HomeMy WebLinkAboutCC - Staff Memorandum April 20, 2018 MEMORANDUM TO: Mayor and City Council FROM: Bill Parsons, Planning Supervisor CC: Bill Nary, City Clerk, Kent Brown RE: Trilogy Subdivision (H-2018-0024) Honorable Mayor and City Council, In 2015, the City approved the Trilogy Subdivision. The plat consisted of 144 buildable lots and 9 common lots on 28.16 acres of land, zoned R-8. In 2016, a first phase of the final plat was approved that consisted of 51 buildable lots and 5 common lots. As part of those approvals, the Developer was given two years to obtain City Engineer’s signature on a final plat (expiration date: 10/20/2017). Recently, it has come to our attention the plat has expired and a portion of this property was sold off to the Brighton Corporation which is slated to be part of the Bainbridge Subdivision. In February (after the expiration date), the City approved a performance surety to guarantee the completion of the improvements. Per the applicant, the construction of the subdivision has commenced, all underground utilities are 100% completed and curb, gutter and sidewalks and roadways are constructed. In the applicant’s narrative, he also states that the subdivision improvements are slated to be completed by April 2018. Because of the time that has elapsed, the applicant was able to apply for an administrative time extension in accord with the UDC. Both Planning and Legal agreed that the miscellaneous application was the only remedy for the applicant to pursue extension of the plat, predicated on Council’s action. Staff believes having the applicant start over is not in the best interest of the City (tied to a recorded development agreement) and respectfully request that the Council approve the request to extend the expiration date of the plat for an additional 6 months from the date of the miscellaneous hearing. Moving forward Staff is working with the IT Department to develop a plat tracking report through our Accela system to avoid these mishaps and inform our customers of their expiration dates.
