Subdivision - Letter of Intent
Dear Mayor and City Council Members:
On behalf of Sitzlar Real Estate Development, LLC, please accept ou~ conditional use/planned
development application for Sparrowhawk Subdivision. The subdivision is located at 1960 Franklin
Road in Meridian, Idaho, on the northeast comer of North Nola Road and East Franklin Road.
The site contains 20.20 acres. Currently, the property contains a single-family residential home and
accessory structures, with the remainder Of the property undeveloped. This site has been annexed :
into the city limits of Meridian and rezoned to C-G (General Commercial) under AZ-00}24: The
applicant has also signed a Development Agreement with the City of Meridian regarding the
development of this property. It is also understood within the Devalbpment Agreement that each
use within Sparrowhawk Subdivision is subject to a conditional use permit regardless if the use is
allowed or not.
At this time, the applicant is requesting detaile~l conditional use approval for an apartment
complex which will be located on Lot 1, Block I of Sparrowhawk Subdivision and conceptual
conditional use approval of various retail, warehousing and office uses on Lots 2 and 3, Block 1
as detailed on the site plan.
Sparrowhawk Subdivision
Sparrowhawk Subdivision, as of this submittal date for this conditional use/planned development
application, has preliminary plat approval by the Meridian City Council under PP-OO-26. The
final plat application has been submitted, however the hearing date for the City Council review
and approval is not until January 15, 2002. We are proceeding on the assumption the final plat
will be approved prior to a City Council hearing on the conditional use/planned development
application and if it has not been approved, a condition of approval On the conditional use permit
will be no building permits will be issued prior to recordation of the final plat of Sparrowhawk
Subdivision.
Request for Detailed Conditional Use Approval
As stated above, the applicant is asking for detailed Conditional use approval for a 54-unit
:apartment complex that will be known as "The Foothills Apartments". The apartments will
consist of one (1), two (2) and ttn'ee (3) bedroom townhouse-style apartments that will remfiin
under one ownership.
Under the approved C-G zoning dis'a'ict, apartments are not an allowed use. Under Sections 12-6-
3 and 12-6-4 in the Meridian Zoning Ordinance, the City Council may authorize Specific uses not
normally permitted by the use regulations of the zone in which the development is located as long
as no more than twenty percent (20%) of the total area oftha project shall be devoted to the uses
permitted by the exception. When combined with the other uses within the planned development,
the apartment use constitutes less than twenty percent (20%) oftha total area of the project.
Even though the other uses that are proposed with the conceptual conditional use portion of this
planned development are allowed uses in the C~G zoning district, the applicant signed and
recorded a Development Agreement with the City of Meridian as a part of the annexation and
rezone, stating that any and all development on this site will be subject to conditional use review
by the city.
Request for Conceptual Conditional Use Approval
In addition to thc request for detailed approval of the apartments, the applicant is requesting
approval of a number of conceptual uses at this time as well. It is understood that when the
applicant is prepared to construct building pad, a detailed conditional use application shall be
approved by the City Council.
At this time the applicant is requesting conceptual approval of the following uses as shown by the
site plan:
· 6,000 square feet of a combination convenience store/fast food
estabhshment/antomobile service station;
· 360 square feet of automobile washing facilities;
· 34,800 square feet of retail uses;
· 9,600 square feet of warehousing uses;
· 54,800 square feet of office uses;
· 10,000 square feet dedicated to a gymnastics center (Meridian Planning and
Zoning Staffhave advised the applicant that this use is classified under the same
category as a private school which requires a conditional use in any zone);
· 9,600 square feet of hank/financial establishment uses;
· 9,600 square feet of restaurant uses
The applicant has been directed by Meridian Planning and Zoning Staff that it is more reasonable
to only pursue conceptual conditional use approval for those uses that are only envisioned at this
time. The alternative is potentially modifying a detailed conditional use application should the
exact uses, building footprints or building elevations change in the future.
The Ada County Highway Dis~ct (ACI-ID) reviewed this site with the submittal of the plat for
Sparrowhawk Subdivision. With that application, ACI-ID approved three (3) curb cuts along East
Franklin Road and one (1) curb cut along North Nola Road. With the proposed site:plan for the
planned development, the applicant is utilizing all allowed curb cuts and will provide cross access
easements throughout the development.
