Request for a Conditional Use Permit for a new 3-story, 100 room hotel in an I-L
zone for Country Inn and Suites Hotels (File No. CUP-O4-050).
We have reviewed this submittal and offer the following comments, as conditions of the applicant.
These conditions shall be considered in full, unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY
On behalf of ABC 2 LLC, the applicant, Boise Hotel Enterprises LLC, has requested approval of a
conditional use permit (CUP) for a new 3-story, 100 room hotel. The proposed hotel is located on a
portion of Parcel 2, Block I of Presidential Subdivision. An application to re-subdivide Parcel 2,
Presidential Subdivision into an 8 lot commercial subdivision ca1led Reagan Subdivision was recently
approved by the Meridian City Council, but the plat has not been recorded as of the date of this
report,
Development of the subject property is governed in part by an existing Development Agreement
(DA) and Planned Unit Development that a1lows, among other uses, commercial and hotel uses in
the I-L zone. Said DA was entered into when the property was annexed by Upland Industries in
the late 1980's, In addition, the property now platted as Presidential Subdivision was approved as
Phase 3 of "The Family Center/Meridian Crossroads" CUP application in 1999, which approved
commercial uses in this area. The origina1 planned unit development requires the issuance of a
new Conditional Use Permit for any subsequent uses of the property.
Staff cannot make a recommendation for approval or denial at this time due to the potential for
impact on the surrounding properties and anticipated public testimony regarding these impacts,
The Commission and Council should rely upon public testimony to determine ¡fthe development

will adversely affect the other property in the vicinity.
LOCATION & SURROUNDING USES
The subject property is located near the intersection of East Pine Avenue and Eagle Road, in the
Presidential Subdivision. The following uses surround the subject property:
Nortb - Crossroads Shopping Center, zoned I-L.
South - E. Pine Ave, and vacant lot, zoned I-L.
East - Crossroads Subdivision, zoned R-4.
West - Eagle Road and professional offices, zoned I-L.
OWNER OF RECORD
The owner of record is ABC 2 LLC, and they have given their consent for the applicant to submit the
requested conditional use permit.
STANDARDS FOR CONDmONAL USES
Tbe Commission and Council shall review the particular facts and circumstances of each
proposed conditional use in terms of the foUowing, and may approve a conditional use permit
iftbey shall find evidence presented at the bearing(s) is adequate to establish (11-17-3):
A.
Tbat the site is large enough to accommodate the proposed use and all yards, open
spaces, parking, landscaping and other features as may be required by this ordinance;

The submitted plan depicts 106 on-site parking sta\ls. MCC 11-13-5(B)(1) requires hotels to
provide parking at the rate of one space per room plus 1 for each 2 employees. The proposed
hotel (100 rooms) requires 100 parking spaces, plus an additional 1 for each 2 employees. As
proposed, the site plan depicts sufficient parking for 12 employees, The applicant has not
specified how many employees the hotel will have, and must provide additional parking if
there will be more than 12 employees. Staff requests tbatapplicant address tbeadequacy
of employee parking at the public bearing.
LandscaDing:
The applicant has proposed perimeter parking landscaping, street buffers and land use buffers
where required by the Meridian Landscape Ordinance.
Staff finds that the subject property, as depicted, is large enough to accommodate the
required open spaces, parking, landscaping and other features required by the ordinance,

B.
That the proposed use and development plan will be harmonious with the Meridian
Comprehensive Plan and in accordance with the requirements of this Ordinance;
The Comprehensive Plan Future Land Use Map designates the property as "Commercial" and
it is currently zoned I-L. Commercial allows for "a full range of commercial and retail to
serve area residents and visitors. Uses may include retail, wholesale, service and office uses,
multi-family residential, as well as appropriate public uses such as government offices," (see
Comprehensive Plan, p, 99), While the Future Land Use Map supports the commercial use of
the property, the Comprehensive Plan also requires that we should "require screening and
buffering of commercial and industrial properties and residential use with transitional zoning"
in order to encourage compatible uses and minimize conflicts (see Comprehensive Plan, p.
105, Objective A). The Comprehensive Plan also requires that we "locate new community
commercial areas on arterials or collectors in such a way as to complement with adjoining
residential areas (see Comprehensive Plan, p. 102, Objective B),

Staff finds that the requested uses are in compliance with the approved Future Land Use Map
and that if approved as a CUP the project will be in compliance with the MCC and
Development Agreement.

That the design, construction, operation, and maintenance will be compatible with
other uses in the general neighborhood and with the existing or intended character of
the general vicinity and that such use will not adversely change the essential character
ofthe same area;
The abutting properties to the north, south, and west are a\1 zoned I-L and are intended for
development of a similar nature. The property to the east is the platted Crossroads
Subdivision, which is zoned R-4 and contains single family residential units.
The Comprehensive Plan shows that the future intended land use ofthe area is Commercial.

