Morrow: I am prepared to make a motion that the Council approve the late comers
agreement for Candlelight subdivision by McBee Corporation subject to the City Attorney
sign off and approval having obtained that we would authorize the Mayor to sign and the
Clerk to attest that late comers agreement.
Rountree: Second
Corrie: Motion made by Mr. Morrow, second by Mr. Rountree to approve the late comers
agreement subject to the Attorney sign off and if it is done so that the Mayor would sign
and the City Clerk would attest, any further discussion? All those in favor? Opposed?

ITEM #8: BILL SIMONS, 675 S. LINDER ROAD: REQUEST HOOK UP TO CITY SEWER:

Freckleton: Mr. Mayor, members of the Council, Mr. Simons came into our office I believe
it was last week, Tuesday. He lives out on Linder Road across from the Landing
Subdivision. His property fronts Linder Road, fronts the sewer and water mains that were
installed by Skyline for the Landing Subdivision. Mr. Simons has been experiencing some
problems with his septic drain field has failed and he requested connection to the sewer.
Last week we explained to him the situation with his property being situated in the County
that it would require a City Council approval and also the situation that exists with having
to pay double assessments for that connection. Mr. Simons did come and he paid the
double assessments, he took care of all of the fees and we got him moving ahead on that.
think he had some comments that he wanted to raise tonight.
Simons: I don't know what comments I want to make but other than the fact, the double
fee kind of bothers me because, I havo, to pay it I will pay it. That street has been torn up
so much so long we have had to alter our way of getting in there on many occasions I had
to park vehicles down the road. I couldn't' get into my own driveway for I don't know how
many times. Then when they built the bridge now they have diverted us around the
subdivision across a lot, I don't even know whose lot is was but it was a vacant lot with
ruts and holes and it was horrendous. I have broken windshield from it. The inconvenience
it was just unbelievable. I anticipate more because they approved a subdivision down the
street and they went halfway back. Now they are going to go down around to Waltman
Lane and then they are going to come back around. So I anticipate one of these days and
I don't even mind being part of the (inaudible) of the City we are surrounded anyway. But
my biggest thing I was wondering if there was any chance of getting a reduced rate.

Morrow: Mr. Mayor, Mr. Simons the issue with the double fees is a requirement of the
bonds that were originally passed to build the sewer plant and the bonds were sold with
that stipulation. So that is not something that this Council or future councils has any say
over at all, it was part of the agreement of the original bonds.
Corrie: Council I will entertain a motion.
Morrow: Mr. Mayor, I would move that we approve the hook ups for Bill and Charmaine
Simons at 675 South Linder Road.
Rountree: Second
Corrie: Motion made by Mr. Morrow, second by Mr. Rountree to. approve the hook up on
the sewer to 675 South Linder Road by Mr. Simons, any further discussion? All those in
favor? Opposed?

ITEM #9: WATER/SEWER/TRASH DELINQUENCIES:
Corrie: This is to inform you in writing if you choose to you have the right to a pre-
determination hearing at 7:30 P.M. November 6, 1996 before the Mayor and City Council
to appear in person to be judged on the facts and defend the claim made by this City that
your water, sewer and trash bill is delinquent. You may retain counsel. The service will
be discontinued on November 13, 1996 unless payment is received in full. If there is
anyone present that wishes to contest their water, sewer or trash delinquency? Hearing
none they are hereby informed that they may appeal or have the decision of the City
reviewed by the Fourth Judicial District Court pursuant to Idaho Code. Even though they
appeal their water will be shut off and the amount of the turn off list is $26,517.16.
Council, entertain a motion on the delinquency turn off list.
