RE: H-2017-0134 CUP JOHNNY BRONX
The Idaho Transportation Department (ITD) has reviewed the conditional use permit application by
Matt Brown with CTA Architects Engineers for Johnny Bronx requesting a conditional use permit for
a drive-through establishment within 300 feet of another drive-through establishment. The parcel is
located at 4970 North Linder Road, south of US-20/26 (West Chinden Boulevard) milepost 37.29.
ITD has the following comments:
1. This project does not abut the State Highway system.
2. IDAPA 39.03.60 governs advertising along the State highway system. The applicant may
contact Justin Pond, Program Manager for ITD’s Headquarters Right-of-Way Section at 334-
8832 for more information.
3. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.
4. ITD does not object to the construction of a drive-through establishment on the parcel as
presented.
