Dear Mr. Berg:
The Idaho Transportation Department has reviewed the application and determined, that the
access to the development could be developed off of Overland Road and not of off State
Highway. This section of SH-69 has been designated a Principal Arterial Type IV. ITD would
like the City of Meridian to help us preserve this corridor by recognizing the following condition.
The access to a Principal Arterial Type IV will be on a limited basis. ITD would like County and
the City of Meridian to help us preserve this corridor by recognizing the following conditions.
Building setbacks for future right of way widths will be, A: 120 feet each side of centerline (240
feet total) to include a frontage road, or B: 70 feet each side of centerline (140 feet total) if the
developer provides an internal frontage road type system to feeder roads.

PLANNING & ZONING RECOMMENDATIONS
NOISE EV ALUATION/MITIGATION
As traffic noise impacts are a potential for property adjacent to state or federal highways, the Idaho Transportation
Department (ITD) requests the local Planning & Zoning Authority to require Applications for Development or Zone
Change Requests to evaluate and, if necessary, mitigate for noise impacts as indicated below under Noise Evaluation
Process.
If the Local Jurisdiction and the Applicant choose not to consider noise abatement, a letter with signatures trom the
authorized representative is required trom both the agency and the applicant. The letter must state that the agency and
the applicant have been notified of the potential noise impacts and the ITD policy. Additionally, the letter must state
that the right to request any noise abatement now and in the future is waived. One letter may be submitted but it
requires the signature of the authorized representative trom both the Applicant and the Local Jurisdiction.
Noise Evaluation Process
I. The applicant shall perform a Traffic Noise Screen in accordance with the Environmental Process Manual
(EPM) Section 1350.02. The following information will be provided by ITD Traffic Section:
The Twenty Year Design Hourly Volume (DHV
2. If the results ofthe Traffic Noise Screen so warrant, then the applicant shall perform a Traffic Noise Impact
Analysis in accordance with EPM Section 1350.03.
3. The applicant shall submit a noise report to the Planning & Zoning authority with a copy to lTD. This report
shall include:
a. Results of the Traffic Noise Screen, including supporting assumptions, documentation, and conclusion
as to why a Traffic Noise Impact Analysis was warranted.
b. Results of Traffic Noise Impact Analysis including supporting assumptions and documentation
c. Type of abatement to be used for the proposed development, if any, and discussion of different types
of abatement considered.
4. The Planning & Zoning authority will review the noise report, solicit and consider comments trom ITD, and
determine which (if any) abatement methods will be made as a condition of the proposed development.

The Environmental Process Manual (EPM) is available on line at

All noise analysis and report preparation shall be done by individuals with experience with highway traffic noise
modeling.

Please find the attached Application for annexation and rezone for the property located at the
southwest corner of Meridian and Overland Roads. The property is approximately nine (9) acres
and is currently zoned C2 in Ada County.
The property is currently used for a convenience store with gasoline sales and agricultural
purposes. The attached development plan is conceptual, however we would request that the
annexation and rezone be conditioned upon future approval of a detailed site plan.
This application meets the intent of the Meridian Comprehensive Plan in that the plan designates
this comer for future commercial uses. Therefore the applicant is requesting a CG zoning
designation for this property.

In response to your fax today I have the following additional information as per your request:

The characteristics of the property that make it desirable for rezoning are:
1. It is located at the intersection of two (2) major arterials
2. It is designated commercial in Meridian's comprehensive plan
B.
The desirability of development pertaining to the zoning amendment and harmony with adjacent
development is as follows:
1. This is a prime commercial corner that currently is operating as a gasolinelconvenience store
with accessory uses.
To the west is a junkyard, to the north is a gasoline/convenience store, to the east is vacant
commercial ground and to the south is residential. Again, the comprehensive plan designates
this comer as future commercial.

This proposed zoning amendment relates to the comprehensive plan as follows:
1. Water and sewer are available to the property
2. This application meets Goal ill, Objective A in that Overland Road will be expanded using
part of the subject property for right-of-way.
This application meets with Goal IV, Objective D which encourages appropriate land uses
along transpiration corridors. Again, this property is located at the intersection of two (2)
major arterials and traditionally this is where commercial developments should be located.
This application meets with Goal I, Objective ß, Action 5 in that this will locate
community/neighborhood commercial services on arterials near residential areas.
