Cherry Lane Meridian, Idaho 83642 RECEIVED FEB 2 6 2002 City of Meridian City Clerk Offie~ Re' Staff Level Approval Hearthstone/MPFP01-009 MAZ01-026 4225 West Cherry Lane 2-lot residential subdivision Facts and Findings: The Ada County Highway District (ACHD) staff has received the above referenced application requesting rezone approval for 2.3-acres from zone R-1 to R-4. Applicant is also requesting preliminary plat approval to plat a 2-lot residential subdivision. The 2.3-acre site is located on the south side of Cherry Lane approximately 1/3 of a mile east of Black Cat Road. This development is estimated to generate 10 additional vehicle trips per day (10 existing) based on the Institute of Transportation Engineers Trip Generation Manual. The application and site plan stamped and received by City of Meridian on December 18, 2001, and submitted to the District on December 27, 2001, has been reviewed by *._he ACHD plmrming and Development staff and conforms to applicable District standards/policy, or can be made to conform with the change(s) to the plan described in the requirements stated below. This is a stafflevel approval and will not be heard by the ACHI) Commission unless the site plan is changed in such a manner as to not conform to District standards/policy or an appeal of the Planning and Development staff decision is submitted as described within the Standard Requirements outlined below. D. on January 2, 2002, the District Plann/ng and Development staff inspected this site and evaluated the transportation system in the vicinity. On January 4, 2002, the staffmet as the District's Technical Review Committee and reviewed the impacts of this proposed development on the District's transportation system. The results of that analysis constitute the following Facts and Findings and recommended Site Specific Requirements. Based on development patterns in this area and the resulting trattic generation, staff anticipates that the transportation system will not be adequate to accommodate additional traffic generated by this proposed development at accepted levels of service with out modification to Chary Lane. The additional traffic generated by this development will have minimal detrimental impact on the transportation system. F. There is currently an existing residence on Lot-1 of this site that takes access to Cherry Lane. The existing residence has a circle driveway that is located approximately 1 O-feet west of the east propexty line, and at the west property line of the proposed Lot 1, approximately 125-feet west of a public street on the north side of Cherry Lane. District policy requires driveways on classified roadways to align or offset a minimum of 150-feet from any existing or proposed driveways or streets. The driveway locations do not meet District policy. G. At the Commission meeting on February 20, 2002, the ACI-ID Commission voted to allow both access points to remain to the existing single family dwelling until such time that the lot redevelops or the dwelling is replaced with a new structure. The Commission approved the modification request because of safety concerns relating to vehicles backing out into Cherry Lane, and because the lot generates less than 10 vehicle trips per day. ACI-II) has received a preliminary plat application for the parcel to the eastl and the developer testified at the ACHD Commission meeting on February 20, 2002. That developer is proposing to construct a public street along the east property line of this site. If a street is constructed in that location with another development, this applicant is not required to make any improvements to that roadway. The Commission made the following motion: "The existing access points on Cherry Lane located approximately 10-feet west of the east property line of the proposed Lot 1, and at the west property line of the proposed Lot 1, are approved with this application. Upon redevelopment of Lot 1 (redevelopment defined as a structure requiring a building permit, other than a shed or garage) the easterly driveway shall be closed, and the existing driveway at the west property line of Lot I shall be approved as'the only access to the lot l~om Cherry Lane. An on-site turnaround shall be required at that time to prevent the need to back in to Cherry Lane from the site, and the design of the turnaround shall be approVed by ACHD." The Commission also added that should the property to the east construct a public street along the east property line of this site, then when the parcel redevelops (Lot 1), no access to Cherry Lane will be approved and all access should be taken offofthe local public street. II. The applicant is requesting to utilize an existing approved private road to access the proposed Lot-2 located adjacent to the west property line. The paved private road was approved under file # 99-11-PR on May 5, 1999. The applicant should provide the District with a copy of a recorded access easement among the parcels for use of the private road for access to the public street prior to final plat approval. I. There is an existing curb cut on Cherry Lane located at the east property line of the proposed Lot 2. The applicant is proposing to utilize the existing private road, and therefore the Cherry Lane S:~ STECI~WORKINGXHearthstone.sla.doc Page 2 curb cut is not needed to access the lot. The applicant should replace the curb cut with standard curb, gutter and sidewalk to match existing improvements. The following Site Specific Requirements and Standard Requirements must be met or provided for prior to ACHD approval of the final plat: Site Specific Requirements: The existing access points on Cherry Lane located approximately 10-feet west of the east property line of the proposed Lot l, and at the west property line of the proposed Lot 1, are approved with this application. Replace the unused curb cut on Cherry Lane located at the east property line of the proposed Lot 2, with standard curb, gutter and concrete sidewalk to match existing improvements. Replace any damaged curb, gutter, and/or sideWalk on Chatty Lane to match existing improvements. Segments to be replaced shall be det,mdned by ACHD Construction Services staff. Contact Construction Services at 387-6280 (with file number) for details. Utility street cuts in pavement less than five years old are not allOwed unless approved in writing by the District. Contact ACHD's Utility Coordinator at 387-2516 or 378-6258 (with file number) for details. Meet District drainage requirements per section 8000 of the AC!