RE: H-2018-0011 2018 UDC TEXT AMENDMENT
The Idaho Transportation Department (ITD) has reviewed the referenced UDC Text Amendment
pertaining to standards for portable signs, daycare facility specific use standards, provisions to allow
multi-family private open space standards to be eligible for alternative compliance, and modifying the
subdivision street names standards to align with newly adopted codes. ITD has the following
comments:
1. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State Highway.
This section also prohibits advertising displays which include any illumination of such
brilliance and so positioned as to blind or dazzle the vision of travelers on adjacent interstate
and primary highways. Multiple message signs shall not include any illumination or image
which moves continuously, appears to be in motion or has any moving or animated parts or
video displays or broadcasts. No multiple message sign may include any illumination which is
flashing or moving, except those giving public service information such as date, time,
temperature, weather, or other similar information.
2. IDAPA 39.03.60 governs advertising along the State highway system. The applicant may

3. ITD does not object to the proposed changes to the UDC as described in this notice provide
they comply with both Idaho Code 40-1910 and IDAPA 39.03.60.
