The Applicant, Director, or a Party of Record may request City Council review of a decision of the Director. All requests for review shall be filed in writing with the Planning Division of the Community Development Department within fifteen (15) days after the written decision is issued, and include the information listed in UDC 1 I -5A -7B. If City Council review of the decision is not requested, the action of the Director represents a final decision on a land use application. The property owner has the right to request a regulatory taking analysis under Idaho Code 67- 8003. Such request must be in writing, and must be filed with the City Clerk not more than twenty-eight (28) days after the final decision concerning the matter at issue. APPLICATION SUMMARY E IDIAN The applicant, Trilogy Development, Inc., requests approval of a two (2) year time extension in order to obtain the City Engineer's signature on the first phase final plat for Edgehill Subdivision (H-2015- 0005). The preliminary plat consists of 116 building lots and 7 common lots on 40.19 acres of land in the R-4 zoning district. The Applicant states that the delay in obtaining the City Engineer's signature on the first phase final plat is due to waiting for development in the area to bring public utilities (i.e. water and sewer service) closer to the site. II. STAFF RECOMMENDATION Staff recommends approval of a two (2) year time extension as requested in order to obtain the City Engineer's signature on the final plat for the first phase Edgehill Subdivision to expire on March 8, 2020. III. APPLICATION AND PROPERTY FACTS A. Site Address/Location: The subject property is located at the southeast corner of S. Linder Road and W. Victory Road at 1393 and 1405 W. Victory Road, in the NW i/4 of Section 25, Township 3 North, Range 1 West. (Parcel No.'s: S 1225223205 & S 1225223185) B. Owner: Corey Barton 1977 E. Overland Rd. Meridian, ID 83642 C. HISTORY OF PREVIOUS ACTIONS On March 8, 2016, this property was annexed with an R-4 zoning district and a preliminary plat was approved consisting of 116 building lots and 7 common lots on 40.19 acres of land for Edgehill Subdivision. V. UNIFIED DEVELOPMENT CODE Per UDC 11-613-7, approval of a preliminary plat shall become null and void if the applicant fails to obtain the City Engineer's signature on a final plat within two years of the approval of the preliminary plat. In the event that the development of the preliminary plat is made in successive phases in an orderly and reasonable manner, and conforms substantially to the approved preliminary plat, such segments, if signed by the City Engineer within successive intervals of two years, may be considered for final approval without resubmission for preliminary plat approval. Upon written request and filing by the applicant prior to the termination of the allowed time period, the Director may authorize a single extension of time to obtain the City Engineer's signature on the final plat not to exceed 2 years. Additional time extensions up to 2 years as determined and approved by the City Council may be granted. With all extensions, the Director or City Council may require the plat to comply with current provisions of the UDC. VI. STAFF ANALYSIS This is the first time extension requested on the subject preliminary plat. Approval of the subject time extension will allow the applicant to proceed with the platting process for the first phase of development. If the subject time extension is not granted, the preliminary plat will expire and a new preliminary plat application will be required. Since the preliminary plat for this project was approved, there have not been any code changes that would necessitate new conditions being placed on this approval. Therefore, staff recommends approval of the applicant's request without any new conditions of approval; the applicant is still required to comply with all previous conditions of approval for this project and the provisions of the development agreement.
