"applicant work with staffto develop an appropriate parking scheme that meets the
intent of this discussion this evening." (ModifY Site Specific Condition # I) See

E. Outstanding Issue(s) for City Council:
1. At the December I, 2004 ACHD Commission meeting the District approved the
applicant's appeal of the requirement to pave the abutting alley and granted the
applicant a one-way, right-in access from Pine Avenue.
2. The applicant has submitted a revised site plan, labeled CI.O, prepared by B & A
Engineers, dated December 10, 3004. The revised site plan shows a one-way entrance
into the site from Pine Avenue with three (3) 45-degree parking stalls behind the
building on the east side of the site and four (4) 90-degree parking stalls on the west
side of the site. The one-way drive aisle to the parking area from Pine Avenue is 12-
feet wide, and the drive aisle adjacent to the parking is 24-feet wide. Staff is
supportive of the proposed I2-foot wide, one-way drive aisle from Pine Avenue.
Staff is also supportive of the proposed traffic signs proposed near the driveway
along Pine Avenue: "Do not block entry" and "One way entrance only". To keep
patrons from exiting onto Pine Avenue, the applicant should be required to add a
"Do not enter" sign at the terminus of the drive aisle (near the northeast corner of
the building). Of the three proposed 45-degree parking stalls, one is a compact stall (9'
by 15'), one is a standard stall (10' by 15'), and one is a van accessible stall (10' by 15'
with a ramp landing). Staff is supportive of this design with the caveat that the
striping for the stalls be extended two more feet to make them IS-feet long
measured perpendicular to the property line. In addition, the wheel stops for the
4S-degree stalls should be removed. NOTE: The applicant may have to shift the
parking stalls to the north to keep the van accessible stall from encroaching into
the one-way drive aisle. Of the four 90-degree parking stalls, one is a van accessible
stall (9' by 17' with a van landing), and the other three are 9' by 17' with wheel stops.
The applicant is showing a 3-foot strip between all of the proposed parking stalls and
the property lines. The width and design of the landscape strip was a topic of
discussion at the P & Z Commission hearing and the proposed 3-foot wide strip is
consistent with the intent of that hearing. Staff is supportive of the 3-foot wide strip
(buffer) between the parking area and the east and west property lines. The
applicant should not be required to plant trees within these buffers, but should be
required to install some type ofIandscape material within the buffers. MCC 11-13-
4.F does not include dimensions for hybrid parking areas that contain 45-degree stalls
on one side and 90-degree stalls on the other side of a drive aisle. The minimum drive
aisle width for a one-way, double-loaded, 45-degree parking lot drive aisle is 13-feet
(MCC 11-13-4.F). The minimum width for a two-way, double-loaded, 90-degree
parking lot drive aisle is 25-feet (MCCI1-13-4.F). Staff is generally supportive of the
proposed parking stall dimensions and layout as it appears to be an ideal design
for such a narrow lot. However, as mentioned above, the 4S-degree parking stalls
need to be 2-feet longer (IS-feet measured perpendicular to the property line),
reducing the drive aisle to 22-feet. Based on the P & Z Commission hearing and the
revised site plan, staff recommends that the CoWlcil amend Site Specific Condition #1
to read: "Construct the parkinr! and drive aisles as proposed on the revised site plan
prepared bv B & A Enrdneers. 1nc.. dated 12-10-04 with the followinf! chanf!es:
I) Stripe the 45-def!ree stalls to be 15-feet wide (measured perpendicular to
the propertv line).
2) Maintain at least 12-feet of pavement width for the one-wav drive aisle from
Pine Avenue and 22-feet of pavement width for the drive aisle adjacent to
the parkinfl stalls.
3) In addition to the sif!naf!e proposed. install a "Do not enter" sif!n at the
terminus of the drive aisle (near the northeast corner of the buildinfl) to
discouraf!e vehicles from existinf! onto Pine Avenue.
4) Remove the wheel stops for the 45-deflree parkinf! stalls. and;
5) Install landscape material within the 3-foot wide buffer strips between the
parkinfl areas and propertv lines.
All vehicular use areas shall be improved (paved and/or flravel vaved) in accordance
with Meridian Otv Code. "

Construct the parking and drive aisles as proposed on the revised site plan
prepared by B & A Engineers, Inc., dated 12-10-04 with the following
changes:
I) Stripe the 45-degree stalls to be IS-feet wide (measured
perpendicular to the property line),
2) Maintain at least I2-feet of pavement width for the one-way
drive aisle from Pine Avenue and 22-feet of pavement width
for the drive aisle adjacent to the parking stalls,
3) In addition to the signage proposed, install a "Do not enter"
sign at the terminus of the drive aisle (near the northeast
corner of the building) to discourage vehicles from existing
onto Pine Avenue,
4) Remove the wheel stops for the 45-degree parking stalls, and;
5) Install landscape material within the 3-foot wide buffer strips
between the parking areas and property lines.
All vehicular use areas shall be improved (paved and/or gravel paved) in
accordance with Meridian City Code.

