The Tranquil Estates HOA,s opposition is based upon the following factors: 1. Possible loss of property values caused by the proposed garbage dump. 2. Foul smells from the decomposition of "Food and Garden Waste" 3. Increased insect problems with "flies and mesquites. 4. Increased machine noise from additional Loaders, Excavators, Conveyors, Generators etc. 5. Increased heavy truck traffic 6. Possible ground water problems caused by leaching ponds. 7. Due to high winds in this part of the county, the effects of blowing trash. Given the fact that the proposed expansion property is adjoining property located in ADA County and the City of Kuna,s impact area have these groups been given time to respond?. As for the leaching pond has the State Of Idaho Department of Environment approved this idea if not then Mr. Murgoitio should get impact study done at his request and Expense! The expansion of this recycling operation is not in the best interest of the city of Meridian, Ada county or the city of Kuna. In closing, I remind you this property was recently annexed into the City of Meridian at the hearing it was stated the property would be used for housing. Now the City wishes to approve an expanded garbage dump. Ask your self would you like a new home near this site. How will the City if Meridian control the insect and foul smell problems. According to the plan filed with the amendment Timber Creek plans operate 6 days per and recycle leaves, wood products, trees, concrete waste sheet rock and Food and Garden waste. The plan indicates Timber Creek, the plans obtain food and garden waste from Republic Services at a rate of 7 trucks loads per day. Assuming republic uses a small garbage, truck which holds approximately seven (7) tons the plan indicates 49 tons per day. On weekly basis that is 294 tons of garbage or about at, 176 tons or 2,352,000 pounds per month According to the Meridian City Attorney's office, at the present time, the City of Meridian has no ordnance or regulations covering a recycling operation. Given the size of the proposed operation it seems logical that the City would or want to have the proper rules and regulations in place prior to allowing approval this amendment. As for planed leaching ponds, are regulated by the State of Idaho DEQ. There have been no requests by Timber Creek. I understand that recycling and composting are soft words, but this is a large operation and is not a back yard composting operation. As for our opposition, ask your self or Your family would you like to have your home next to a large garbage operation. I am sure most of the committee has not been to the recycling site. In Addition to the parties listed Mr. Murgoito and his sister also attended. Please read the attached and you will find that other than Mr. Murgoito, not one of the attendees was in favor of the amendment! Mr Murgoitio final word on the amendment was a threat " if he is not allowed to expand his development agreement then he will put in a feed lot!". I think the City of Meridian should remember that it was Murgoitio that requested the city annex this area zone it for low density housing. By review of dates it appears that that was never the plan, and I will bet that his ability create a waste recycling business was not getting approved by Ada County. Then he went to an eager group City of Meridian and proposed additional housing for approval. It looks like the Planing and Zoning committee got played! There is also a lot of confusion as to when the city meeting will be held. I have received 3 post card notices each with different information, dates and areas being included. In addition I have received a letter dated June 7, 2018 which states the application will be scheduled and heard at the July 17, 2018 meeting this letter was signed by C Jay Coles, City Clerk. I received a Post Card mailed June 14, 2018 stating that its scheduled for June 19,2018. Please use this email to forward information to our group of concerned neighbors. The following is a summary of the issue and the related concerns. This does not contain every relevant point, but will provide an informative overview. Summary of the Application H-2018-0042 by Mike Murgoitio for Timber Creek Recycling Mike Murgoitio is the owner/operator of Timber Creek Recycling and the third generation of the Murgoitio farmers who farm approximately 800 acres in this valley. Timber Creek Recycling has submitted application to increase the current recycling business that currently operates on the corner of Columbia and Locust Grove. The property described in the application borders Columbia (beginning 1/2 mile east of meridian road) to Locust Grove, north on Locust Grove to Lake Hazel, then 1/2 mile west on Lake Hazel. This property is zoned "114" which is "medium low density housing." The application is for approval to be granted an exception to the zoning and approval to run a large-scale commercial composting facility. The items that they would receive are: wood products (anything wood - tree limbs, pallets, construction wood, etc.), grass, leaves, food waste (which would be city wide curbside collection by BFI), garden waste, bio waste (from sewage plants), sheetrock, demolition debris and "other aterials.- According to Mr. mHe has also stated that the concrete,o, he has amended his application to remove the bio waste (demolition debris) "is out." TCR shreds/grinds the wood products and then uses them for bedding for their own feed lot and sells it to another company which bags it for commercial sale to businesses such as Lowes. The wood products are also mixed with other various composting materials and held to accomplish an aging process - compositing. The composting material is currently used on the Murgoitio property in a new method of farming called "No Tilt". The issue that most, if not all, residences around this property is that TCR appears to be a commercial, if not industrial, business that is being pursued in a residential zone. While Mr. Murgoitio labels the operation as agricultural, the application requests the "expansion of the existing recycling business to allow commercial composting_" The grinding process produces excessive dust that blows out to the nearby residences, the equipment produces noise on an industrial level, and truck traffic has increased and would continue to increase on Columbia, Locust Grove and Lake Hazel. In addition, accumulation of biodegradable materials stink (to put is simply). That was evident this last year with the foul odor of the onions that were accepted. In fact, the odor of such materials is the evidence that harmful gasses are being produced by the rotting materials and are being emitted into the ground and air. In fact, under certain circumstances there are significant safety hazards such as explosive gasses, toxic fumes and groundwater contamination potential. Mr. Murgoiti&s assertion is that his composting facility will not stink. He states that at his increased level of operation he will fall within the prevue of DEQ which will allow TCR to mix and turn the composting material in a manner that will prevent odors. While the DEQwill have some oversight authority, there is currently no penalty or method to enforce their guidelines. if this business is allowed to move forward, and the result of the operation is detrimental to the quality of life in this area, property owners will have little if any recourse. Thus, on top of the noise, dust, odor and traffic, property values will drop in proportion to the offensiveness of the TCR operation. The verbiage in the application includes phrases such as "other, materials in the same category," "other heavy equipment," "included but not limited to, owner/developer will process and utilize any additional recyclable materials," "other equipment necessary," "said activities include, but are not limited to," and regarding the TCR to umber of saticks sfy its allowed in and out of the facility - "the number reasonably necessary contracts and obligations." These open allowances remove limits and fail to provide any boundaries to the volume of the operation. While Mr. Murgoitio seems to be willing to work with the surrounding neighbors on some level, there is no method of enforcing any accommodation or compromise that might be agreed upon. In addition, the agreementwith the city would be tied to L&G Murgoitio, LLC at 6575 S. Locust Grove Rd. Therefore, should the business be sold or managed by someone other than Mike Murgoitio, any agreement made between him and the neighbors could become irrelevant. Typically, dumps, meat -packing plants, airports, prisons and other such specialty operations are not planned or permitted in currently populated residential areas. Timber Greek Recycling falls into this category and should not be permitted to operate, let alone expand, at the proposed location. There also remains some questions in regard to a conflict-of-interest on the part of the city of Meridian in regard to the method in which TGR was given an exception for the current operation to function within the R4 zone, and in regard to the future expanded contractual relationship between the two parties for recycling materials.
