Packard Estates Development, LLC (File No. VAC-O4-009).
We have reviewed this submittal and offer the following comments, as conditions of the Applicant.
These conditions shall be considered infull. unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY & LOCATION
The applicant, Packard Estates Development, requests approval to vacate two segments of existing
public right-of-way within the boundaries of the approved Preliminary Plat for Redfeather Estates
Subdivision No.2. One segment is approximately 650 feet long and is adjacent to Perkins-Brown
Subdivision on the west property line. This existing right-of-way is a total of 40 feet wide with the
west halflocated in Perkins-Brown Subdivision and the east halflocated in Redfeather Estates. Only
the east halfis being vacated under this application. The other segment is approximately 1,000 feet
long and is a portion of the existing right-of-way for E. Granger Drive. Both of these segments were
shown on the approved preliminary plat to be vacated in the future.
A condition of approval ftom both the City of Meridian and ACHD was that the property owner
either vacate or exchange these rights-of-way before final plat signature. The applicant intends to
include the20-feet of right-of-way south of the Milk Lateral as part of future buildable and common
area lots within Phase 4 of the subdivision. The E. Granger right-of-way is being shifted to the north
to accommodate a reconstructed street that will remain in the general alignment orE. Granger today.
Redfeather Estates Subdivision is zoned R-8 and is located on the south side orE. Ustick Road in
Section 4, T.3N., R.1E.
Staff has no objection to the proposed vacation.

The owner of record of the subject property is Packard Estates Development, LLC, who has given
consent to Engineering Solutions to submit the vacation application.

Subdivision), Zoned RUT (County)/Agriculture, Zoned RUT (County)
PROCESS
The Subdivision and Development Ordinance (Title 12), Chapter 10, requires the Planning &
Zoning Commission to review and make a recommendation on all Vacation applications. A public
hearing is then required before the City Council. Idaho Statute (Title 50, Chapter 13) grants the
highway district commissioners [mal authority to vacate public rights-of-way.
CONDITIONS OF APPROVAL
1.
Prior to the City of Meridian signing the Final Plat for any portion of Redfeather Estates
Subdivision that contains the subject vacated property, the applicant must submit evidence to
the City Engineer that the rights-of-way vacation has been approved by all required agencies
and authorities.
RECOMMENDATION
Staff recommends approval of the right-of-way vacation for Redfeather Estates Subdivision No.
2.

In response to your request for comment, the Ada County Highway District (ACHD) staff has
reviewed the submitted application and site plan for the vacation/exchange of Granger Street
right-of-way. It has been determined that the Right-of-Way and Development Services Department
does not have any comment for you at this time.
If the City of Meridian provides the applicant with consent to vacate/exchange this right-of-way, the
applicant will be required to file a formal request with the District to vacate/exchange this right-of-
way. Upon receipt of a formal application for vacation/exchange, the Ada County Highway District
Commission will set a public hearing and make a determination as to whether or not the
applicant's proposal is in the public's interest to vacate/exchange this right-of-way.