Therefore, staff finds that the proposed development will not adversely change the existing or
intended character of the general vicinity. Please see item D for comments regarding the
impact to other property in the area.
D.
That the proposed use, if it complies with aD conditions of the approval imposed, will
not adversely affect other property in the vicinity;
Staff has concerns about the construction of a 3-story hotel directly adjacent to the property
line abutting the residential neighborhood. Crossroads Subdivision lies directly to the east of
the subject property and is zoned R-4 (Low Density Residential), with typical setbacks of 15
to 30 feet in the rear of the lots adjacent to this development. The visual impact and intrusion
ftom the proposed hotel could be further minimized by moving its location closer to
Presidential Drive, and placing the required parking behind the structure, This move would
place the impacts associated with parking lot usage closer to the residences, but would
decrease the visual impact and perceived invasion of privacy associated with having a 3 -story
structure within approximately 75 feet of the residences. There is an existing 20-foot buffer
and fence along the property line that may help reduce impacts ftom the development.
Therefore, staff finds that the use, in the configuration proposed, may adversely affect
adjacent properties. The Commission and Council should rely upon public testimony to
determine if the development will adversely affect the other property in the vicinity,
E.
That the proposed use will be served adequately by essential public facilities and
services such as highways, street, police, and fire protection, drainage structures, refuse
disposal, water, sewer or that the person responsible for the establishment of proposed
conditional use shaD be able to provide adequately any such services;
The project has vehicular access ftom Pine via two previously approved full access driveways,
one 340-feet east of Eagle Road and one 620-feet east of Eagle Road. Please see ACHD
report for specific comments regarding street issues, Water and sanitary sewer service to the
project is readily available to the site via extensions ftom mains which are part ofthe recently
approved Reagan Subdivision improvements, The Commission and Council should consider
the Meridian Police, Parks, and Fire Departments' comments with regard to their capability to
serve the proposed development.
F.
That the proposed use will not create excessive additional requirements at public cost
for public facilities and services and will not be detrimental to the economic welfare of
the community;

If approved, the developer will finance the extension of sewer, water, utilities and pressurized
irrigation to serve the project. The primary public costs to serve the future residents will be
fire and police services, Staff finds there will not be excessive. additional requirements at
public cost and that the proposed use will not be detrimental to the community's economic
welfare.
G.
That the proposed use will not involve activities or processes, materials, equipment. and
conditions of operation that will be detrimental to any persons, property, or general
welfare by reason of excessive production oftraffic, noise. smoke, fumes, g1are or odors;
Staff finds that no excessive traffic, smoke, fumes, glare or odors will result from the
proposed use,
H.
That the proposed use will have vehicular approaches to the property which shall be so
designed as not to create an interference with traffic on surrounding public streets;
All vehicular approaches have been previously approved by ACHD, Staff finds that the
proposed use will not create significant interference with traffic on the surrounding public
streets. Please refer to ACHD comments for additional detail on this issue.
I.
That the proposed use will not result in the destruction, loss or damage of a natural,
scenic or historic feature considered to be of major importance.
Staff finds that no natural or scenic feature will be lost, damaged or destroyed by issuance of
this conditional use, Staffhas not identified any natura1 or scenic features on the site.
SPECIAL CONSIDERATIONS
1. Landscaping: The following addition is needed on the landscape plan to comply with
ordinance. See P&Z Condition #3.
. The 13 contiguous parking spaces on the northwestern comer of the project are
not allowed. MCC 12-13-11-3(C) requires that "no linear grouping of parking
spaces sha1l exceed twelve (12) in a row, without an internal planter island." One
parking space must be eliminated to comply with MCC 12-13-11-3,

in 1991 and all applicable conditions of approval from Presidential Subdivision (pFP-OI-002).
The following addition to the landscape plan is required:
. Eliminate one parking space in the row of 13 spaces in the northwestern corner of
the project.
GENERAL CONDfiaONS OF APPROVAL
1.
This conditional use permit shall be subject to the expiration provisions set forth in MCC 11-
17-4.B.
2,
All parking stalls, drive aisles and drive-thru lanes shall be constructed per the dimensions
depicted on the submitted site plans and MCC.
3.
All parking and drive aisles shall be paved for all uses, in compliance with the submitted plans.
Handicap parking spaces sha11 be signed and striped in compliance with Federal accessibility
guidelines,
4.
Sanitary sewer and water service shall be from service lines currently installed adjacent to the
property.
5.
All exterior lighting, whether attached to the building or located within the parking lot, shall
be down-shielded or otherwise altered so that the light does not spill over onto adjacent
properties or right-of-way. All parking lot lighting shall be in accordance with Ordinance 11-
13-4C.
6.
All signage sha11 be in accordance with the standards set forth in this report and Section 11-14
of the City Zoning and Development Ordinance. All signage is subject to review and shall
require separate permits,
7,
All construction and site improvements shall conform to the requirements of the Americans
with Disabilities Act and the adopted building and fire codes.
8.
A drainage plan designed by a State of Idaho licensed architect or engineer is required and
shall be submitted to the City Engineer (Ord, 557, 10-1-91) for all off-street parking areas,
Storm water treatment and disposal must be designed in accordance with Department of
Environmental Quality 1997 publication Catalog of Storm Water Best Management Practices
for Idaho Cities and Counties and City of Meridian standards and policies. Off-site disposal
into surface water is prohibited unless the jurisdiction which has authority over the receiving

