This is an appeal to the decision made regarding file number MCUP04-O45. The decision
requiring us to pave the alley is un:1àir. It is imposing additional costs that were not
imposed on other occupants. Currently, there are four other businesses on the alley, two
of which (124 E. Pine and 128 E. Pine) have been recently allowed to open without
paving any portion of the alley. Prior to purchasing the property, Craig Hood, City of
Meridian Planning and Zoning, mentioned that Ada County waived the paving of the alley
with all other applicants that requested Conditional Use Permits so there was no reason to
expect that added cost.
In addition we request the commission re-evaluate the usage of the existing drive that has
been in existence since 1929. We would be willing to use it for employee parking or
modifY the plan as an entrance (right-in only) for the proposed parking area. We would
have no problem upgrading the gravel drive to a paved drive. Due to vehicles blocking the
alley, access is limited. Also, with current City parking problems, access to the parking lot
fÌ'om Pine would be beneficial. It would be fuasible if the existing driveway were a one-
way entrance off of Pine with an exit through the alley.
Per request, the only examples would be the existing parking lot on the south side of Pine
and possibly a parking space directly behind the building to the west, 906 N. Main. The
entrance of the City parking lot is 57 feet closer to the intersection than this proposed
entrance and the exit is directly across the street. Currently, the driveway at 116 E. Pine is
158 feet fÌ'Om the intersection and according to the information given by the staff; it
appears that a one-way entrance or exit is allowable if it is further than 85 fuet fÌ'om a
signalized intersection (District Policy 72-F4 and 72-F5). The staff also states that there

no other existing drives on this block with the exception of the above stated City parking
lot.
