DESCRIPTION OF APPLICANT'S REQUEST
The applicant requests Certificate of Zoning Compliance (CZC) and Administrative Design
Review (DES) approval to construct a 673 square foot addition to an existing 9,361 square foot
building and associated site improvements on 0.58 acres of land in the O -T zoning district. The
applicant is proposing to develop the project in two (2) phases as follows:
1. The first phase consist of the addition to the building; and
2. The second phase includes the remainder of the site improvements required with the approval
of the conditional use permit (H-2017-0052).
Staff is amenable to phasing of this project however; all of the improvements approved
with the CZC application must be completed prior to the one year expiration date noted
below.
The site is located at 119 E. Bower Street.
DECISION
The applicant's request for Certificate of Zoning Compliance and Administrative Design
Review is approved with the conditions listed in this report.
Note: This is not a building permit. Please contact Building Services at (208) 887-2211 to
verify if you need a building permit and/or inspection. If you do need a building permit, you
must complete that process before you commence the use or construction. Please contact
Building Services for additional details about building permits and inspections.
Site Conditions of Approval
1. The applicant shall construct all proposed fencing and/or any fencing required by the
UDC, consistent with the standards as set forth in UDC 11-3A-7 and 11 -3A -6B.
Process Conditions of Approval
1. No signs are approved with this application. Prior to installing any signs on the property,
the applicant shall submit a sign permit application consistent with the standards in
UDC Chapter 3 Article D and receive approval for such signs.
2. The applicant shall complete all improvements related to public life, safety, and health
as set forth in UDC 11 -5C -3B. A surety agreement may be accepted for other

improvements in accord with UDC 11 -5C -3C.
3. The site plan/details are approved by the City of Meridian Planning Division as shown
in Exhibit B with the following comment:
• The applicant shall provide stamped civil drawings detailing the drainage of
the parking lot to Land Development for review and approval.
• Add wheel stops to the 10 parking stalls to prevent vehicles from overhanging
over onto the adjacent properties on the east boundary.
4. The elevations are approved by the City of Meridian Planning Division as shown in
Exhibit C.
5. The approved site plan and elevations may not be altered without prior written approval
of the City of Meridian Planning Division.
6. The applicant shall pay any applicable impact fees prior to the issuance of a building
permit.
7. If any changes must be made to the site plan to accommodate ACHD requirements, the
applicant shall submit a new site plan to the City of Meridian Planning Division for
approval prior to issuance of the building permit.
8. The applicant shall complete all required improvements prior to issuance of a Certificate
of Occupancy. It is unlawful to use or occupy any building or structure until the
Building Official has issued a Certificate of Occupancy.
Ongoing Conditions of Approval
1. The applicant shall comply with the outdoor storage as an accessory use standards as set
forth in UDC 11-3A-14.
2. The project is subject to all current City of Meridian ordinances and previous conditions
of approval associated with this site (H-2017-0052)
3. The issuance of this CZC does not release the applicant from any previous requirements
of the other permits issued for the site.
4. The applicant has a continuing obligation to comply with the outdoor lighting provisions
as set forth in UDC 11-3A-11.
5. The applicant and/or assigns shall have the continuing obligation to meet any applicable
specific use standards for the existing use as set forth in UDC 11-4-3-19. The applicant
has submitted documentation from the USDA requesting that the site remain free
of landscaping to deter pests from occupying the site and compromising the
facility.
CITY COUNCIL REVIEW
The applicant or a party of record may request City Council review of a decision of the
Director. All requests for review shall be filed in writing with the Planning Division on or
before August 24, 2017, within fifteen (15) days after the written decision is issued, and contain
the information listed in UDC 11 -5A -6B.
If City Council review of the decision is not requested, the action of the Director represents a
final decision on a land use application. You have the right to request a regulatory taking
analysis under Idaho Code 67-8003.
EXPIRATION
The Certificate of Zoning Compliance shall expire if the construction, alteration or the use has

not commenced within one year of the date of issuance of the Certificate of Zoning
Compliance.
In accord with the above provisions, the subject Certificate of Zoning Compliance is valid until
August 9, 2018.

Dear Bill:
This is the Certificate of Zoning Compliance application for Meridian Meat and Sausage
(H2017-0052). The development of this project will be done in two phases. The first phase is
only the construction of the 673 square foot addition for a freezer at the northwest corner of the
existing building. Existing building has a zero foot setback from the southerly right of way line
of E. Bower Street. This new addition will also have a zero foot setback from the public right of
way of Bower Street. Exterior building materials are CMU block with a cedar fascia, along top
edge of the building. The desire is to build the addition so that it looks like it has always been a
part of the overall building. After the addition is completed the other improvements will be done
in the second phase.

It has come to our attention that the city is asking Mr. Rene Schoop owner of Meridian Meat & Sausage to plant trees and other
shrubbery around his place of business at 119 East Bower, Meridian, Idaho 83642. His is a USDA FSIS inspected facility
(establishment #11061 M)
The city's request for him to plant trees & other vegetation will realistically put Mr. Schoop in a difficult position. His business functions
under federal regulations to eliminate food, moisture and harborage for pests, making their survival more difficult.
Title 9 Code of Federal Regulations § 416.2 - Establishment grounds and facilities.
(a)Grounds and pest control. The grounds about an establishment must be maintained to prevent conditions that could lead to
insanitary conditions, adulteration of product, or interfere with inspection by FSIS program employees. Establishments must
have in place a pest management program to prevent the harborage and breeding of pests on the grounds and within
establishment facilities. Pest control substances used must be safe and effective under the conditions of use and not be
applied or stored in a manner that will result in the adulteration of product or the creation of insanitary conditions.
(3) Walls, floors, ceilings, doors, windows, and other outside openings must be constructed and maintained to prevent the
entrance of vermin, such as flies, rats, and mice.
Trees, shrubs, low-lying vegetation, ground cover (including mulch) and other types of landscaping can all determine how many pests
will find harborage. Most trees produce some kind of nut, fruit, seed or flower, which can all become a food source for many kinds of
pests. If trees are close to a structure, overhanging limbs can act as a bridge for pests to access a building structure. As Mr. Shoop is
currently in compliance with 9 CFR the city's demand is problematic and could jeopardize his long time compliance with federal
regulations necessary for him to operate his facility.
Shrubs can attract insects with seasonal flowerings and may attract ants by the presence of aphids that are feeding on the shrubs.
Densely planted shrubs with foliage that extend all the way to the ground can make an attractive home for rodents and other pests
looking for harborage. When shrubs are planted close to a structure, these pests can very easily make their way into it.
Low-lying vegetation can include weeds, grass, flowers and ivy; these types of vegetation can serve as harborage and can attract many
different pests. Pests like cockroaches thrive in these dense beds of vegetation and in the middle of the summer, these roaches will
move directly from landscape to buildings. As this establishment is also in the vicinity of a railroad and other industrial operations the
chance of increasing the harborage of pests is very likely if vegetation is planted around his property.

The 3yd trash container can be moved to the Southside of the building off the alley by the old glass shop as long as it is
midway between the alley and the building and not under the power wire to the building next door. I have met with the
owner and discussed the location.

Usda does not have a say in that but containers off alleys are not required to have enclosures so it works out ok
