Request for Vacation of a Portion of the Five-Foot Utility Easements Located on Lots
26 & 27, Block 1, by Ramsey Homes (File No. VAC-O4-008).
We have reviewed this submittal and offer the following oomments, as conditions of the Applicant.
These conditions shall be considered in ful~ unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY & LOCATION
The applicant, Ramsey Homes, requests approval to vacate the recorded utility easement along the
interiorlot line between Lots 26 and 27, Block 1 of Lochs a Falls Subdivision No.6 along the eastern
boundary of the subdivision. A single family house was constructed on Lot 27 that encroached into
the platted easement. The applicant intends to relocate the side lot line to accommodate the required
side setback for the residence. Approval of the subject easement vacation is required prior to the lot
line adjustment being approved by the City Engineer and recorded.
Lochsa Falls Subdivision is zoned R-4 and is located on the west side ofN. Ten Mile in the Section
26, TAN., R.1W.
Idaho Power, Intermountain Gas, and Qwest have submitted notarized consent for relinquishment of
the easement which the applicant has included with their application. A letter of relinquishment is still
needed from Cable One. The Meridian Public Works Department has no objection to the
relinquishment of the easement.
Staff has no objection to the proposed vacation.

PROCESS
The Subdivision and Development Ordinance (Title 12), Chapter 10, requires the Planning & Zoning
Commission to review and make a recommendation on Vacation applications. A public hearing is then
required before the City Council.
CONDffiONSOFAPPROVAL
1.
Applicant shall obtain and submit a relinquishment of easement trom Cable One to the
Planning & Zoning Department prior to the City Council public hearing.
RECOMMENDATION
Staff recommends approval of the utility easement vacation for Lochsa Falls Subdivision No.6.

In response to your request for comment, the Ada County Highway District (ACHD) staff has reviewed
the submitted application and site plan for the item referenced above. It has been determined that the
Right-of-Way and Development Services Department does not have any site specific requirements for
you at this time due to the fact that the proposed vacation does not affect the transportation system.
If the site plan or use should change in the future, ACHD will review the site plan and may require
improvements to the transportation system at that time.
A traffic impact fee may be assessed by ACHD and will be due prior to the issuance of a building
permit. Contact ACHD Planning & Development Services at 387-6170 for information regarding
impact fees.
Prior to the construction or installation of any roadway improvements (curb, gutter, sidewalk, pavement
widening, driveways, culverts. etc), a permit or license agreement must be obtained from ACHD.
