Members Present: Mayor Tammy de Weerd, Keith Bird, Joe Borton, Genesis Milam, Ty Palmer, Luke Cavener and Anne Little Roberts. For the record is Tuesday, September 5th at 6:00 p.m. We will start with roll call attendance, Mr. Clerk. Item 2: Pledge of Allegiance De Weerd: Item 2 is the Pledge of Allegiance. If you will all rise and join us in the pledge to our flag. (Pledge of Allegiance recited.) Item 3: Community Invocation by Larry Woodard with Ten Mile Christian Church De Weerd: Item 3 is our community invocation. Tonight we will be led by Larry Woodard with the Ten Mile Christian Church. If you will all join us in the invocation or take this as an opportunity for a moment of reflection. Thanks for joining us, Larry. Woodard: Good to be here again. We thank you, Lord, for watching over our city this summer. Meridian has been so blessed and as our population now creeps over 100,000 people, this is quite an accomplishment. Responsibilities on the Mayor, the City Council grow each day. Bless our leaders and give them wisdom as they tackle the problems of one of the fastest growing cities in the United States. Tonight I want to ask for your help, Lord, and assistance for the people of Houston and nearby Louisiana as they try to recover from one of the most devastating storms in modern history. I cannot imagine 50 inches of rain. We fussed about the height of the Boise River this early summer and it was nothing compared to the hurricane which hit Texas. So, we join with other Americans Meridian City Council September 5, 2017 Page 2 of 26 in praying for these people who in many cases have just lost everything . May the resources to rebuild and recover come more quickly from the national and state level. Also pray tonight for our nation as a whole. The dissension among our people has been disconcerting and now we find ourselves perhaps on the brink of war with North Korea . Should war occur I pray for the citizens of South Korea, Japan, the United States. Protect us from nuclear harm. Bless this meeting tonight and our city leaders, in Jesus' name, amen. The Station Children's Museum Update Meridian City Council September 5, 2017 Page 6 of 26 De Weerd: Item 8-A is under Community Presentations. We had Jacy Jones here and Char. You brought your cheering squad. Jones: I always bring a side kick. Madam Mayor, Members of Council, thank you so much for allowing me an opportunity to speak with you tonight . I will be brief, like -- De Weerd: Jacy, will you pull that closer? Jones: Yes. Is that better? De Weerd: Yes. Jones: I will be brief, uncommonly so for myself. So, it's been about eight months since I was last in front of you to give you an update on what we are doing with the Children's Museum project and we spent that time working on exhibits and programming, marketing and branding. You will notice a name change. And, then, completing the draft of our strategic plan. Some of you had expressed interest the last time that I was here that you would like to remain involved with this project , so I wanted to come and formally invite you on behalf of myself and the board of directors to attend our next advisory committee meeting, which is set for next Monday, September the 11th, at 4:30 p.m. at Maui Wowi. I do have copies of the agenda that I will leave with the clerk, so that you have got that for your records and, then, as a reminder. So, where if you're able to come we appreciate your support. We are always thankful for your support and the support of the community. We have got some good community support with this project and about 34 members scheduled to attend that meeting. So, we are excited about that. So, with that I will stand for questions. I told you I would be really brief. But, essentially, just wanted to invite you and let you know that you're welcome and we would love to see you. De Weerd: Thank you, Jacy. Any questions from Council? Bird: I have none, Mayor. Cavener: Madam Mayor? De Weerd: Any RSVPs? Yes, Mr. Cavener. Cavener: A question -- Jacy, for your meetings are they the -- are they at a set time on a reoccurring basis? I'm unable to come this Tuesday, but would like to maybe attend in the future. Jones: No. That's a good question, Councilman Cavener. Our meetings are scheduled for the second Monday of every month at 4:30 p.m. We are currently hosting them at Maui Wowi, although that location somewhat changes depending on -- well, could change depending on the future and where we end up permanently living. We hope to be in our location sooner rather than later. But that's where we are meeting now. And, then, we Meridian City Council September 5, 2017 Page 7 of 26 will at this advisory committee meeting set out the advisory committee agenda for all of 2018. So, we can send you all of those dates -- all four of them, so that you know well in advance. Cavener: Thanks. De Weerd: Okay. Well, thank you for being here. Jones: Thank you. B. Meridian Arts Commission Update 1. Mural Campaign De Weerd: Look forward to seeing you next week. Okay. Item 8-B is under our Meridian Arts Commission. For their update. Hi, Hillary. Hi, Ellen. Bodnar: Hi. De Weerd: Nice to see you. Bodnar: Thanks for having us here. We just wanted to provide you guys with two quick updates. One of them is more formal than the other. So, in light of the conversation surrounding budget hearings and wanting City Council to have input on the projects that our commission is pursuing with the maps ordinance funds, we are here before you today to request authority to move forward with releasing two