Stokes berry Subdivision Easement Vacation
Request for Vacation of Irrigation Easements in Block I of Stokes berry Subdivision
on the Eastern 10-feetofLots 2, 3, and 4; the Northern 10-feetofLot2; the Southern
la-feet of Lot 3; the Northern 5-feet of Lot 3; and the Southern 5-feet of Lot 4, by
Properties West, Inc. (File No. VA C-04-00 7).
We have reviewed this submittal and offer the following comments, as conditions of the Applicant.
These conditions shall be considered in jùll, unless expressly modified or deleted by motion of the
Meridian City Council:
APPLICATION SUMMARY & LOCATION
The Applicant/Owner, Properties West, Inc., requests approval to vacate the existing Nampa-
Meridian irrigation easements in Block 1 of Stokes berry Subdivision on the eastern 1 a-feet of Lots 2,
3, and 4; the northern la-feet of Lot 2; the southern la-feet of Lot 3; the northern 5-feetofLot 3; and
the southern 5-feet of Lot 4. Stokesberry Subdivision has been re-platted and the configuration of
the lots changed, making the old easements shown on the original plat unnecessary. The new lots
were approved with the required easements.
Stokesberry Subdivision is zoned L-O (Light Office) and is located on the west side ofN. Eagle
Road, approximately Yo. mile north orE. Fairview Avenue, in the NE \4 of Section 5, T.3N., R.lE.
Nampa-Meridian Irrigation District has submitted notarized consent for the easement vacation which
the applicant has included with their application. The Applicant would like to develop the property
with new office buildings on top of the current easement location.
Meridian Public Works has no objection to the relinquishment of the irrigation easements noted
above.
StafIrecommends approval of the proposed vacation of irrigation easements.

SURROUNDING USES
North -Carol Subdivision, residential subdivision zoned R-l & R-2 (City & County).
South - Undeveloped land, zoned RUT (Ada County).
East - N. Eagle Road and property zoned RUT (Ada County.)
West - River Valley Elementary school, zoned R-4.
PROCESS
The Subdivision and Development Ordinance (Title 12), Chapter 10, requires the Planning &
Zoning Commission to review and make a recommendation on Vacation applications. A public
hearing is then required before the City Council.
RECOMMENDATION
StafIrecommends approval of the irrigation easement vacation for Stokesberry Subdivision.
