The site is located at the southwest corner of Overland Road and Meridian Road (SH 69). Acreage: 7.24 Current Zoning: C-2 Proposed Zoning: C-G Vicinity Map A. 1. 2. 3. 4. 5. Findings of Fact Trip Generation: This development is estimated to generate 3,175 additional vehicle trips per day (651 existing) based on the Institute of Traffic Engineers Trip Generation Manual. Impact Fees: There will be an impact fee that is assessed and due prior to issuance of any building permits. The assessed impact fee will be based on the impact fee ordinance that is in effect atthat time. Traffic Impact Study: A traffic impact study may be required when the District reviews a development application for this site. Site Information: The site is currently utilized for a convenience store with gasoline sales and agricultural purposes. Overland Road is currently improved with 2 travel lanes, a left turn lane at the intersection with Meridian Road, and no curb, gutter, or sidewalk abutting the site. . Meridian Road (SH 69) is currently improved with 4 travel lanes and a center/left turn lane, and no curb, gutter, or sidewalk abutting the site. Meridian Road is under the jurisdiction of the Idaho Transportation Department. 8. 9. 10. B. 3 Existing Right-of-Way . Overland Road currently has between 72 and 86-feet of right-of-way abutting the site. . Meridian Road (SH 69) currently has between 100 and 125.feet of right-of-way abutting the site. Existing Access to the Site The site currently has four driveways on Overland Road and four driveways on Meridian Road (SH 69). Site History ACHD has not previously reviewed this site. 11. Capital Improvements Plan/Five Year Work Program Overland Road is scheduled in the District's Five Year Work Program to be widened to 5 lanes from Meridian Road to Linder Road in 2007. The intersection of Overland Road and Meridian Road (SH 69) is also scheduled in the District's Five Year Work Program and the Capital Improvements Plan to be widened to 7 lanes on all four intersection legs in 2007. . Fin~ings for Consideration This application is for a rezone and annexation only. Listed below are some of the policies that apply to the site. Upon the receipt of a development application the District may require additional Findings of Consideration that apply to the review of future development applications. 1. Right-ot-Way Overland Road District policy requires 96-feet of right-of-way on 5 lane arterial roadways and 120-feet on 7-lane arterial roadways (Figure 72-F1 B). These right-of-way widths allows for the construction of a 5 to 7- lane roadway with curb, gutter, 5-footconcrete detached sidewalks and bike lanes. The intersection of Overland Road and Meridian Road (SH 69) is currently listed in the District's Five Year Work Program and the intersection design is 95% complete. The District's Design Department has determined the necessary right-of-way widths for the interse.ction project. Dedicate 65-feet of right-of-way (tapering to 54-feet of right-of-way at the west property line, see intersection design plans) from the centerline of Overland Road abutting the parcel by means of a warranty deed. The right-of-way purchase and sale agreement and deed must be completed and signed by the applicant prior to scheduling the final plat for signature by the ACHD Commission or prior to issuance of a building permit (or other required permits), whichever occurs first. Allow up to 30 business days to process the right-of-way dedication after receipt of all requested material. The owner will be paid the fair market value of the right-of-way dedicated which is an addition to existing ACHD right-of-way if the owner submits a letter of application to the impact fee administrator prior to breaking ground, in accordance with the ACHD Ordinance in effect at that time (currently Ordinance #200), iffunds are available. 4. 4 2. Sidewalk Overland Road District policy requires 7-foot wide attached (or 5-foot detached) concrete sidewalk on all collector roadways and arterial roadways (7204.7.2). The applicant will be required to either construct a 5-foot detached concrete sidewalk abutting the site on Overland Road or provide the District with a road trust for the approximate cost of the sidewalk $9,000 ($20 a lineal foot, 450-feet). If the applicant chooses to construct the detached concrete sidewalk, they should coordinate with District Development Review and Design staff on the location of the sidewalk. 3. Driveways Offsets District policy 72-F4 (1) requires driveways located on arterial roadways neara signalized intersection to be located a minimum of 440-feet from the signalized intersection for a full-access driveway and a minimum of 220-feet from the signalized intersection for a right-in/right-out only driveway. There is an existing driveway on the norih side of Overland Road located approximately 200-feet west of the intersection of Overland Road and Meridian Road (SH 69). The applicant will be required to align the first proposed driveway on Overland Road with the existing driveway on the norih side of Overland Road. This driveway meets the criteria to be restricted to a right-in/right-<Jut driveway; however, due to the existing driveway on the norlh side, it will not be restricted at this time. The District reseNes the right to restrict the driveways to right-in/right-out driveways in the future if the driveways become a safety concern. The applicant has proposed a second driveway on Overland Road located approximately 36CJ.