RFPs for murals at public sites. We would like to receive -- or solicit RFPs for proposals for Home Court and for -- there is a small piece out here that used to be a waterfall outside of City Hall on the little pathway walking over to the parking lot. So, we would like to get your guys' input and feedback on moving forward with those RFPs. I attached them to your Council packet, but the biggest thing is that they are a little different in that we asked for public input beforehand and stakeholder input beforehand, mainly being the Parks Department, since these are their facilities really, where we included suggestions from the public and stakeholders for content that could be included in those murals. So, that way we are getting proposals that really fit and the vision that the people that are using these facilities are interested in seeing. For Home Court the features that we pulled out -- basically wrote down -- MAC has determined that sports slash activities, natural features from the region and/or community spirit would be valuable components to integrate into the mural. Originally we had talked about that being instead of community spirit we talked about it being featured people, but community spirit is a little more broad and lends itself very well to the City of Meridian, so we can make that change. And for the City Hall site the three things that we kind of suggested for mural content were water and nature, community spirit and service, and/or incorporating Meridian's history as viable concepts integrated into the mural. So, that's really what we are thinking that we should put out there, we should ask for proposals in response to and, then, the Arts Commission and Parks Department and whoever is interested in serving on a selection panel could review purposals received and determine Meridian City Council September 5, 2017 Page 8 of 26 how to proceed from there, whether it's selecting an artist, not taking any of the proposals or so on. We just wanted to reach out to you guys before we got the project going , so that you know what our intentions are. We have also been working with MDC and asked them to contribute a line item for us for the Arts Commission, instead of toward traffic boxes this next year, towards a mural at a private site and the site that we are pursuing with them is the Meridian mill that the Zamzow's own. Our course for that location is not an RFP, but because there are so many different stakeholders, MDC is the sole funder and the Zamzow's -- it's their private building, the Arts Commission recommendation is that we commission a piece specifically for that site. So, working with an artist that we kind of select and determine that would be a good artist to sit down with, start conversations with, make sure they really got the vision from the Zamzow's family, MDC, and the Arts Commission and, then, again, any -- before anything would be finalized coming before City Council again. So, tonight we are just looking for your approval to move forward on the projects and the proceed as outlined. De Weerd: Thank you. Council, any questions? Milam: Madam Mayor? De Weerd: Mrs. Milam. Milam: Hillary, how are these select -- these sites selected? Bodnar: These two public sites? Do you want to go through that a little bit? Milam: Home Court -- so, I'm guessing that's the side where the entrance is, is that -- so, the only way to really see that is people that are going to the Home Court or is this a setting that can be visible from like Franklin or from the road? Bodnar: I don't think it would be visible from the road. No. It would be visitors to Home Court -- to the facility. The restriction with map funds is that they have to be -- they have to be spent on public facilities and Home Court was determined to be a really great asset that the city has that could -- could use something like a large vibrant mural that could really get people excited about what's going on, but -- Milam: Thank you. Borton: Madam Mayor? De Weerd: Mr. Borton. Borton: Hillary, if I recall the proposal had I think a five hundred dollar limit. Bodnar: For the City Hall site. Borton: City Hall site? And what was the other one? Meridian City Council September 5, 2017 Page 9 of 26 Bodnar: Thirty -- thirty-five thousand dollars, because it's such a large mural. What we worry about is not to exceed 35,000. Borton: Okay. Bodnar: And that's also why this project in particular has to go through the RFP process, because it's a got the purchasing threshold. Borton: Madam Mayor? De Weerd: Uh-huh. Borton: So, remind me -- I apologize, I have forgotten. What's the Arts Commission's process on an annual budget basis with -- with the maps proceeds, do they kind of line it out a year in advance? So, does this -- using this much of it for this one project kind of fall in line with what the commission had anticipated? Bodnar: Correct. We had a meeting -- it was about a year and a half ago outlining the -- the public art projects throughout the rest of this -- our strategic plan, which goes through FY-19 and the -- the decision that was made at that point was that we will continue to have MAC outline public art projects in accordance with the ir stated plans. So, again, you will be -- the next time we have a strategic plan you guys will already have the public art projects outlined in there. So, we -- we have planned for public art projects through FY-19 and the murals project what was discussed for this current year . Borton: Okay. Madam Mayor? De Weerd: Mr. Borton. Borton: You probably have already