Parking calculations have been based on City of Meridian parking standards as per the Zoning
Ordinance. It is understood the parking with the conceptual uses will be reviewed with each
detailed application and this is only an estimate. With the square footage of the proposed
conceptual uses, the applicant is required to provide 397 parking spaces. As shown on the site
plan, the applicant is providing 411 standard parking spaces and 30 handicapped parking spaces
for a total of 441 parking spaces, well above what is required.
Amenities for the Planned Development
The apartment complex is providing several amenities on-site for the enjoyment Of the residents.
Those amenities include a 2,448 square foot community bnildmg, a tot lot, a swimming pool and
a barbecue and picnic area. However, these amenities will only be available to those living in the
apartment complex.
The other portion of the site will offer the following amenities for those who work or patronize
the other uses:
· Two (2) separate landscaped patio areas with picnic tables; and
· A five foot ( ) w~de pubhc pedestrian c~rculation system along the perimeter of
the site.
In addition, the overall site is providing nineteen percent (19%) landscaping, well above the
landscaping requirements of the Zoning Ordinance.
Compliance with C/tg of Merltti,~n Comprehensive Plan Policies
The proposed planned development complies with the following City of Meridian Comprehensive
Plan policies:
Economic Development:
· 2.2U: Encourage and support job market expansion that provides for mid-and
upper-range wage scale and benefits;
* 2.3U: Take necessary actions to maintain low unemployment;
· 3.1U: Approve quality housing projects that mcct thc needs of all economic
levels.
Land Use:
· 1.5U: Encourage a balance of land uses to ensure that Meridian remains a
desirable, stable and self-sufficient community;
· 2.1 U: Support a variety of residential categories (urban, rural, single-familyl
multi-family, townhouscs, duplexes, apartments, condominiums etc.) for the
purpose of providing the City with a range of affordable housing opportunities;
· 4.1U: Neighborhood Shopping Centers, rather than strip commercial
development shall be provided for convenience shopping services;
* 4.2U: Neighborhood Shopping Centers should locate:
A.) Near, but not necessarily at, the intersections of collectors and/or
arterial roads.
4.3U: Encourage new commercial development within under utilized existing
commercial areas;
5.8U: Development in these areas should be based on functional plans and
proposals in order to ensure that the proposed uses conform to the
Comprehensive Plan policies and are c~mpatible with the' surrounding
neighborhoods.
5.9U: The integhty and identity of any adjoining residential neighborhood
should be preserved through the use of buffering techniques, including screen
plantings, open space and other landscaping techniques;
· 5.10U: Development should be conducted under Planned Unit Development
procedures and as conditional uses, especially when two or more differing uses
are proposed;
· 5.11U: The character, site improvements, and type of development should be
harmonized with previously developed land in the area, and where located
adjacent to or near any existing residence or residential area, shall be harmonized
with residential uses, and all reasonable efforts shall be made to reduce the
environmental impact on residential areas, including noise and traffic reduction;
· 5.13U: Clustering of uses and controlled access points along arterials and
collector streets will be required;
· 5.14U: Because these areas are near 1-84, Franklin and Overland Roads, high
quality visual appearance is essential. All development proposals in this area will
be subject to development review guidelines and conditional use permitting
procedures; and
5.15U: The mixed-use area in the vicinity of the Overland Road/Franklin
Road/Eagle Ruad/I-84 interchange is a priority development area.
In all, we feel that this development is a nice fit into the overall plan envisioned by the City of
Meridian for this area. The submitted site plan has been designed based on Ada County Highway
Dislrict policy and the City of Meridian Zoning Ordinance standards. If you have any questions,

PROJECT NARRATIVE DESCRIPTION
The Foothills will be built to serve Iow-income residents in the City of Meridian,
Idaho and surrounding communities. It will consist of 54 individual apartments
with 16 two-bedroom units, 24 three-bedroom units, 6 three-bedroom
townhouses and 8 four-bedroom townhouses. The development will target
families whose median incomes are at or below the 30%, 40%, 50% and 60%
levels. Based on comparisons with other' existing developments in Meridian; our
proposed rents, apartment mix, amenities and overall project design will be
extremely attractive to the Meridian population.
For the benefit and welfare of its tenants, the development will include a 2,500
square foot community building consisting of an office, kitchen, laundry facilities,
a full maintenance room, exercise room and an education/computer room.