-feet west of the intersection of Overland Road and Meridian Road (SH 69). This driveway will be required to be shifted. The driveway should be located in accordance with District policy, 440-feet west of the intersection of Overland Road and Meridian Road (SH 69). The location of this driveway will be dependent upon the review of site distance by District Traffic SeNices staff with the development application. Widths District policy 7207.9.3 restricts commercial driveways with daily traffic volumes over 1,000 vehicles to a maximum width of 36-feet. Most commercial driveways will be constructed as curb-cut type facilities if located on local streets. Curb return type driveways with 15-foot radii will be required for driveways accessing collector and arterial roadways. Paving Graveled driveways abutting public streets create maintenance problems due to gravel being tracked onto the roadway. In accordance with District policy, 7207.9.1, the applicant should be required to pave the driveway its full width and at least 30-feet into the site beyond the edge of pavement of the roadway and install pavement tapers with 15-foot radii abutting the existing roadway edge. Meridian Road (SH 69) Meridian Road (SH 69) is under the jurisdiction of the Idaho Transportation Department. The application should contact ITD to determine what improvements and access points will be required on State Highway 69. 2. 3. 4. 5. 6. D. 1. 5 5. Other Access Overland Road is classified as a minor arterial. Other than the access points specifically approved with this application, no other access points to Overland Road are approved. A note of the access restriction should be placed on the final plat. C. Site Specific Conditions of Approval This application is for a rezone and annexation. Listed below are some of the site specific conditions of approval that District may require when it reviews a future development application. The District may add additional site specific requirements when it reviews a specific redevelopment application. 1. Dedicate 65-feet of right-of-way (tapering to 54-feet of right-of-way at the west property line, see intersection design plans) from the centerline of Overland Road abutting the parcel by means of a warranty deed. Construct a 5-foot detached concrete sidewalk abutting the site on Overland Road OR provide the District with a road trust for the approximate cost of the sidewalk $9,000 ($20 a lineal foot, 450-feet). If the applicant chooses to construct the detached concrete sidewalk, they shall coordinate with District Development Review and Design staff on the location of the sidewalk. Located the first proposed driveway on Overland Road in alignment with the driveway on the north side of Overland Road, located approximately 200-feet west of the intersection. This driveway shall be constructed as a maximum 36-foot wide curb return driveway with 15-foot radii. This driveway may be restricted in the future as a right-in/right-out driveway if conditions warrant. Locate the second proposed driveway on Overland Road a minimum of 440-feet west of the intersection of Overland Road and Meridian Road (SH 69), measured near edge to near edge. This driveway shall be constructed as a maximum 36-foot wide curb return driveway with 15-foot radii. When the District receives a development application, this driveway location will require the approval of District Traffic Services staff for site distance safety. Comply with requirements of ITD for State Highway 44 frontage. Submit to the District a letter from ITD regarding said requirements prior to District approval of the final plat or issuance of a building permit (or other required permits), whichever occurs first. Contact District III Traffic Engineer Dan Coonce at 334-8340. Comply with all Standard Conditions Of Approval. Standard Conditions of Approval Any existing irrigation facilities shall be relocated outside of the right-of-way. 9. 11. E. 1. 6 2. All utility relocation costs associated with improving street frontages abutting the site shall be borne by the developer. 3. Replace any existing damaged curb, gutter and sidewalk and any that may be damaged during the construction of the proposed development. Contact Construction Services at 387-6280 (with file number) for details. 4. Utility street cuts in pavement less than five years old are not allowed unless approved in writing by the District. Contact the District's Utility Coordinator at 387-6258 (with file numbers) for details. 5. All design and construction shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. 6. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. 