stream provides written authorization prior to development plan approval. The applicant is
responsible for filing all necessary applications with the Idaho Department of Water
Resources regarding Shallow Injection Wells.
Any drainage areas (detention/retention basins) must be designed to ensure that water will
percolate or discharge within a period of time not to exceed 24 hours for all storms up to and
including a 100-year storm event.
10.
Certificate of Occupancy: All required improvements must be complete prior to obtaining a
Certificate of Occupancy for the proposed development. A temporary Certificate of
Occupancy may be obtained by providing surety to the City in the form of a letter of credit or
cash in the amount of 110% of the cost of the required improvements (including paving,
striping, landscaping, and irrigation). A bid must accompany any request for temporary
occupancy.
FIRE DEPARTMENT
1. Operational fire hydrants and temporary or permanent street signs are required before combustible
construction begins,

Acceptance of the water supply for fire protection will be by the Meridian Water Department.
3.
Final Approval of the fire hydrant locations shall be by the Meridian Fire
Department.

b. The Fire hydrant sha1l not face a street which does not have addresses on it.
c, Fire hydrant markers shall be provided per Public Works spec,

Fire lanes and streets sha1l have a vertical clearance of 13'6". This includes mature
landscaping.

Commercial and office occupancies will require a fire-flow consistent with the International
Fire Code to service the proposed project. Fire hydrants sha1l be placed an average of300'
apart.

The xx officelcommercia\lots lot will have an unknown transient population and will have an
unknown impact on Meridian Fire Department call volumes. The Meridian Fire Department has
experienced 2397 responses in the year 2003. According to a report completed by Fire &
Emergency Services Consulting Group our requests for service are projected to reach 2800 in the
year 2005 and 3800 by the year 2010,
10.
Maintain a separation of5' ftom the building to the dumpster enclosure.
11.
Provide a Knoxbox entry system for the complex.
12,
The first digit of the Apartment/Office Suite shall correspond to the floor level.
13,
Fire Sprinklers will be required for all buildings associated with this project.
14.
Provide exterior egress lighting as required by the International Building & Fire Codes.

submit stamped (approved) plans with your certificate of zoning compliance application.
PARKS DEPARTMENT
1. Standard Plan for Protection ofExisting Trees during Construction: The standard established
in the City of Meridian Landscape Ordinance (MCC 12-13-13) will be followed,

retained on site. If any municipal surface drainage leaves the site, the Nampa & Meridian
Irrigation District must review drainage plans. The developer must comply with Idaho
Code 31-3805. It is reconunended that irrigation water be made available to all
developments within the Nampa & Meridian Irrigation District.

Enclosed please find a Land Use Change Application for your use to file with the Irrigation
District for its review on the above-referenced development. If this development is under a
"rush" to be finalized, I would recommend that you submit a cashier's check, money order or
cash as payment of the fees in order to speed the process up. If you submit a company or
personal check, it must clear the bank before processing the application.
Should this development be planning a pressure urban irrigation system that will be owned,
operated and maintained by the Irrigation District, I strongly urge you to coordinate with John P.
Anderson, Water Superintendent for the Irrigation District, concerning the installation of the
pressure system. Enclosed is a questionnaire that you must fill out and return in order to initiate
the process of contractual agreements between the owner or developer and the Irrigation
District for the ownership, operation and maintenance of the pressure urban irrigation system.
If you have any questions concerning this matter, please feel free to call on me at the District's
office, or John P. Anderson, at the District's shop.

This letter is written in support of the hotel proposal Qevelopment by Boise Hotel
Enterprises, LLC & ABC 2, LLC for a conditional use pem¡it for approval of a 3-story,
100 room hotel at north East Pine Avenue and east of North Eagle Road. This
development would be adjacent to an existing Ram Restaurant and Farmers Trust Bank.
The hotel would be a good fit as well as fill a need for lodging in the area. It would seem
this type of development would also create less per day 1raffic therefore minimizing
traffic. Thank you for your consideration.
