This matter coming before the City Council for Final Plat approval pursuant to
Meridian City Code § 12-3-7 on November 3, 2004, and the Council finding that the Administrative
Review is complete trom Sonya Allen, Assistant City Planner for the Planning and Zoning
Department, and Bruce Freckleton, Development Services Manager for the Public Works
Department, dated: Hearing Date: November 3, 2004, to the Mayor and Council, and the Council
having considered the requirements of the preliminary plat the Council takes the following action:

is attached hereto marked Exhibit "A", and consisting of 2 pages, and by this

LLC, a true and correct copy of which is attached hereto marked Exhibit "B" and
consisting of 1 page, and by this reference incorporated herein, and the additional
requirements ITom the action ofthe Council taken at their November 3, 2004 meeting
as follows, to-wit:

Adopt the requirements of the Meridian Fire Department as
follows:
I. One and two family dwellings will require a fire-flow of 1,000
gallons per minute available for duration on hours to service the
entire project. Fire hydrants shall be placed an average of 400'
apart. International Fire Code Appendix D
2. Acceptance of the water supply for fire protection will be by the
Meridian Water Department.

3. Final Approval of the fire hydrant locations shall be by the
Meridian Fire Department.
a. Fire Hydrants shall have the 4 Yz" outlet face the main street
or parking lot aisle.
b. The Fire hydrant shall not face a street which does not have
addresses on it.
c. Fire hydrant markers shall be provided per Public Works
spec.
d. Locations with fire hydrants shall have the curb painted red
10' to each side of the hydrant location.
e. Fire Hydrants shall be placed on corners.
f. Fire hydrants shall not have any vertical obstructions to
outlets within 10'.
4. The phasing plan may require that any roadway greater than 150' in
length that is not provided with an outlet shall be required to have
an turn-around.
5. All entrance and intemal roads shall have a turning radius of28'
inside radius and 48'outside radius.
6. Operational fire hydrants and temporary or permanent street signs
are required before combustible construction begins.

The Applicant is hereby notified that pursuant to Idaho Code 67-8003, the Owner may
request a regulatory taking analysis. Such request must be in writing, and must be filed with the City
Clerk not more than twenty-eight (28) days after the final decision concerning the matter at issue. A
request for a regulatory takings analysis will toll the time period within which a Petition for Judicial
Review may be filed.
Please take notice that this is a final action of the governing body of the City of
Meridian, pursuant to Idaho Code § 67-6521. An affected person being a person who has an interest
in real property which may be adversely affected by this decision may, within twenty-eight (28) days
after the date ofthis decision and order, seek a judicial review as provided by Chapter 52, Title 67,
Idaho Code.

Acres in an R-4 Zone by Brighton Corporation (File No. FP-O4-059).
We have reviewed the above referenced submittals and offer the following comments as
conditions of approval. These conditions shall be considered in full, unless expressly
modified or deleted by motion of the Meridian City Council:
APPLICATION SUMMARY & LOCATION
The applicant, Brighton Corporation, has applied for Final Plat approval of 3 single-family
residential building lots on 0.45 acre ofland for Ashford Greens Subdivision No.7. This is a re-
subdivision of Lots 88, 89, 90, and 91, Block 23, of Ashford Greens Subdivision No.2. The
existing zoning designation for this subdivision is R-4 (Low Density Residential).
This phase of Ashford Greens Subdivision is located east ofN. Black Cat Road and north ofW.
Cherry Lane, in the SW \4 of Section 3, T.3N., R.l W.
The applicant filed for, and received approval on October 5, 2004, for their requested vacation of
the existing public utilities, drainage and irrigation easements on Lots 43-45, and Lots 88-91,
Block 23 of Ashford Greens Subdivision No.2.
The submitted final plat substantially complies with the approved preliminary plat. There is one
lot less on the final plat than was approved on the preliminary plat; however, staff has no
objection to this change.
Staff recommends approval of Ashford Green Subdivision No.7 with the comments and
conditions stated in this report.

SITE SPECIFIC COMMENTS 1 FINAL PLAT
1.
Applicant is to meet all terms of the approved Annexation, Preliminary Plat, and
Conditional Use Permit for this subdivision.
2.
Fencing must be in compliance with MCC 12-4-10.
3.
Label the "Real Point of Beginning" on the face of the plat.
4.
Revise or add the following notes on the face of the plat:

(4.) "Each side of interior lot lines and alon!! the northerlv side of Lot 3 and the
southerlv side of Lot 1. Block 32 shall have a five-foot..."

(Setbacks for Block 33) Delete the side yard setbacks that deal with corner lots since there
are none in this phase.

The applicant has indicated that the pressure irrigation system within this development is
existing. Service locations shall be adjusted to the new lot configuration.
5.
Sanitary sewer and water service to this site shall be via the existing mains adjacent to the
proposed subdivision. Applicant will be responsible to provide a plan to the Public
Works Department detailing the abandonment of, or installation of new sanitary sewer
and water services. Prior to signature on the final plat by the City Engineer, the applicant
shall either complete the construction detailed above, or post surety for 110% of the
construction costs.
6.
Applicant shall be required to pay Public Works development plan review, and
construction inspection fees, as determined during the plan review process, prior to
signature on the final plat per Resolution 02-374.
7.
Compaction test results must be submitted to the Meridian Building Department for all
building pads receiving engineered backfill, where footing would sit atop fill material.
8.
Staffs failure to cite specific ordinance provisions, or terms of the previous approvals for
this subdivision does not relieve the Applicant of responsibility for compliance.
STAFF RECOMMENDATION
Staff recommends approval of the final plat with the above stated comments and conditions.
