B. Summary of Public Hearing:
1. The applicant, Ken Elliott of Vision First LLC, testified in favor ofthe application.
2. The Planning & Zoning Commission heard and took oral and written testimony, as
reflected in the Clerk's record and the minutes and duly considered the evidence and
the record in this matter. The majority of the testimony was in opposition to the
project, mainly due to density and traffic issues.
C. Key Issues of Discussion by Commission:
1. Density and lot size issues
2. Cut-through traffic on Dartmoor Drive.
3. Stub Streets
4. Landscaping
D. Recommendation for Denial:
The Planning & Zoning Commission hereby recommends denial of the application for the
following reasons:
a. The outstanding legal issues may place the City in the position for a potential lawsuit.
Without a legal decision stating that there is no need for the Dartmoor property to
remain as open space until March of 2009, the Commission is not willing to annex or
plat the property.
b. The plat needs to provide a better transition from the surrounding large lot
subdivisions, both in terms of increasing the perimeter lot sizes and reducing the
overall density.
c. The issue regarding whether the proposed stub street to the east could ever connect to a
public street needs resolution.
d. The amount of projected traffic on Dartmoor Drive through the existing subdivision is
unacceptable and needs to be decreased.
E. Outstanding Issue(s) for City Council:
The applicant has filed an appeal of the Commission's denial of the Preliminary Plat.
They have submitted a letter and attaclunents for the Council's consideration stating how
they intend to address the reasons for denial. If the Council decides to grant the appeal,
staff recommends setting all three projects aside for a future public hearing on all three
items (AZ, PP, CUP) and sending out new notices to the public.
