RE: MERIDIAN H-2017-0145 SWINDELL SUBIVISION MDA
The Idaho Transportation Department (ITD) has reviewed the modification to the development
agreement for the Swindell Subdivision at the northwest corner of East Overland Road and South
Locust Grove Road, south of I-84 milepost 44.90. ITD has the following comments:
1. I-84 is a full access controlled highway. No access to the State Highway system is requested
with this application and none is approved.
2. The interstate fence is typically constructed one foot within ITD Right Of Way, but may vary
due to terrain and other possible issues. All measurements relative to ITD Right of Way shall
be taken from the Right of Way monuments, not from the fence.
3. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway
system.
4. IDAPA 39.03.60 rules govern advertising along the State highway system. The applicant can
contact Justin Pond, Program Manager for ITD’s Headquarters Right-of-Way Section at 334-
8832 for more information.
5. ITD does not object to the development agreement modification for a subdivision being
constructed in this location as presented.