-TZ) Development Policy Manual. Contact District staff at 387-6170 for details. If utility relocation is necessary to construct improvements required with this development, then all utility relocation costs associated with improving street frontages abutting the site should be borne by the developer. The applicant should provide the District with a copy of a recorded access easement among the parcels for use of the private mad for access to the public street prior to final plat approval. Other than the access points specifically approved with th/s application, direct lot or parcel access to Cherry Lane is prohibited. Lot access restrictions, as required with this application, shall be stated on the final plat. S:',DSTECH\WORKING~-Iearthstone.sla.do¢ Page 3 Standard Requirements: The Commission shah hear and decide appeals by an applicant of the final decision mede by the ROWDS Manager when it is alleged that the ROWDS Manager did not properly apply this section 7101.6, did not consider all of the relevant facts presented, made an error of fact or law, abused discretion or acted arbitrarily and capriciously in the interpretation or enforcement of the ACHD Policy Manual. a. Filing Fee: The Commission may, from time to time, set reasonable fees to be charged the applicant for the processing of appeals, to cover administrative costs. Initiation: An appeal is initiated by the filing of a written notice of appeal with the Secretary of Hi way:Systems, wllie~~ be filed within ten (10)worlring days from the date of the decaslon that ~s the subject of the appeal. The not,ce of appeal shall refer to the decision being appealed, identify the appellant by name, address and telephone number and state the grounds for the appeal. The grounds shall include a written summary of the provisions of the policy relevant to the appeal and/or the facts and law relied upon and shall include a written argument in support of the appeal. The Commi~ion shall not consider a notice of appeal that does not comply with the provisions of this subsection. Time to Reply: The ROWDS Manager shall have ten (10) working days from the date of the filing of the notice of appeal to reply to the notice of the appeal, and may during such time meet with the appellant to discuss the matter, and may also consider and/or modify the decision that is being appealed. A copy of the reply, and any modifications to the decision being appealed will be provided to the appellant prior to the Commission hearing on the appeal. do Notice of Hearing: Unless otherwise agreed to by the appellant, the hearing of the appeal will be noticed and scheduled on the Commission agenda at a regular meeting to be held within thirty (30) days following the delivery to the appellant of the ROWDS Manager's reply to the notice of appeal. A copy of the decision being appealed, the notice of appeal and the reply shall be delivered to the Commission at least one (1) week prior to the hearing. Action by Commission: Following the hearing~ the Commission shall either affirm or reverse, in whole or part, or otherwise modify, amend or supplement the decision being appealed, as such action is adequately supported by the law and evidence presented at the heating. Payment of applicable road impact fees are required prior to building construction in accordance with Ordinance #195, also known as Ada County Highway District Road Impact Fee Ordinance. S:'~D S TECI-BW ORKING'~-Iearthstone.sla.doc Page 4 All design and consmtedon shall be in accordance with the Ada County Highway District Policy Manual, ISPWC Standards and approved supplements, Construction Services procedures and all applicable ACHD Ordinances unless specifically waived herein. An engineer registered in the State of Idaho shall prepare and certify all improvement plans. The applicant shall submit revised plans for staff approval, prior to issuance of building permit (or other required permits), which incorporates any required design changes. Consm~tion, use and property development shall be in conformance with all applicable requirements of the Ada County Highway District prior to District approval for occupancy. Any change by the applicant in the planned use of the property which is the subject of this .. app~c~ti ~o~ shall regui~ .tl~ al~lieam to ¢omt~17~ ~es;re~fio~, ordinurtc~s,plans, or other regulatory end legal restrictions in force at the time the applicant or its successors in interest advises the Highway District o£ its intent to change the planned use of the subject property unless a waiver/variance of said requirements or other legal relief is granted pursuant to the law in effect at the time the change in use is sought. No change in the t~m~s and conditions of this approval shall be valid unless they are in writing and signed by the applicant or the applicant's authorized representative and an authorized representative of the Ada County Highway District. The burden shall be upon the applicant to obtain written confirmation of any change fi'om the Ada County Highway District. Dear Planners: The Meridian School District has experienced phenomenal student growth the last ten years. The high schools, middle schools, and elementary schools throughout the district are operating over capacity. Approval of Hearthstone Subdivision will have a significant impact on school enrollments at Chaparral Elementary, Meridian Middle, and Meridian High School. Additional students will further compound thc current overcrowded situation. Residents cannot be assured of attending the neighborhood school as it may be necessary to bus students to other schools across the district. School capacity is addressed in Idaho Code 67-6508. The Meridian School District is currently operating beyond capacity. Future development will continue to have an impact on the district's capacity.
