FP-04-060 ORDER OF CONDITIONAL APPROVAL OF FINAL PLAT This matter coming before the City Council for Final Plat approval pursuant to Meridian City Code § 12-3-7 on November 3, 2004, and the Council finding that the Administrative Review is complete from Sonya Allen, Assistant City Planner for the Planning and Zoning Department, and Bruce Freckleton, Development Services Manager for the Public Works Department, dated: Hearing Date: November 3, 2004, to the Mayor and Council, and the Council having considered the requirements of the preliminary plat the Council takes the following action: IT IS HEREBY ORDERED THAT: 1. The final plat upon which there is contained the Certification and signature of the City Clerk and the City Engineer verifYing that the plat meets the City's requirements shall be signed only at such time as: 1. The City Engineer has verified that all off-site improvements are completed and/or the appropriate letter of credit or cash has been issued guaranteeing the completion of off-site and required on-site improvements. NOTICE OF FINAL ACTION AND RIGHT TO REGULATORY TAKINGS ANALYSIS The Applicant is hereby notified that pursuant to Idaho Code 67-8003, the Owner may request a regulatory taking analysis. Such request must be in writing, and must be filed with the City Clerk not more than twenty-eight (28) days after the final decision concerning the matter at issue. A request for a regulatory takings analysis will toll the time period within which a Petition for Judicial Review may be filed. Please take notice that this is a final action of the governing body of the City of Meridian, pursuant to Idaho Code § 67-6521. An affected person being a person who has an interest in real property which may be adversely affected by this decision may, within twenty-eight (28) days after the date ofthis decision and order, seek ajudicial review as provided by Chapter 52, Title 67, Idaho Code. Bruce Freckleton, Development Services Manager~ Ashford Greens Subdivision No.8 From: Re: Final Plat approval of Two (2) Single-Family Residential Building Lots on 0.34 Acres in an R-4 Zone by Brighton Corporation (File No. FP-O4-060). We have reviewed the above referenced submittals and offer the following comments as conditions of approval. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY & LOCATION The applicant, Brighton Corporation, has applied for Final Plat approval of 2 single-family residential building lots on 0.34 acre ofland for Ashford Greens Subdivision No.8. This is a re- subdivision of Lots 43, 44, and 45, Block 23, of Ashford Greens Subdivision No.2. The existing zoning designation for this subdivision is R-4 (Low Density Residential). This phase of Ashford Greens Subdivision is located east ofN. Black Cat Road and north ofW. Cherry Lane, in the SW % of Section 3, T.3N., R.lW. The applicant filed for, and received approval on October 5, 2004, for their requested vacation of the existing public utilities, drainage and irrigation easements on Lots 43-45, and Lots 88-91, Block 23 of Ashford Greens Subdivision No.2. The submitted final plat substantially complies with the approved preliminary plat. There is one lot less on the final plat than was approved on the preliminary plat; however, staff has no objection to this change. Staff recommends approval of Ashford Green Subdivision No.8 with the comments and conditions stated in this report. Applicant is to meet all terms of the approved Annexation, Preliminary Plat, and Conditional Use PeITnit for this subdivision. 2. Fencing must be in compliance with MCC 12-4-10. 3. Revise or add the following notes on the face of the plat: (1.) ".. .public right-of-way line ami the exteri8r s¡,¡édi:isisliéø¡,¡¡¡tÌa.". have a ten..." (4.) "Each side of interior lot lines and alonfI the northerlv side of Lot 3 and the southerlv side of Lot 1. Block 32 shall have a five-foot..." (7.) Bottom elevation of structural footinfIs shall be set a minimum of 12-inches above the hifIhest established normal flroundwater elevation. "BuildinfI setbacks and dimensional standards in this subdivision shall be in compliance with Title 11 and Title 12 of the Meridian Citv Code unless otherwise modified bv Conditional Use Permit" (Setbacks for Block 33) Delete the side yard setbacks that deal with comer lots since there are none in this phase. (8.) 4. The applicant has indicated that the pressure irrigation system within this development is existing. Service locations shall be adjusted to the new lot configuration. 5. Label the "Real Point of Beginning" on the face of the plat. 6. Sanitary sewer and water service to this site shall be via the existing mains adjacent to the proposed subdivision. Applicant will be responsible to provide a plan to the Public Works Department detailing the abandonment of, or installation of new sanitary sewer and water services. Prior to signature on the final plat by the City Engineer, the applicant shall either complete the construction detailed above, or post surety for 110% of the construction costs. 7. Applicant shall be required to pay Public Works development plan review, and construction inspection fees, as determined during the plan review process, prior to signature on the final plat per Resolution 02-374. 8. Compaction test results must be submitted to the Meridian Building Department for all building pads receiving engineered backfill, where footing would sit atop fill material. 9. Staff's failure to cite specific ordinance provisions, or terms of the previous approvals for this subdivision does not relieve the Applicant of responsibility for compliance. STAFF RECOMMENDATION Staff recommends approval ofthe final plat with the above stated comments and conditions.
