot due to insufficient street fi'ontage. There does not appear to
be a loss or reduction of neighborhood amenities fi'om the original preliminary plat.
3. Trees in drainage swells: ACHD has given approval for the applicant to have one tree within
the roadside drainage swells at each property line intersection, per approved landscape plans
L-l and L-2, dated October 7, 2004. Tree species planted along streets should be limited to
Class I and ll, due to the proximity of the proposed plantings to the detached sidewalk.
Where proposed street sections with drainage swells will be adjacent to previously approved
Final Plats with curb and gutter, the construction drawings shall depict how the different
street sections shall meet.
SITE SPECIFIC CONDITIONS (PRELIMINARY PLATIFINAL PLAT)
1. This Amended Preliminary Plat shall be subject to all applicable conditions of approval from
Tuscany Lakes Subdivision (AZ-02-005, PP-02-006, CUP-02-006).
2. Trees within the roadside drainage swells shall be limited to one per property line
intersection, per ACHD requirements, and the species shall be limited to Class I and ll, as
defined by the City of Meridian Landscape Ordinance.
3. Fencing details shall be submitted with each Final Plat application. Fencing on Lots 9, 10,
and 11, Block 7 and Lots 39 and 52, Block 1 adjacent to pathways shall not be over three feet
in height if constructed of a solid material, and shall not be more than 4 feet in height if it is
non-sight obscuring. A 6-foot high perimeter fence shall be installed prior to any building
pennits being issued, unless agreed to otherwise in writing by the Planning Director.

4. Where proposed street sections with drainage swells will be adjacent to previously approved
Final Plats with curb and gutter, the construction drawings shall depict how the different
street sections shall meet.
5. Sanitary sewer and water service to these lots will be ftom service line extensions ftom
existing mains adjacent to the project. Subdivision designer to coordinate service routing
with the Public Works Department.
GENERAL CONDITIONS
I. Underground year-round pressurized irrigation must be provided to all lots within this
development. The City of Meridian requires that pressurized irrigation systems be supplied
by a year-round source of water. The applicant shall be required to utilize any existing
surface or well water for the primary source. If a surface or well source is not available, a
single-point connection to the culinary water system shall be required. If a single-point
connection is utilized, the developer shall be responsible for the payment of assessments for
the common areas prior to signature on the final plat by the City Engineer.
2. Any tree over 4" in caliper that is removed ftom the property shall be replaced by installing
additional trees, being the equivalent number of caliper inches of trees that were removed.
Required landscaping trees will not be considered as replacement trees for those trees that are
removed.
3. Any existing domestic wells and/or septic systems within this project will have to be
removed ftom their domestic service, per City Ordinance Section 5-7-517. Wells may be
used for non-domestic purposes such as landscape irrigation.
4. Any drainage areas (detention/retention basins) must be designed to ensure that water will
percolate or discharge within a period of time not to exceed 24 hours for all storms up to and
including a laO-year storm event. Side slopes within drainage areas shall not exceed 3:1.
The project engineer should pay close attention to the results offield studies determining the
groundwater, soil type & and characteristics during the design and construction phases.
5. Coordinate fire hydrant placement with the City of Meridian Public Works Department.
6. Streetlights will be required at locations designated by the Public Works Department. All
streetlights shall be installed at the expense of the Applicant. Typical locations are at street
intersections and/or fire hydrants.
7. Developer shall coordinate mailbox locations with the Meridian Post Office.
8. All sidewalks shall be constructed in accordance with MCC 12-5-2.K. Prior to signature of
the final plat(s), all sidewalks shall be constructed or a financial guarantee that said
improvements will be completed shall be provided

9. A note shall be placed on the final plat stating that unless otherwise approved, all building
setbacks shall meet the requirements of the zoning ordinance in effect at the time of building
permit submittal.
10. A letter of credit or cash surety in the amount of 110% will be required for all landscaping,
pressurized irrigation, sanitary sewer, water, etc., prior to signature of the final plat.
II. Applicant shall be required to pay Public Works development plan review, and construction
inspection fees, as detennined during the plan review process, prior to signature on the final
plat per Resolution 02-374.
12. Plat approval shall be subject to the expiration provisions set forth in MCC.
13. Staff's failure to cite specific ordinance provisions or terms of the approved preliminary plat,
conditional use permit or development agreement does not relieve Applicant of responsibility
for compliance.

This is a staff level approval Df a preliminary plat for Amended Tuscany Lakes Subdivision. The
applicant is proposing to convert previously approved storm drainage lots into 6 additional building
lots throughout the subdivision. All of the roadway improvements were required with Tuscany
Lakes Subdivision, and thDse requirements are still applicable to this amended preliminary plat. The
District Planning Review staff is not approving the roadside swale section with this letter, and the
applicant will need to coordinate the drainage accommDdations with District Development Review
staff. The applicant will need to demonstrate that the drainage can be properly accommodated with
the requested change. The applicant is required to pay all applicable platting and review fees.

filed, for review, prior to final Ptatting. Please contact Donna Moore at 466- 7861 for
further information.
All laterals and waste ways must be protected. The District's Ridenbaugh Canal courses
through this proposed project with an easement of one hundred (100) feet, fifty (50) feet
both sides. This easement must be protected and any encroachment without a signed
License Agreement and approved plan, before any construction is started, is
unacceptable.
All municipal surface drainage must be retained on site. If any municipal surface
drainage leaves the site, the Nampa & Meridian Irrigation District must review drainage
plans. The developer must comply with Idaho Code 31-3805. It is recommended that
iITigation water be made available to all developments within the Nampa & Meridian
Irrigation District.
