MERIDIAN AND MERIDIAN DEVELOPMENT CORPORATION
FOR IMPLEMENTATION AND CONSTRUCTION OF MDC IMPROVEMENTS FOR PINE
AVENUE PROJECT
This FIRST AMENDMENT MEMORANDUM OF AGREEMENT BETWEEN CITY OF
MERIDIAN AND MERIDIAN DEVELOPMENT CORPORATION FOR IMPLEMENTATION
AND CONSTgUCTION OF MDC IMPROVEMENTS FOR PINE AVENUE PROJECT is entered
into this 2.3r day of January 2018 by and between the City of Meridian, a municipal corporation
organized under the laws of the state of Idaho ("City") and Meridian Development Corporation, an
urban renewal agency established under the laws of the state of Idaho ("MDC").
WHEREAS, on November 22, 2016, City and MDC entered into a MEMORANDUM OF
AGREEMENT BETWEEN CITY OF MERIDIAN AND MERIDIAN DEVELOPMENT
CORPORATION FOR IMPLEMENTATION AND CONSTRUCTION OF MDC IMPROVEMENTS
FOR PINE AVENUE PROJE ("Agreement") to cooperatively fund certain improvements located
along Pine Avenue; and
WHEREAS, the Parties learned that certain trees were not included in the Agreement as being
the responsibility of MDC and the Parties would lice to amend their Agreement to include additional
funds to purchase trees to be included in the landscaping improvements along Pine Avenue in an
amount not to exceed thirty-two thousand dollars ($32,500.00);
NOW, THEREFORE, in consideration of the mutual covenants of the parties contained herein
and in the November 22, 2018 Agreement, the Parties agree as follows:
I. The Parties hereby agree that additional funds in an amount not to exceed thirty-two thousand five
hundred dollars ($32,500.00) are to be included in the amount to be reimbursed to the City under
Agreement. These funds are for trees which are to be included in the improvements to be
completed along Pine Avenue under the Agreement.
H. Except as expressly modified by this First Amendment or other duly executed addenda, all
provisions of the November 22, 2016 Agreement shall remain in full force and effect.
IN WITNESS WHEREOF, the parties shall cause this First Amendment to be executed by
their duly authorized officers to be effective as of the day and year first above written.
