DEFINITIONS
Words used in multiple sections of this document are defined below and other words are defined in Sections 3,
10, 12, 17, 19 and 21. Certain rules regarding the usage of words used in this document are also provided in
Section 15.
(A) "Security Instrument" means this document, which is dated October 19, 2015 , together with
all Riders to this document.
(B) "Borrower"is Annie L. Chandler and Devin P. Chandler, wife and husband
Borrower is the trustor under this Security Instrument.

(D) "Trustee"is First American Title
(E) "MERS" is Mortgage Electronic Registration Systems, Inc. MERS is a separate corporation that is acting
solely as a nominee for Lender and Lender's successors and assigns. MERS is the beneficiary under
this Security Instrument. MERS is organized and existing under the laws of Delaware, and has an
address and telephone number of P.O. Box 2026, Flint, MI 48501-2026, tel. (888) 679-MERS.
(F) "Note"means the promissory note signed by Borrower and dated October 19, 2015 The Note
states that Borrower owes Lender One Hundred Twenty Six Thousand One Hundred
Seventy and 00/100
Dollars (U.S. $ 126.170.00 ) plus interest. Borrower has promised to pay this debt in regular
Periodic Payments and to pay the debt in full not later than November 1, 2045 .
(G) "Property"means the property that is described below under the heading "Transfer of Rights in the
Property."
(II) "Loan" means the debt evidenced by the Note, plus interest, and late charges due under the Note, and all
sums due under this Security Instrument, plus interest.
(I) "Riders" means all Riders to this Security Instrument that are executed by Borrower. The following
Riders are to be executed by Borrower [check box as applicable]:

(J) "Applicable Law" means all controlling applicable federal, state and local statutes, regulations,
ordinances and administrative rules and orders (that have the effect of law) as well as all applicable final,
non -appealable judicial opinions.
(Iq "Community Association Dues, Fees, and Assessments" means all dues, fees, assessments and other
charges that are imposed on Borrower or the Property by a condominium association, homeowners
association or similar organization.
(L) "ElectronieFunds Transfer" means any transfer of funds, other than a transaction originated by check,
draft, or similar paper instrument, which is initiated through an electronic terminal, telephonic
instrument, computer, or magnetic tape so as to order, instruct, or authorize a financial institution to
debit or credit an account. Such term includes, but is not limited to, point-of-sale transfers, automated
teller machine transactions, transfers initiated by telephone, wire transfers, and automated clearinghouse
transfers.
(NJ) "Escrow Items" means those items that are described in Section 3.
(N) "NscelianeousProceeds" means any compensation, settlement, award of damages, or proceeds paid by
any third party (other than insurance proceeds paid under the coverages described in Section 5) for: (i)
damage to, or destruction of, the Property; (ii) condemnation or other taking of all or any part of the
Property; (iii) conveyance in lieu of condemnation; or (iv) misrepresentations of, or omissions as to, the
value and/or condition of the Property.

(0) "Mortgage Insurance" means insurance protecting Lender against the nonpayment of, or default on, the
Loan.
(P) "Periodic Payment" means the regularly scheduled amount due for (i) principal and interest under the
Note, plus (ii) any amounts under Section 3 of this Security Instrument.
(Q) "RESPA" means the Real Estate Settlement Procedures Act (12 U.S.C. Section 2601 et seq.) and its
implementing regulation, Regulation X (12 C.F.R. Part 1024), as they might be amended from time to
time, or any additional or successor legislation or regulation that governs the same subject matter. As
used in this Security Instrument, "RESPA" refers to all requirements and restrictions that are imposed in
regard to a "federally related mortgage loan" even if the Loan does not qualify as a "federally related
mortgage loan" under RESPA.
(R) "Secretary"means the Secretary of the United States Department of Housing and Urban Development or
his designee.
(S) "Successorin Interest of Borrower" means any party that has taken title to the Property, whether or not
that party has assumed Borrower's obligations under the Note and/or this Security Instrument.
TRANSFER OF RIGHTS IN THE PROPERTY
The beneficiary of this Security Instrument is MERS (solely as nominee for Lender and Lender's successors
and assigns) and the successors and assigns of MERS. This Security Instrument secures to Lender; (i) the
repayment of the Loan, and all renewals, extensions and modifications of the Note; and (ii) the performance
of Borrower's covenants and agreements under this Security Instrument and the Note. For this purpose,
Borrower irrevocably grants and conveys to Trustee, in trust, with power of sale, the following described
property located in the

