BIRD, DONNELL, ROUNTREE, WARDLE
A RESOLUTION VACATING A PORTION OF THE FIVE (5) FOOT
UTILITY EASEMENT ALONG THE INTERIOR LOT LINE BETWEEN LOTS
26 AND 27, BLOCK 1 OF LOCHSA FALLS SUBDIVISION NO.6 ALONG THE
EASTERN BOUNDARY OF THE SUBDIVISION; AS FILED AND RECORDED
WITH THE ADA COUNTY RECORDER IN BOOK 88 OF PLATS, PAGES 10,
145 TO 10,146 AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on December 14, 2004, the City Council ofthe City of Meridian,
held a hearing on the vacation of a portion of the five (5) foot utility easement along the
interior lot line between lots 26 & 27, Block 1 of Lochsa Falls Subdivision No.6 along
the eastern boundary of the subdivision as filed and recorded with the Ada County
Recorder in Book 88 of Plats, Pages 10,145 to 10,146; and
WHEREAS, after such hearing, the City Council, by formal motion, did approve
said described vacation; and
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN CITY, IDAHO:
Section 1. That a portion of the five (5) foot utility easernent along the interior lot
line between lots 26 & 27, Block I of Lochsa Falls Subdivision No.6 along the eastern
boundary of the subdivision as filed and recorded with the Ada County Recorder in Book
88 of Plats, Pages 10,145 to 10,146 is hereby vacated. Copies of the necessary
relinquishments are attached as Exhibit "A".
Section 2. That this Resolution shall be in full force and effect immediately upon
its adoption and approval.

APPUCATION SUMMARY &: LOCATION
The applicant, Ramsey Homes, requests approval to vacate the recorded utility easement along the
interiorlotHne between Lots 26 and 27, Block 1 ofLochsaFaUs Subdivision No.6 along the eastern
boundary ofthø subdivision. A single family house was CODStrIIcte<I on Lot 27 that encroached into
the platted easement, The app1icant intends to relocate the aide lot line to accommodate the required
side setback for the residence, Approval of the subject œseøumt vaeati.on is required prior to the lot
line adjustment being approved by the City Engineer and reoorded.
Lochsa. Fa1ls Subdivision is zoned R-4 and is located on tho west side ofN. Ten Mile in the SeáÍ.on
26, TAN., R.IW,
Idaho Power, Intermountain Gas, and Qwest have submitted nota.rized consent for relinquishment of
tbe easement which the a.pp1icaDt hu inchIded with their application. A letter of relinquishment is still
needed ftom Cable One. The Meridian PubHc Works Department has no objection to the
re1inqui.sbment of the eBSemel1t.

In response to your request for comment. the Ada County Highway District (ACHD) staff has reviewed
the submitted applicatiorl and site plan tor the item referenced above: It has been determined that the
Right-ot-Way and Development Services Department does not have any site specific requirements for
you at this time due to the fact that the proposed vacation does not affect the transportation system.
If the site plan or use should change in the tuture, ACHD will review the site plan and may require
improvements to the transportation system at that time.
A traffic impaet fee may be assessed by ACHD and will be due prior to the issuance of a building
permit. Contact ACHD Planning & Development Services at 387-6170 for Information regarding
Impaetfen. . . .
Prior to the construction or installation of any roadway improvements (curb, gutter. sidewalk, pavement
widening, driveways. culverts, etc), a permit or license agreement must be obtained from ACHD.