7. Construction, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. I 8. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #200, also known as Ada County Highway District Road Impact Fee Ordinance. It is the responsibility of the applicant to verify all existing utilities within the right-of-way. The applicant at no cost to ACHD shall repair existing utilities damaged by the applicant. The applicant shall be required to call DlGLlNE (1-800-342-1585) at least two full business days prior to breaking ground within ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-6190 in the event any ACHD conduits (spare or filled) are compromised during any phase of construction. 10. No change in the terms and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change from the Ada County Highway District. Any change by the applicant in the planned use of the property which is the subject of this application, shall require the applicant to comply with all rules, regulations, ordinances, plans, or other regulatory and legal restrictions in force at the time the applicant or its successors in interest advises the Highway District of its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted' pursuant to the law in effect at the time the change in use is sought. Conclusions of Law The proposed site plan is approved, if all of the Site Specific and Standard Conditions of Approval are satisfied. 2. ACHD requirements are intended to assure that the proposed use/development will not place an undue burden on the existing vehicular and pedestrian transportation system within the vicinity impacted by the proposed development. There is a one week tumaround for this approval. 0 Working in the ACHD Right-of-Way Four business days prior to starting work have a bonded contractor submit a "Temporary Highway Use Permit Application" to ACHD Construction - Pennits along with: a) Traffic Control Plan b) An Erosion & Sediment Control Narrative & Plat, done by a Certified Pian Designer, if trench is >50' or you are placing >600 sf of concrete or asphalt. Construction (Subdivisions) 0 Sediment & Erosion Submittal At least one week prior to setting up a Pre-Con an Erosion & Sediment Control Narrative & Plat, done by a Certified Plan Designer, must be turned into ACHD Construction - Subdivision to be reviewed and approved by the ACHD Drainage Division. 0 Idaho Power Company Vic Steelman at Idaho Power must have his IPCO approved set of subdivision utility plans prior to Pre-Con being scheduied. 0 Final Approval from Development Services ACHD Construction - Subdivision must have received approval from Development Services prior to scheduling a Pre-Con. 9 Request for Reconsideration of Commission Action 1. Request for Reconsideration of Commission Action: A Commissioner, a member of ACHD staff or any other person objecting to any final action taken by the Commission may request reconsideration of that action, provided the request is not for a reconsideration of an action previously requested to be reconsidered, an action whose provisions have been partly and materially carried out, or an action that has created a contractual relationship with third parties. a. Only a Commission member who voted with the prevailing side can move for reconsideration, but the motion may be seconded by any Commissioner and is voted on by all Commissioners present. If a motion to reconsider is made and seconded it is subject to a motion to postpone to a certain time. b. The request must be in writing and delivered to the Secretary of the Highway District no later than 3:00 p.m. on the day prior to the Commission's next scheduled regular meeting following the meeting at which the action to be reconsidered was taken. Upon receipt of the request, the Secretary shall cause the same to be placed on the agenda for that next scheduled regular Commission meeting. I c. The request for reconsideration must be supported by written documentation setting forth new facts and information not presented at the earlier meeting, or a changed situation that has developed since the taking of the earlier vote, or information establishing an error of fact or law in the earlier action. The request may also be supported by oral testimony at the meeting. d. If a motion to reconsider passes, the effect is the original matter is in the exact position it occupied the moment before it was voted on originally. It will normally be returned to ACHD staff for further review. The Commission may set the date of the meeting at which the matter is to be returned. The Commission shall only take action on the original matter at a meeting where the agenda notice so provides. e. At the meeting where the original matter is again on the agenda for Commission action, interested persons and ACHD staff may present such written and oral testimony as the President of the Commission determines to be appropriate, and the Commission may take any action the majority of the Commission deems advisab.le. f. If a motion to reconsider passes, the applicant may be charged a reasonable fee, to cover administrative costs, as established by the Commission. 10
