RE: H-2018-0024 MI TRILOGY SUBDIVISION NO 1 EXTENSION
The Idaho Transportation Department (ITD) has reviewed the referenced application by Challenger Development
requesting a City Council review for the purpose of extending the expired plat to allow a 6 month extension to obtain
City Engineer’s signature for Trilogy Subdivision No. 1 final plat located on the southeast corner of US-20/26
(Chinden Boulevard) and North Black Cat Road, south of US-20/26 milepost 45.66. ITD has the following comments:
1. This project abuts the State highway system.
2. The ACHD Staff report dated September 20, 2008 identified improvements to include a northbound left
turn bay and northbound right turn bay on Black Cat Road at the intersection of US-20 and Black Cat Road
that were never constructed. ITD respectfully requests that construction of these improvements be included
as a condition of the extension of the plat.
3. Application H-2016-0062 indicates eliminating the current permitted 24 foot field approach. The
applicant will need to submit an application to vacate this access. Any change in use of this
access will require an application for an ITD permit. Applicant must apply for and receive an
approved ITD Right-of-Way use permit prior to doing any work or activity within the highway
right-of-way. The applicant may contact Shona Tonkin at 208-334-8341 for more information.
4. ITD’s corridor plan for this area of US-20/26 requires 100-ft of right-of-way as measured from
the section line in US-20/26. A typical section is shown below. This area includes 86 feet for the
construction of the future widening of the roadway and drainage and 14 feet for the construction
of the future pathway and utilities. If the City requires berms or other improvements, they should
be constructed outside of the 100 feet of right-of-way. ITD reminds the City that keeping costs
down within this corridor will help with future construction of US-20/26.
5. No trees are allowed within the clear zone of the ITD Right-of-Way. Only planting of forage, plants, grasses,
flowers, and shrubs with a mature height not to exceed 3 feet will be allowed.
6. No rocks over 4 inches maximum size will be allowed in the ITD Right-of-Way.
7. Irrigation systems shall be no closer than 5 feet from the pavement edge and shall be adjusted so as not to
cause water to cover any portion of the highway pavement.
8. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.
9. IDAPA 39.03.60 governs advertising along the State highway system. The applicant may contact Justin

10. ITD objects to the 6 month extension to obtain City Engineer’s signature for Trilogy Subdivision No. 1 final
plat due to traffic /access concerns. ITD will withdraw any objection to the proposed application once all
traffic /access concerns have been addressed with ITD Staff.