Concrete pads with tables, benches and barbecues situated throughout the
project and surrounded by plenty of open space will serve as an excellent setting
for family gatherings. For children, a large playground area with equipment will
provide a perfect place for recreation. The project's laundry facilities will face the
play area to provide supervision and maximize child safety. Additionally, the
development will include a basketball court and a swimming pool.
Within the units, tenants will enjoy such added features as microwaves,
dishwashers and garbage disposals. Kitchens will also include standard features
such as refrigerators, exhaust fans and ranges with ovens. All three and four
bedroom units will include hook-ups for washers and dryers.
Three handicap accessible units will serve disabled individuals and families. One
unit will also be designed and constructed specifically for individuals with sensory
impairments. The design of these apartments will adhere to all necessary
requirements to satisfy Section 504 as well as any additional mandates deemed
appropriate by the City of Meridian or other governmental entities with jurisdiction
over the development.
At present, the neighborhood is best described as mixed residential with
commercial, offices and retail properties located along the primary arterial
frontages transitioning to multi-family and single-family residential in
neighborhood interiors. The site is currently bordered on the south by a
residential subdivision. To the North and to the East is Locust Grove Industrial
Park. Directly west is vacant land. The site is also one-half mile from
Crossroads Middle School and River Valley Elementary School is one mile north.
Meridian High School is two miles northwest. The Meridian Central Business
District is one mile west of the site.

NOTICE IS HEREBY GIVEN pursuant to the Ordinances of the City of Meddian
and the Laws of the State of Idaho, that the Meridian Planning and Zoning Commission
of the City of Meridian will hold a public headng at the Meridian City Hall, 33 East Idaho
Avenue, Meridian, Idaho, at the hour of 7:00 p.m. on March 7, 2002, for the purpose of

During the public hearing March 4, 2002 several items were noted that were to become
modifications to the proposed Master Site Plan.
The following modifications to the Foothills Apartment Site plan were made at the request
of the City of Meridian: 1) A detailed Landscape Plan for the modified Apartment Site layout.
2) 6' high perimeter fencing added along the East and North property line. 3) Basketball court
rotated to allow more parking at community center building. 4) a landscaping island has been
added along the north parking area. 5) a landscaping island has been added along the eastern
parking area.6) Van accessible stall has been added and total parking stalls has been increased
to 128 spaces from 108 previously shown. 7) sidewalk perpendicular to parking stalls have
been increased to 6 ft. width. All other walks to be 5 ft. wide. 8) Additional landscaping has
been added along the buffer areas along the north property line. The 20 ft. minimum buffer
and additional landscaping has been provided to the buffer to the south at the restraunt pad.
9) The community building has been rotated. Two of the apartment buildings were
rearranged on the site to accommodate better landscape buffers and more parking spaces.
The Master Site Landscaping Plan has also be~n revised to show the landscaping berms and
tree plantings along the street frontages. Specifically designed by the Land Group for this
project. Your review and approval of this application and submittal drawings will be much

In an effort tO provide local officials with an opportunity to comment or provide feedback on
affordable housing developments proposed in their community, the Idaho Housing and
Finance Association is hereby notifying you that the affordable housing development
referenced above is proposed in your area. This development will compete with other
applications submitted for Low-Income Housing Tax Credits.
The Low-Income Housing Tax Credit Program provides tax incentives to developers of
affordable housing who designate at least 20% of the units in a development as affordable
for families at designated income levels. The Idaho Housing and Finance Association, the
administrator of the credit for the State of Idaho, awards the state's credit authority to
sponsors Who have successfully competed under the Allocation Plan approved by the
Governor and Association's Board of Commissioners.
If you would like to comment on tine proposed project, please include the following points in
your response:
~ Describe any local economic factors which may affect the feasibility of the
proposed development;
· Describe the general community support for developments which are
designated to assist households with limited income; and
· Please specifically address whether you feel: that there is a need for
additional rental units of this type in your community.
In previous responses from local leaders, we have been informed that public hearings by the
developer and/or local municipalities can often be helpful in determining community support.
Letters of community support will not be accepted from public officials or public housing
agencies !hat have a relationship or material involvement in the development.
Should any subsequent issues or concerns arise prior to our final determination, please
notify us accordingly.
