RE: H-2017-0125 BRICKYARD SUBDIVISION NUMBER 1
The Idaho Transportation Department (ITD) has reviewed the final plat application for 30 building lots and 1
common lot that includes 247 total dwelling units presented by John Carpenter for the Brickyard Subdivision
Number 1 on a parcel located north of East Ustick and west of SH-55 milepost 39.29. ITD has the following
comments:
1. The application packet indicated that a traffic impact study has been conducted for this
subdivision as a whole. ITD requests that it be sent to us for consideration.
2. This property does not abut the State highway system.
3. This development will gain access to the State Highway system at the SH-55 (North Eagle Road)
/ East Ustick Road intersection. Trip generations for the site were not provided. The Idaho
Administrative Proceedures Act (IDAPA) governs access to state highways. Per IDAPA 39.03.42
rules, when a development generates 100 or more new trips in the peak hour, 1000 or more new
trips per day, or the new volume of trips will result from development that equals or exceeds the
threshold values in table 2, a traffic impact study shall be required, unless waived by the District
Engineer. The applicant will be responsible to construct any mitigation identified by the traffic
impact study.

This development exceeds the 100 residential dwelling unit threshold value shown in IDAPA Table 2. A traffic
impact study will need to be provided.
4. Idaho Code 40-1910 does not allow advertising within the right-of-way of any State highway.
5. IDAPA 39.03.60 governs advertising along the State highway system. The applicant may contact
Justin Pond, Program Manager for ITD’s Headquarters Right-of-Way Section at 334-8832 for more
information.
6. The City is reminded that the SH-55 corridor is already congested. This project will increase the
number of vehicle trips in the corridor. ITD has no current funding assigned to mitigate traffic
congestion in the SH-55 corridor in this area.
