the parties of the first part, and hereinafter called the Grantors, and the City of Meridian, Ada County,
Idaho, the party ofthe second part, and hereinafter called the Grantee;
WITNESSETH:
WHEREAS, the Grantors desire to provide a sanitary sewer right-of-way across the premises
and property hereinafter particularly bounded and described; and
WHEREAS, the sanitary sewer is to be provided for through an underground pipeline to be
constructed by others; and
WHEREAS, it will be necessary to maintaffi and service said pipeline from time to time by
the Grantee;
NOW, THEREFORE, in consideration of the benefits to be received by the Grantors, and
other good and valuable consideration, the Grantors do hereby give, grant and convey unto
the Grantee the right-of-way for an easement for the operation and maintenance of a sewer
line over and across the following described property:

The easement hereby granted is for the purpose of construction and operation of a sanitary
sewer line and their allied :fucilities, together with their maintenance, repair and replacement
at the convenience of the Grantee, with the free right of access to such facilities at any and
all times.
TO HAVE AND TO HOLD, the said easement and right-of-way unto the said Grantee, it's
successors and assigns forever.
IT IS EXPRESSLY UNDERSTOOD AND AGREED, by and between the parties hereto,
that after making repairs or performing other maintenance, Grantee shall restore the area of
the easement and adjacent property to that existent prior to undertaking such repairs and
maintenance. However, Grantee shall not be responsible for repairing, replacing or restoring
anything placed within the area described in this easement that was placed there in violation
of this easement.
THE GRANTORS hereby covenant and agree that they will not place or allow to be placed
any permanent structures, trees, brush, or perennial shrubs or flowers within the area

described for this easement, which would interfere with the use of said easement, for the
purposes stated herein.
THE GRANTORS do hereby covenant with the Grantee that they are lawfully seized and
possessed ofthe aforementioned and described tract of land, and that they have a good and
lawful right to convey said easement, and that they will warrant and forever defend the title
and quiet possession thereof against the lawful clairns of all persons whomsoever.
IN WITNESS WHEREOF, the said parties of the first part have hereunto subscribed their
signatures the day and year first herein above written.

EDINBURGH PLACE SUBDIVISION
OFFSITE SEWER EASEMENT
A 20.00 foot wide sanitary sewer easement running parallel to and 10.00 feet on each
side of the following described cenWi"line and lying in the SE 1/4 of the SW 1/4 of Section 29,
TAN., R.\E., B.M., Ada County, Idaho, more particularly described as follows:
Commencing at the 1/4 Section Comer common to Sections 29 and 30 of said TAN.,
R.\ E.;
Thence South 0°25'22" West, 1326.09 feet, on the westerly section line of said Section
29 to the South 1/16th section comer common to said Sections 29 and 30;
Thence leaving said section line South 89°28'46" East, 1327.71 feet, on the north
boundary of the SW 1/4 of the SW 1/4 of said Section 29 to the southwest1/16th comer of said
Section 29;
Thence continuing South 89°28'46" East, 394.71 feet, on the north boundary of the
SE 1/4 of the SW 1/4 of said Section 29 to the REAL POINT OF BEGINNING of this easement;
Thence North 0°31 '07" East, 133.00 feet;
Thence North 89°28'46" West, 478.96 feet;
Thence South 89°05'11" West, 99.74 feet to an existing sewer stub-out pipe lying in Lot
2, Block 4 of Vienna Woods Subdivision, as shown on the plat thereof recorded in Book 80 of
Plats at Page 8667 of Ada County Records, said point being the POINT OF TERMINUS of this
20.00 foot wide easement. The sidelines of said easement are to be extended or shortened to
create a continuous 20.00 foot wide strip ofland.