got this already dialed in as well, but if -- if there is a large mural that -- that includes action and activity, that's great from one person's perspective. Color is great and I guess in that regard diversity, not only in the color, but in who is depicted from age and race and abilities and gender and -- it's just an opportunity to kind of embrace what we are trying to promote and support. So, it's probably already on your radar, but that's an opportunity for a large canvas like that. Bodnar: Correct. And we talked about whether or not to include those requirements in an RFP or if they would be included in an agreement later on saying, okay, this is your RFP, this is -- you know, for example, we want to represent another ethnicity in this group, because we have got -- we haven't represented them so far and they are a big -- they are a big group in the City of Meridian. The RFP basically outlines that the -- the proposal could be modified according to the park's needs or city needs. So, our hope was that that allowance there really gave us flexibility to say we love this idea, we like the content, but these are the things we need to make sure to include, if it's not already included. So, it's on our radar. Meridian City Council September 5, 2017 Page 10 of 26 Borton: Sure. As long as it's on the radar. De Weerd: However, I think that rather than an afterthought, if that's going to be a priority criteria you should have it in an addendum or something and here are comments of things -- elements that are important that would -- I guess you can't say be smart to include in your proposal, but -- Bodnar: I think we could find some language that we could include in that content suggestion from stakeholder and public input that says content should be all inclusive, it should encompass multiple genders, religions, whatever it is, to make it as equal as possible. Borton: It's an opportunity to have that, again, on the radar and -- and the proposal may not have people in it, I mean I wouldn't necessarily want to constrict the artist's submission to -- Bodnar: Yes. Borton: -- to the human element, so it could be something else. It doesn't have to be -- to the extent that you choose to provide something like that as your submittal , it's an opportunity to embrace -- DeAngelis: Well, yeah, I think that's a good point and -- I mean, honestly, we don't know what we are going to get back. Borton: Sure. DeAngelis: There aren't a lot of large scale mural artists in our realm and -- there are a few that are really good and could very easily bring that to the table in their first proposal. But, of course, using discretion when we go through the -- the items that are brought to us for proposal and making sure that if we love this design , but it's not -- it's missing diversity, that's something we could go back to the artist with and have the m rework and that's, of course, something that the Arts Commission is always aware of when we are working on a public art project, they should represent the public. So, yeah, it's on our radar. Bodnar: One of our selection criteria also includes consistency with city policy and community values and I think we have kind of outlined that as a value. De Weerd: Okay. Any further comment or direction? Milam: Madam Mayor? De Weerd: Mrs. Milam. De Weerd: All ayes. MOTION CARRIED: ALL AYES. Bodnar: Thank you very much. 2. Heroes Park Update De Weerd: Thank you. The second half to this was an update on Heroes Park. Bodnar: Yeah. So, we just wanted to provide Council with a quick update on this project. We last presented to you the trail markers and we had also listed at that same presentation the heroes that would be presented -- or that would be featured in the primary installation. Since that last appearance -- since my last appearance before Council we decided that another woman -- again speaking of how to incorporate more people -- another woman should be featured in the primary installation. So, worked with the artist and came to the conclusion that we were going to replace Albert Einstein's image with an image of Rosa Parks instead. Just for your -- for your knowledge. And, then, the other discussion that came up after that presentation and update was that instead of using the police image that was featured in the artist detailed plan, we could find -- or we were asked to find an image of a local police officer that might be more easily recognizable as police officers and, then, also have a local impact as well. So, Shelly in the Parks Department had been working on finding an image with the Police Department that we could use and we forwarded an option to Ken McCall, the artist, to see if it would work in his -- in his format. Just a quick update. De Weerd: Thank you. Any questions on that, Council? We appreciate that and you have something going on next week. Bodnar: Art Week. It's starting. It starts actually Saturday. So, the community block party -- they have got some art activities going on there, but also 848 starts -- or the performances are on Saturday as well. So, you can start hiding your art as early as Saturday and finding art as well. And Dwight and Barbara Williams have already dropped off framed pieces. If you guys can at least get out and try to find some art, it's a really fun way to get involved in the community and also meet some cool new people. De Weerd: Very good. Bodnar: Yeah. Final Plat for TM Crossing Subdivision No. 2 (H-2017-0110) by Brighton Investments, LLC Located North Side of Interstate 84, East of S. Ten Mile Road De