BY THE CITY COUNCIL:
BIRD, DONNELL, ROUNTREE, WARDLE
A RESOLUTION VACATING A PORTION OF THE FIVE (5) FOOT
UTILITY EASEMENT ALONG THE INTERIOR LOT LINE BETWEEN LOTS
26 AND 27, BLOCK 1 OF LOCHSA FALLS SUBDIVISION NO.6 ALONG THE
EASTERN BOUNDARY OF THE SUBDIVISION; AS FILED AND RECORDED
WITH THE ADA COUNTY RECORDER IN BOOK 88 OF PLATS, PAGES 10,
145 TO 10,146 AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on December 14, 2004, the City Council of the City of Meridian,
held a hearing on the vacation of a portion of the five (5) foot utility easement along the
interior lot line between lots 26 & 27, Block I of Lochsa Falls Subdivision No.6 along
the eastern boundary of the subdivision as filed and recorded with the Ada County
Recorder in Book 88 of Plats, Pages 10,145 to 10,146; and
WHEREAS, after such hearing, the City Council, by formal motion, did approve
said described vacation; and
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF MERIDIAN CITY, IDAHO:
Section 1. That a portion of the five (5) foot utility easement along the interior lot
line between lots 26 & 27, Block I of Lochsa Falls Subdivision No.6 along the eastern
boundary of the subdivision as filed and recorded with the Ada County Recorder in Book
88 of Plats, Pages 10,145 to 10,146 is hereby vacated. Copies of the necessary
relinquishments are attached as Exhibit "A".
Section 2. That this Resolution shall be in full force and effect immediately upon
its adoption and approval.

APPLICATION SUMMARY 01: LOCATION
The applicant, Ramsey Homes, requests approval to vacate the recorded utility easement Blong the
interior lot 8ne between Lots 26 and 27, Block 1 ofLocbsa FaDs Subdivision No.6 along: the eastern
boundary of the subdiviaion. A single family house was conøtruoted on Lot 27 that encroached into
the platted easement, The applicant intends to relocate the aide lot line to accommodate the required
side setback for the residence. Approval of the subject easement \'IIC8tion is required prior to the lot
line adjustment being approved by the City Engineer and recorded.
Loehsa Falls Subdivision is zoned R-4 and is looated on tho west side ofN. Ten.Mile in the Section
26. TAN., R.IW.
Idaho Power, Intermountain Gas, and Qwest have submitted notarized consent for relinquishment of
the easement which the applicant hu included with their application. A letter of relinquishment is still
needed ftom Cable One. The Meridian Public Works Department has no objection to the
relinquishment of the easement.
Stalfbas no objection to the proposed vacation.

The Subdivision and Development Ordinance (Title 12), Cbapter 10, requires the Pl8IU1ÏD8 "Zoning
Commission to review and make a reçommenctation on Vacation applications. A publiç hearing is then
required before the City Council,
CONDmONS OF APPROVAL
Applicant sball obtain and submit a relinquislunent of easement from Cable One to the
Planning " Zoning Department prior to the City Council public bearing.
RECOMMENDATION
1.

In response to your request for comment, the Ada County Highway District (ACHD) staff has reviewed
the submitted application and site plan for the item referenced above: It has been detennined that the
Right-of-Way and Development Services Department does not have any site specific requirements for
you at this time due to the fact that theproposecl vacation does not affect the transportation system.
If the site plan or use should change in the future, ACHD will review the site plan and may require
improvements to the transportation system at that time.
, A traffic Impact fee may be assessed by ACHD and will be due prior to the issuance of a building
permit Contact ACHD PlaMlng & Development Services at 387-6170 for Information regarding
Impact fees. . . .
Prior to the construction or installaiion of any roadway improvements (curb, gutter, sidewalk, pavement
Widening, driveways, culverts, ete), a permit or license agreement must be obtained from ACHD.
