The Applicant, Director, or a Party of Record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division of the Community Development Department within fifteen (15) days after the written decision is issued, and include the information listed in UDC 11 -5A -7B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. The property owner has the right to request a regulatory taking analysis under Idaho Code 67- 8003. Such request must be in writing, and must be filed with the City Cleric not more than twenty-eight (28) days after the final decision concerning the matter at issue. APPLICATION SUMMARY The applicant, Matt Schultz, requests approval of a one (1) year time extension in order to obtain the City Engineer's signature on the final plat for the second phase of Normandy Subdivision (H-2016- 0084). The plat consists of 33 building lots and 4 common area lots on 6.77 acres of land in the R-8 zoning district. The Applicant states that due to fall and winter delays last year they were unable to obtain the City Engineer's signature by the March 23, 2018 deadline, thus the reason for the request. H. STAFF RECOMMENDATION Staff recommends approval of a one (1) year time extension as requested in order to obtain the City Engineer's signature on the second phase final plat for Normandy Subdivision to expire on March 23, 2019. Once signature is obtained on the second phase final plat, the applicant has two years from that date to obtain signature on the third phase of development. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is located at 4145 S. Locust Grove Rd., in the SE'/a of Section 30, T. 3N., R. 1E. B. Owner: Challenger Development, Inc. 1977 E. Overland Rd. Meridian, ID 83642 C. Applicant: Matt Schultz, Schultz Development PO Box 1115 Meridian, ID 83642 D. Representative: Same as Applicant E. Applicant's Statement/Justification: Please see applicant's narrative for this information. IV. HISTORY OF PREVIOUS ACTIONS • In 2007, this property was annexed and zoned (AZ -06-064) R-8 for the development of single- family residential homes. A development agreement was not required as a provision of Normandy Subdivision No. 2 — TED A-2018-0017 PAGE 1 annexation. A preliminary plat (PP -06-065) was also approved for 109 single-family residential building lots and 7 common lots. A couple of time extensions (TE -09-004; TE -10-025) for the preliminary plat were approved but the plat later expired. • In 2015, a new preliminary plat (PP -15-008) was approved consisting of 110 building lots and 9 common lots on 26.93 acres of land in the R-8 district. • In 2015, a final plat (FP -15-032) was approved for Phase 1 that consisted of 44 building lots and 7 common lots on 11.03 acres of land in the R-8 district. The City Engineer signed the plat on March 23, 2016. • In 2016, final plats were approved for Phases 2 (H-2016-0084) and 3 (H-2016-0085) consisting of 33 building lots and 4 common area lots on 6.77 acres of land; and 33 building lots and 5 common area lots on 8.87 acres of land, respectively, in the R-8 zoning district. V. UNIFIED DEVELOPMENT CODE Per UDC 11-613-7, approval of a preliminary plat shall become null and void if the applicant fails to obtain the City Engineer's signature on a final plat within two years of the approval of the preliminary plat. In the event that the development of the preliminary plat is made in successive phases in an orderly and reasonable manner, and conforms substantially to the approved preliminary plat, such segments, if signed by the City Engineer within successive intervals of two years, may be considered for final approval without resubmission for preliminary plat approval. Upon written request and filing by the applicant prior to the termination of the allowed time period, the Director may authorize a single extension of time to obtain the City Engineer's signature on the final plat not to exceed 2 years. Additional time extensions up to 2 years as determined and approved by the City Council may be granted. With all extensions, the Director or City Council may require the plat to comply with current provisions of the UDC. VI. STAFF ANALYSIS This is the first time extension requested on the subject final plat. Approval of the subject time extension will allow the applicant to proceed with the platting process for the second phase of development. If the subject time extension is not granted, the final plat will expire and a new final plat application will be required. Since the preliminary plat for this project was approved, there have not been any code changes that would necessitate new conditions being placed on this approval. Therefore, staff recommends approval of the applicant's request without any new conditions of approval; the applicant is still required to comply with all previous conditions of approval for this project and the provisions of the development agreement.