Weerd: That one will be difficult to hide. Thank you for the demonstration. Don't do that at home. It's very dangerous. Okay. He will move to Item 9, under Action Items. Item 9-A is final plat for H-2017-0110. Caleb. Hood: Thank you, Madam Mayor. First action item tonight is a final plat for TM Crossing Subdivision No. 2. The site consists of 18.93 acres. Currently zoned C-G, general retail and service commercial. As you can see on the -- the red arrow that's pointing there on the diagram on the left, the site is located north of Interstate 84 and just east of South Ten Mile Road. The first page -- the first phase of this project is further back to the west . There are five commercial building lots and one common lot. The applicant is here this evening, Mike Wardle. There was one change that they asked to the -- the staff report, that's why it's not on the Consent Agenda. Site specific condition number four, they have asked for -- instead of property owner or business owners association to be the responsible party for owning and maintaining the common area where the Purdum -- Purdum Drain is located -- so, on the bottom of the screen, the diagram on the right, which is the final plat, the Purdum Drain runs along the southern boundary and instead of , again, the business owners association or property owner, they'd like to change that to operator. Staff does not have an issue with -- with this request. Again, the applicant is here, though, if you have any questions or need any clarification. With that I would stand for any questions. I was curious what the distinction is with an operator. If it's not the owner or not an association -- Wardle: Madam Mayor, Mike Wardle, Brighton Corporation. 12601 West Explorer Drive in Boise. We are talking -- there is some technical issues and let me just clarify that the common lot -- and it's the only common lot in the plat -- is purely the Purdum Drain area and it's not the type of thing that you can put into the responsibility of the business owners in the project itself, it's something that -- in this particular case by the recorded declaration and covenants and restrictions for the project actually identify the operator as the declarant or Brighton, the owner of the -- you know, the developer. So, we have, then, the responsibility, even though -- if there are maintenance costs it comes out on a square foot basis from the -- all of the properties, but there are two types of common area. One is parcels and that would be anything that relates specifically to the building itself and , then, there is projects and in this case it's only drains. I would note that, Madam Mayor and Council Members, that the -- the big lot here is the new Paylocity building and so we are -- we are planning that one to get one moving, but -- so, just a technical term and we -- the staff agrees with the change that we requested, so we would ask your concurrence with that. Ustick Road Meridian City Council September 5, 2017 Page 14 of 26 De Weerd: Item 9-B is a final plat for H-2017-0116. I will turn this to Caleb. Hood: Thank you, Madam Mayor, Members of the Council. The second action item tonight is another final plat. This one would have been on the Consent Agenda, but just didn't work out to get that on -- on the Consent Agenda before this meeting. So, just a brief overview of this project. There are 37 single family residential building lots and two common area lots on 4.4 acres of land, zoned R-15. This is the second phase of this project as well. Here is the overall aerial for the Verado project. Phase two is right here. You can kind of see the inset or that cut out from the existing home that's not a part, so this phase two goes in this general vicinity here. The rest of this phase one has already been final platted. And, again, we do have a letter from the applicant agreeing to all the conditions in the staff report and I told them not to be here tonight , because they had agreed to all of the conditions. So, hopefully, if you have any questions I can answer them, but with that, Madam Mayor, that concludes staff's report. De Weerd: Thank you, Caleb. Council, any questions? Bird: Madam Mayor? It is located on the south side of Franklin Road, just west of Linder Road. The mailing address is 1845 West Franklin Road. It's just shy of eight acres -- Meridian City Council September 5, 2017 Page 16 of 26 7.99 acres. It does have split zoning as you can see on the vicinity map here. Most of it is zoned TN-R, Traditional Neighborhood Residential, and there is some small pieces along the northern part of the property along Franklin Road that are zoned C-C. There is also a pond on that finger that's also zoned C-C, but a large -- large portion of the site is zoned TN-R. The request is for a short plat consisting of four building lots and one common lot, although I do want to draw your attention that staff has a condition in the staff report to include two additional common lots. The plat on -- on the left not only has a drive aisle and a common lot, there are two open space common area lots with clubhouses and other open space here and here. Staff is recommending that they make those separate common lots apart from the common driveway access roadway, just for clarification on -- on amenity lots versus use lots. But it's still one common lot as depicted on this final plat. But, again, there is a condition that this area here, including that pond I referenced earlier, which you can see on the site plan more, this will be on a -- on a separate common lot, as well as