Maintain the existing landscaping adjacent to Pine Avenue in accordance with
MCC 12-13-10. The standard established in the City of Meridian Landscape
Ordinance for mitigation of existing trees (if removed from the site) will be
followed.

All signage for this site shall be restricted to the dimensional standards outlined in
Table C, ofMCC 11-14-10, with a further restriction thatthe maximum height for
a free-standing sign be 6-feet. All signage shall be in accordance with the

standards set forth in Section 11-14 of the City Zoning and Development
Ordinance.
No building or other structure shall be erected, moved, added to or structurally
altered, nor shall any building structure or land be established or change in use on
this site without first obtaining a Certificate of Zoning Compliance (CZC) from
the Meridian Planning and Zoning Department (MCC 11-19-1).
6.
All construction shall confonn to the requirements of the Americans with
Disabilities Act.
7.
Sanitary sewer and water service shall be from the city of Meridian's existing
systems adjacent to the site. The Public Works Department will evaluate the
existing use against the proposed use to detennine if additional assessment fees
will need to be collected. Upgrading of existing service lines may be necessary to
provide a level of service different from a residential use.
8.
Outside lighting shall be designed and placed in such a manner as to eliminate
glare and illumination of the adjoining roadways and properties, in accordance
with City Ordinance Section 11-13-4.C.
9.
All required improvements must be complete prior to obtaining a Certificate of
Occupancy for the proposed development. A temporary Certificate of Occupancy
may be obtained by providing surety to the City in the fonn of a letter of credit or
cash in the amount of 110% of the cost of the required improvements (including
paving, striping, landscaping, and irrigation). A bid must accompany any request
for temporary occupancy. Any temporary occupancy will not exceed 60 days to
complete the required improvements.
10.
The applicant's (or successor's) failure to comply with any of the tenns of
approval of the conditional use permit shall be cause for revocation of the
conditional use permit.
OTHER AGENCYIDEPARTMENT COMMENTS/CONDITIONS
MERIDIAN FIRE DEPARTMENT
I. All processes & storage practices shall be required to comply with the International
Fire Code.
SANITARY SERVICE COMPANY
1. SSC has no comments related to this application.
MERIDIAN PARKS DEPARTMENT
1. Standard Plan for Protection of Existing Trees during Construction: The standard
established in the City of Meridian Landscape Ordinance (MCC 12-13-13) will be
followed.
ADA COUNTY HIGHWAY DISTRICT
Site Specific Conditions of Approval (written in accordance with policy)

Reconstruct the driveway on Pine Street as a curb return with IS-foot curb radii
(similar to City lot across the street). Sign the driveway as "ENTRANCE ONLY"
on Pine Street, and install a "DO NOT ENTER" sign where the driveway
intersects the proposed parking lot to deter vehicles trying to exit out to Pine
Street.
Comply with all Standard Conditions of Approval.
Standard Conditions of Approval
1. Any existing irrigation facilities shall be relocated outside of the right-of-way.
2.
All utility relocation costs associated with improving street frontages abutting the
site shall be borne by the developer.
3.
Replace any existing damaged curb, gutter and sidewalk and any that may be
damaged during the construction of the proposed development. Contact
Construction Services at 387-6280 (with file number) for details.
4.
Utility street cuts in pavement less than five years old are not allowed unless
approved in writing by the District. Contact the District's Utility Coordinator at
387-6258 (with file numbers) for details.
5.
All design and construction shall be in accordance with the Ada CoWlty Highway
District Policy Manual, ISPWC Standards and approved supplements,
Construction Services procedures and all applicable ACHD Ordinances Wlless
specifically waived herein. An engineer registered in the State of Idaho shall
prepare and certify all improvement plans.
6.
The applicant shall submit revised plans for staff approval, prior to issuance of
building permit (or other required permits), which incorporates any required
design changes.
7.
Construction, use and property development shall be in confonnance with all
applicable requirements of the Ada CoWlty Highway District prior to District
approval for occupancy.
8.
Payment of applicable road impact fees are required prior to building construction
in accordance with Ordinance #198, also known as Ada County Highway District
Road hnpact Fee Ordinance.
9.
It is the responsibility of the applicant to verify all existing utilities within the
right-of-way. The applicant at no cost to ACHD shall repair existing utilities
damaged by the applicant. The applicant shall be required to call DlGLINE (1-
800-342-1585) at least two full business days prior to breaking ground within
ACHD right-of-way. The applicant shall contact ACHD Traffic Operations 387-
6190 in the event any ACHD conduits (spare or filled) are compromised during
any phase of construction.
10.
No change in the tenns and conditions of this approval shall be valid unless they
are in writing and signed by the applicant or the applicant's authorized
representative and an authorized representative of the Ada County Highway
District. The burden shall be upon the applicant to obtain written confinnation of
any change from the Ada County Highway District.
11.
Any change by the applicant in the planned use of the property which is the
subject of this application, shall require the applicant to comply with aU rules,
regulations, ordinances, plans, or other regulatory and legal restrictions in force at
the time the applicant or its successors in interest advises the Highway District of
its intent to change the planned use of the subject property unless a
waiver/variance of said requirements or other legal relief is granted pursuant to
the law in effect at the time the change in use is sought.