STANDARDS FOR HOME OCCUPATION ACCESSORY USE
STATEMENT OF COMPLIANCE
UDC 11-4-3.21: Home Occupation Accessory Use: In addition to the noticing requirements set forth in subsections
11 -2A -2A, the following standards apply to all home occupation accessory uses with the exception that strict
adherence to the standards contained in subsections E, F, G and H of this section in the TN -C and TN -R Districts is
not required:
A. The home occupation accessory use shall only be allowed as an incidental, secondary use to an allowed
residential use. The operator of the home occupation accessory use shall be responsible for obtaining an
accessory use permit, as well as any and all other applicable licenses, permits, or inspections, prior to
operating the home occupation accessory use. Where a home occupation accessory use includes the
provision of lessons or instruction to a group of seven (7) or more students at one time, prior to submittal of
an application for an accessory use permit, the applicant shall hold a neighborhood meeting in accord with
subsection 11-5A413 of this title.
B. Allowed home occupation accessory uses include, but are not limited to:
1. Personal and professional services.
2. Direct sales.
3. Artisan craft production or instruction.
4. Art, dance, music, or other lessons/instruction.
5. Any other similar use, as determined by the Director.
C. Prohibited home occupation accessory uses include, but are not limited to:
1. Vehicle repair.
2. Vehicle rental.
3. Vehicle washing.
4. Equipment repair.
5. Equipment rental.
6. Retail sales, except:
a. The sale of services or items produced or fabricated on the premises as a result of the home
occupation accessory use;
b. The sale of products secondarily related to the personal service aspect of the home occupation
accessory use; or
c. The sale of products sold online that are delivered to customers by mail.
7. Any other use prohibited by the UDC or in violation of the purpose statement of this code, as
determined by the Director.
D. In no way shall the home occupation accessory use emit lighting, noise, fumes, smoke, dust, odors,
vibrations, or electrical interference that can be observed outside the dwelling. A sign may be displayed at
the dwelling for advertising the home occupation accessory use in accord with the standards set forth in
UDC 11 -3D -8B.
E. The home occupation accessory use shall be conducted entirely in the dwelling, and not more than ten
percent (101/o) of the overall area of said dwelling shall be used for a home occupation accessory use or for
storing goods associated with the home occupation accessory use. An attached garage shall be included in
the calculation of the area of the dwelling for this purpose.
F. No activity connected to the home occupation accessory use or any storage of goods, materials, or products
connected with a home occupation accessory use shall be allowed in any detached garage or detached
accessory structure.

G. The home occupation accessory use shall not have more than two (2) outgoing pick-ups per day from a
common carrier.
H. The home occupation accessory use shall be conducted by the inhabitants of the dwelling, and no more
than one nonresident employee shall be permitted at any time.
I. The home occupation accessory use shall not serve as a headquarters or main office where employees conic
to the site and are dispatched to other locations.
Off-street parking shall be provided as Section 11-3C-6 of this Title, in addition to the required off-street
parking for the dwelling.
K. All visits by clients, customers, and/or employees shall occur between the hours of 8:00 a.m. and 8:00 p.m.

Home Occupation Accessory Use
Chandler Tree Service LLC
We will not have any customers coming to us at this property. We are a tree service that
goes to our customers home to complete the work that we are hired to do. We currently
have 2 contractors that help us complete the work as needed. We use our RV parking in
the backyard on the side of our garage to store our Isuzu NPR truck & chipper. It is
enclosed behind a gated fence. We have a 3 car garage, but don't park work trucks/
trailers in it. They would not be able to fit because the garage is too short & there isn't
enough room. Part of our 3rd bay in our garage is used to store equipment such as chain
saws, climbing gear, ropes, rakes, tools etc. Approximately 65 square feet is used for that
purpose. Hours of operation are Monday- Friday 8am-5pm.