down below. We do have -- we did receive late this afternoon an e-mail from the applicant stating that they are in agreement with the staff report. We will also just call to your attention the remainder portion of this -- this project has previously been platted as well, so, again, this is -- it's phase two, although this is a short plat and so it doesn't -- that nomenclature of phase two or phase three doesn't apply here, but this -- this area here is also being developed by the same party and has gone through that process. This actually went through our process -- I'm ballparking something here, but about 12 months ago the details for the townhouses and the multi-family have already been through the public hearing process, so there aren't any elevations with this. Again, it's just a subdivision of land. The buildings have already been through that process. Thompson: Now that raises a question. De Weerd: If you will, please, state your name and address for the record. Thompson: I am Doug Thompson. I live at 1846 West Greenhead Drive, which is just south of the property we are discussing. De Weerd: Thank you. Thompson: Regarding the elevations, when he changed the townhouse part of it from single dwelling units to townhouse units, there was a problem with the windows, that he met with those of us in the neighborhood about. He was going to move those windows and was supposed to have last year sent the renewed elevations. I have never received those. I gave him my e-mail address and he, obviously, has my mailing address, because he has mailed me several letters and I also tried to make a phone call -- but, anyway, I have never received those updated elevations, which should have been updated moving some windows from the back of the building to the sides of the buildings, so that they didn't, from the upstairs, look directly into the back yards of both of us across the -- the Ten Mile Creek. Okay? De Weerd: Thank you. Thompson: You bet. Hood: Madam Mayor, I can make sure that Sonya requests that Mr. Jewett send those revised elevations and we will verify that all conditions of approval for that project are complied with before -- you know, before building permits and occupancy and the li ke, but we will make sure that Mr. Thompson -- to the best we can to get Mr. Thompson those revisions to the those -- to those elevations as they are provided from the applicant. De Weerd: Was that agreement on the public record? Did he make that here, so that we would have it as part of the findings? Yes. Yeah. I'm sorry I didn't ask you that when you were up here. I apologize. Bird: I think he did it just with them. Thompson: I don't know if he made that as part of the public arrangement here, but he made that in a meeting with those of us at the neighborhood on July 26th, 2016, when we met with him at the property. He talked about the change from a single dwelling to a double dwelling and that they were going to be two story, instead of single level, and at Meridian City Council September 5, 2017 Page 18 of 26 that point we talked about the windows and in order to get our agreement he agreed at that point to move those windows. De Weerd: Okay. Thompson: So, I don't know whether he came here and actually made that change or not. Which may be why I have never received the elevation s. I feel a little bit like a frog that's been put in hot water -- or put in water on the stove and -- there has been several changes to this property and each time it's been to increase density and this bothers me. De Weerd: I appreciate that you brought it up, because certainly we would want those expectations and any of those agreements that might not have happened here to make sure that it is part of everyone's understanding, because plans have -- can change without notice. Thompson: Yeah. And I don't know if he came here originally with a single dwelling plan or not, because I know we met with him several times on the property and this is like the sixth or seventh change to the plan that has been proposed, you know. So, there has been a lot of changes over the -- the last three or years to this property since he took it over and, golly, I don't even know where we are anymore, other than I know that there has been an increase in density and I'm concerned about the elementary school to the south of us that was overcrowded last year and now we are going to put another 80 to a hundred homes in there and the other two subdivisions that are going in next door to it -- De Weerd: Thank you. So, I don't know if these elevations are matching -- or what it -- what the gentleman was saying Mr. Jewett was supposed to change, but what he's tied to is what's in this agreement here from September of 2016. De Weerd: Caleb, would it be possible that you could pull those elevations up? Hood: Yeah. Madam Mayor, I'm in the 2016 development agreement. Mr. Nary, what did you say that was? Nary: It says 12 Oaks. It's a development agreement modification and what I'm looking at is the -- Hood: Towards the end of that document? Nary: Yeah. There are attachments to it and those attachments indicate the renderings of the building elevations and I can't tell what -- I can guess what I think the rear of the building is is on page two and they are marked rear elevations, duplex -- the rear elevation of the duplex and, then, on the multi-family buildings are all attached. So, if -- if they are supposed to change from this, this is the last thing that we have I can find in the record as to what the developer is obligated to construct.
